Passed AN ORDINANCE WAIVING COMPETITIVE BIDDING REQUIREMENTS, PURSUANT TO SECTION 8.04 ("CONTRACTING PROCEDURES"), PARAGRAPH (C) rte"" "(WAIVER OF COMPETITIVE BIDDING"), FOR THE PROCUREMENT OF SERVICES TO BY-PASS SANITARY irr..~+ SEWER FLOW, CLEAN AND TELEVISE 4,500 FEET OF SANITARY SEWER LINE WHEREAS, Section 8.04 (c) ("WAIVER OF COMPETITIVE BIDDING") of the Revised Dublin Charter authorizes Council, by a vote of no less than five (5) Members, to waive competitive bidding requirements if it determines that such waiver is in the best interest of the City; and WHEREAS, Council has determined that there is a legitimate basis on which to justify such waiver for the procurement of non-professional services related to by-passing sanitary sewer flows, clean and televise 4,500 feet of a 36-inch sanitary sewer line along Dublin Road; and WHEREAS, Council has determined that such waiver of competitive bidding is truly in the best interest of the City; and NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, ~ of the elected members concurring: Section 1. That competitive bidding requirements are hereby waived for the procurement of services related to bypassing sanitary sewer flows, clean and televise 4,500 feet of a r...~ 36-inch sanitary sewer line along Dublin Road. Section 2. That such waiver of competitive bidding is hereby declared to be in the best interest of the City. Section 3. That this Ordinance shall take effect and be in force from and after the earliest period allowed by Law. Kinds, Director of Engineering/City Engineer~~.~ DATE: April 12, 2001 SUBJECT: Ordinance No. 56-O1 Waiving Competitive Bidding Process Attached, please find Ordinance No. 56-01, for waiving the competitive bidding requirements for the procurement of services to bypass sanitary sewer flow, clean and televise the 36-inch diameter Dublin Road sanitary sewer. This sewer is located primarily parallel to Dublin Road and west of the Scioto River. Last summer, we cleaned, inspected and televised approximately 5900 feet of this sewer and used this information to plan for future CIP projects. This year, it is planned to clean, inspect and televise an additional 4500 feet of sewer. The attached map shows the areas cleaned and inspected last summer and the area proposed to be addressed this summer. The Dublin Road sanitary sewer is 28 years old and can carry 5 million gallons peak flow per day during dry weather conditions. During heavy rains this sewer has a potential of carrying flows of up to 9 million gallons per day. The sewer is suspected to have cracks, defects and problems throughout its length. Before a comprehensive repair budget can be proposed it is essential to determine at what locations and to what extent problems exist. To accomplish this task, the sewer line must be televised. However, before televising, sewage flows must be by-passed between manholes via temporary sewer lines laid on the ground surface and the line must be clean of debris before televising. The nature of this operation and uncertainties associated with removal of debris typically found within sewers (e.g., poured concrete, boulders, etc.) make it difficult to estimate time, equipment and manpower requirements typically outlined within a standard construction contract. For specialized work like this, it is preferable to seek quotes from a minimum of three specialized vendors who perform this type of work on a regular basis. Similar to last year's program, staff would like to initiate the process of soliciting a minimum of three quotes from such vendors. The operating budget includes an allocation of $150,000 in the sewer fund to televise and clean sewer lines. However, in this year's program, staff estimates that 4,500 feet of 36" sanitary sewer may be cleaned, inspected and televised for about $75,000. Pursuant to Section 8.04 (b) of the Revised Dublin Charter and Section 37.03 of the Dublin Codified Ordinances, the procurement ofnon-professional services in the amount of $30,000 or greater requires the City to conduct formal competitive bidding unless Council waives such competitive bidding I~..rr requirements as specified in Section 8.04 (c) of the Charter. Section 8.04 (c) of the Revised Dublin Charter authorizes Council, by a vote of no less than five (5) members, to waive competitive bidding requirements if it determines that such waiver is in the best interest of the City. Under the circumstances, Staff believes it would be in the best interest of the City to waive competitive bidding requirements and, therefore, recommends that Council adopt Ordinance No. 56-01.
