AN ORDINANCE TO ESTABLISH DUBLIN ZONING FOR
APPROXIMATELY 509 PARCELS COMPRISING OF AN AREA OF
APPROXIMATELY 872 ACRES, AS ANNEXED FROM PERRY
TOWNSHIP PRIOR TO 1975, BOUNDED ON THE NORTH BY THE
FRANKLIN/DELAWARE COUNTY LINE, TO THE EAST BY SAWMILL
ROAD, TO THE SOUTH, I-270, AND TO THE WEST THE SCIOTO
RIVER AS R-1, RESTRICTED SUBURBAN RESIDENTIAL DISTRICT
(NORTHEAST TOWNSHIP REZONING -CASE NO.O1-006Z).
WHEREAS, under Dublin Code Section 153.004(D), territory annexed to the City of Dublin
continues to be governed by the zoning regulations which governed the territory annexed
immediately prior to the annexation, as enacted by a Board of County Commissioners under
R.C. 303.01 to 303.25, or enacted by a Board of Township Trustees under R.C. 519.02
to 519.25, as the case maybe; and
WHEREAS, Section 153.004(D) further states that as soon as practicable after the
annexation of territory to Dublin, proceedings shall be instituted to include the annexed
territory in one or more of the zoning districts defined in the zoning ordinance, as amended;
and
WHEREAS, certain parcels located in the northeast quadrant were annexed to the Village of
Dublin in 1973, and never designated with a proper Dublin zoning classification since
annexation; and
WHEREAS, it is necessary to rezone certain parcels in the northeast quadrant of the City to
ensure they are governed by Dublin zoning classifications in compliance with Section
WHEREAS, this rezoning will ensure consistent administration and equal enforcement of
City Codes to protect the health, safety and welfare of its citizens;
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of
Ohio, ~ of the elected members concurring:
Section 1. That the following described real estate (see attached map marked Exhibit "A")
situated in the City of Dublin, State of Ohio, is hereby rezoned R-I, Restricted Suburban
Residential District, and shall be subject to regulations and procedures contained in
Ordinance No. 21-70 (Chapter 153 of the Codified Ordinances) the City of Dublin Zoning
Code and amendments thereto.
Section 2. That application (Exhibit "B"), the list of contiguous property owners (Exhibit "B-
2"), and the list of affected property owners (Exhibit "D"), are all incorporated into and made
an official part of this Ordinance and said real estate shall be developed and used in
accordance therewith.
Section 3. That this Ordinance shall take effect on the earliest date provided by law.

designation for the properties included in the Northeast Quadrant. In addition, this application will set

The City of Dublin recently conducted an inventory of certain parcels of land located

Dublin in 1973. Many properties have been rezoned since the original 1973 annexation, and
it is important that the remaining properties have a Dublin zoning classification. The City of
Dublin is consequently beginning the process of rezoning your property and other similarly
situated properties to a Dublin zoning classification. This rezoning will ensure on-going
responsibility within the City to protect the health, safety and welfare of its citizens.
It is proposed that the classification for your property be changed to the Dublin
R-1, Restricted Suburban Residential District classification. The impacts of this rezoning
may vary and will depend upon the current uses on your property, but for most properties the
impact will be minimal. The development standards for a Dublin R-1, Restricted Suburban
Residential District (green paper) and Perry Township R-1, Restricted Suburban Residential
District (yellow paper) are attached for your reference.
The ordinance initiating this zoning change will be introduced at the March 19, 2001
Dublin City Council meeting. It will then be referred to the Planning and Zoning
Commission for a hearing. After the ordinance is reviewed by the Planning and Zoning
Commission, it will be returned to City Council for a public hearing and final vote. You will
be notified of both the Planning and Zoning meeting and City Council public hearing.
In order to have continued, coordinated, orderly development within the City, it is
important that all property located within Dublin City limits have a Dublin zoning

§153.020 RESTRICTED SUBURBAN RESIDENTIAL DISTRICT
A. Permitted use. Land and buildings in the Restricted Suburban Residential
District shall be used only for the following purposes:
1. Dwelling structures. One-family dwelling structures.
2. Home occupation. Home occupation in association with a
permitted dwelling, and in accordance with the provisions of §
1183.04.
3. Accessory uses. Accessory buildings and uses in association with
permitted dwellings as specified in § 153.074, including: Domestic
servants' quarters (employed on the premises).
4. Public school and parks.
a) Public school offering general educational courses and having
no rooms regularly used for housing or sleeping of
students.
b) Parks, playgrounds and playfields.
5. Private school. Private school offering general educational courses
similar to those ordinarily given in public schools and having no
rooms regularly used for housing or sleeping of students, providing
it occupies a lot of not less than five acres.
6. Religious. Church or other place of worship provided it occupies a
lot of not less than five acres.

B. Development standards. In addition to the provisions of 153.070 through
153.076, the following standards for arrangement and development of land and
buildings are required in the Restricted Suburban Residential District.
1. Lot area and coverage. For each dwelling unit there shall be a lot area
not less than 40,000 square feet per dwelling unit.
a) For each permitted use and conditional use the lot area shall be
adequate to meet the sanitation requirements of the County
Board of Health, but shall not be less than that prescribed
for such use.
b) One principal use shall be permitted on a lot, and such lot shall
not be covered more than 20% by structure.

2. Lot width. For aone-family dwelling there shall be a lot width of 150
feet or more at the front line of the dwelling, and such lot shall have access
to and abut on a public right of way for a distance of 60 feet or more. For a
conditional use the lot width shall be adequate to meet the development
standards of the Restricted Suburban Residential District.
3. Side yard. For dwellings or associated accessory buildings there shall
be a total of side yards of 25 feet or more with a minimum of eight feet on
one side. For a conditional use, except dwellings, and accessory structures
thereto, there shall be a side yard on each side of a building of 25 feet or
more.
4. Rear yard. For main buildings, there shall be a rear yard of 20% or
more of the lot depth, except that a rear yard of more than 50 feet shall not
be required.
5. Maximum height. No dwelling structure shall exceed 35 feet in
height. Maximum height for other structures shall not exceed a
safe height as determined by the Fire Chief and as reviewed and
accepted by the Planning and Zoning Commission.

SECTION 302 RESTRICTED SUBURBAN RESIDENTIAL DISTRICT
302.02 PERMITTED USES. Land and buildings in the RESTRICTED SUBURBAN
RESIDENTIAL DISTRICT shall be used only for the following purposes: „
302.021 Dwelling Structures. One-family dwelling structures.
302.022 Home Occupation. Home Occupation in association with a permitted dwelling,
and in accordance with the provisions of SECTION 511, ARTICLE V.
302.023 Accessory Uses. Accessory buildings and uses in association with permitted
dwellings as specified in SECTION 512, ARTICLE V, including:
Domestic servant quarters (employed on the premises).
302.024 Public School and Parks. Public school offering general educational courses and
having no rooms regulazly used for housing or sleeping of students.
Pazks, playgrounds, and playfields open to the public without fee.
302.025 Private School. Private school offering general educational courses similar to
those ordinarily given in public schools and having no rooms regularly used for housing or sleeping
of students, provided it occupies a lot of not less than five (5) acres.
302.026 Religious. Church or other place of worship provided it occupies a lot of not less
than three (3) acres and there is one (1) acre or more per one hundred (100) seats or similar
accommodations in the main assembly area.
302.027 Residential Care Facility. Residential Care Facility in accordance with Section
510, Article V.
302.03 CONDITIONAL USE. The following uses shall be allowed in the RESTRICTED
SUBURBAN RESIDENTIAL DISTRICT subject to approval in accordance with SECTION 815,
ARTICLE VIII.
302.031 Borrow Pit. A Borrow Pit in accordance with the requ'u~ements of SECTION 620,
REGULATIONS FOR EXCAVATION AND QUARRY, ARTICLE VI; and provided that such
excavation and required rehabilitation shall be completed within one (1) year from the date of

with all applicable federal, state and local building laws
including, without limitation, the Ohio Basic Building Code
and the National Electric Code;
(ii) that the tower complies with all current FCC regulations for
non-ionizing electromagnetic radiation (NIER); and
(iii) that the tower will to the extent possible, accommodate co-
loration of additional wireless communication antennas for
.•r future use, with a statement as to the number of antennas
capable of being accommodated and the ultimate height
needed for the stated co-location capacity; or, alternatively, an
explanation as to the reasons why the tower will not be
constructed to accommodate co-location.
B. General Requirements for all Telecommunications Towers.
1. The applicant or tower provider shall demonstrate that the telecommunications tower
must be located where it is proposed in order to service the applicant's service area
and that there are no alternative sites reasonably available in any area. This shall
include an explanation and accompanying documentation a to why a tower on this
proposed site is technically necessary; a description of the suitability of the use of
existing towers, other structures or technology not requiring the use of the proposed
new tower; and a demonstration that a technically suitable location is not reasonably
available on an existing tower, building or structure. If another tower is technically
suitable, the applicant must show that a request to co-locate was made and that such
request was rejected.
2. All towers shall meet or exceed current standards and regulations of the FAA, FCC
• and any other agency of the state or federal government with the authority to regulate
such towers. If the applicable standards and regulations are changed, then the
owners/operators of the towers shall, if required by the applicable governmental
authority, bring such towers into compliance with the revised standards and
regulations within six (6) months of the effective date of such standards and
regulations, unless a different compliance schedule is mandated by the applicable
governmental authority.
3. The owner/operator shall remove a tower within one hundred eighty (180) days after
the tower's use is discontinued. The owner/operator shall annually file a declaration
with the Zoning Inspector which certifies that the radio frequency transmission
and/or reception equipment attached to the tower is in use and is operational.
4. .The owner/operator shall provide documentation that notice has been provided in
accordance with Section 519.211 of the Ohio Revised Code.
C. Development Standazds for all Telecommunications Towers.

11. No advertising is permitted anywhere on the telecommunications tower facility with
the exception of one identification sign not to exceed one squaze foot in size.
12. The tower shall be fully automated and unattended on a daily basis and shall be
visited only for periodic and necessary maintenance. Also, all utility service to the
tower shall be underground in accordance with applicable federal, state and local
codes.
13. Where the tower is located on a property which is not owned by the tower operator,
the applicant shall present documentation that the owner of the property has approved
the application and that vehiculaz access is provided to the property. Reasonable
access and circulation shall be provided to the tower.
14. The applicant shall provide a signed statement indicating that the applicant agrees to
allow for the potential co-location of other antenna facilities to the extent possible,
until said tower has reached full antenna capacity. Antenna towers aze not permitted
to be built to a height which exceeds the applicant's service need as substantiated by
the testimony and certification of the applicant's engineer. If the tower must be
extended in the future to accommodate co-location, the initial tower foundation must
be designed to accommodate this extension capability. This ultimate height shall be
specified on the drawings submitted with the application. Unless otherwise approved,
the tower height shall not be extended until co-locators are installed.
15. A tower may be attached to a residential or nonresidential building or structure that
is a perntted use and structure in the district, provided that the tower's height does
not exceed twenty (20) feet above the existing building or structure to which the
tower is attached; and further provided that all requirements except those found in
Items C 2, 7 and 9 are met. All roof-mounted towers shall be screened from view to
the extent possible. The outside storage of vehicles or equipment, if not located
inside the building or structure on which the tower is located, shall be screened by
a minimum eight (8) foot high solid masonry or concrete wall and, outside of and
along the wall, a continuous evergreen hedge, trees or similar landscape materials of
a size and type deemed appropriate by the Board of Zoning Appeals. The screening
shall be maintained in good condition. Any solid wall shall contain no advertising,
but may contain one small identification sign not to exceed one squaze foot in size.
The applicant is responsible for ensuring that the tower area is kept free of weeds and
trash.
D. Exception to Conditional Use Permit.
Telecommunications towers meeting the following conditions shall not be required to obtain
a Conditional Use Permit, but shall be deemed to be permitted uses requiring a Certificate of Zoning
Compliance.

For a Conditional Use, except dwellings, and accessory structures thereto, there shall be a
side yard on each side of a building of twenty-five (25) feet or more.
302.044 Rear Yard. For main buildings, there shall be a rear yard of twenty percent (20%)
or more of the lot depth, except that a rear yard of more than fifty (50) feet shall not be required.

UPDATE:
Due to the late hour, this case was postponed from the April 5, 2001 agenda without
discussion. Since that date staff, along with the Law Director have met with property owners
along Tonti Drive to resolve issues concerning lot size and land use rights. Some changes ~"4
have been made to the staff report.
BACKGROUND:
The City of Dublin recently discovered that a number of parcels were annexed to Dublin over
a period of 25 years without being assigned a Dublin zoning classification. For Code
administration and enforcement purposes and on the advice of the Law Director, the City has
initiated the rezoning of these parcels. Due to the scale of this project and the number of
property owners involved, this is the first of several future ordinances. The rezoning of other
portions of the City is forthcoming.
Ordinance 34-01 initiated this zoning change, and it was introduced at the March 19, 2001
Council meeting. After a Planning Commission recommendation, it will be forwarded back
to Council for a public hearing and a vote. With a positive recommendation from the
Commission, a simple majority vote is required for passage. A negative Commission

recommendation requires asuper-majority vote for passage. If the ordinance is approved, it
will take affect in 30 days.
CONSIDERATIONS:
Site Characteristics:
• The subject area is comprised of 525 parcels, covering an area of approximately 883
acres. This area is generally bounded on the east by Sawmill Road, on the west by the
Scioto River, on the north by the Franklin/Delaware County line, and on the south by
I-270. The majority of this area was annexed to the Village of Dublin in 1973, with a
few properties annexed in 1963.
• All of these parcels are zoned residentially, and the original township regulations
currently apply. Operationally and because this problem was not known, Dublin has
been enforcing the usual Dublin standards in virtually all instances--from building
permits to Code enforcement. The rezoning will give these parcels the Dublin R-1,
Restricted Suburban Residential District classification, and will facilitate the proper
administration of adopted Codes and standards.
• Neighborhoods incorporated in this application include: Hanna Hills, Grandee Cliffs
Estates, Drexel Hills Terrace, O'Shaughnessy Hills, The Woodlands, Scioto Estates,
Maple Glen, Glenbriar, Kiplinger Estates, River Oaks, and River Knolls. Existing
structures that do not meet the current Code requirements for the Dublin R-1 District
will be considered legally nonconforming by this rezoning. Most typically, these sites
have been developed on estate-sized lots that meet or exceed the R-1 standards.
However, new development and redevelopment will be required to meet current
Dublin standards. Some lots in these subdivisions do not meet the 40,000 square foot
minimum lot size. There are ongoing discussions with these property owners and
legal staff to resolve this issue.
Community Plan Issues:
• A primary goal of the Community Plan is to promote a high quality built environment.
Implementation of this rezoning will ensure conformity with Dublin standards, and
will uphold the health, safety, and welfare of its residents.
• The Community Plan designates the majority of this area as residential low to medium
density (0.5-2 dwelling units per acre) with some mixed use (employment emphasis)
and parks.
Land Use and Zoning:
• Section 153.004(D) states that territory annexed into the City of Dublin continues to
be governed by the zoning regulations which governed the territory immediately prior
to annexation. Regulations for these territories are generally enacted by an elected
board of township trustees or board of county commissioners. In most all cases,
property annexed to Dublin was from either a township or county, in a zone similar to
Dublin's R-1 District. Following annexation, however, no specific rezoning action
was undertaken.
• The permitted uses within the Dublin R-1 District include single-family residential
dwellings, churches, public or private schools, and parks. Home occupation and

accessory uses are permitted in limited situations. Conditional uses include childcare
and wireless telecommunication facilities.
• The permitted uses within the Perry Township R-1 District include single-family
residential dwellings, churches, public or private schools, parks, residential care
facilities. Home occupation and accessory uses are permitted in limited situations.
• .Conditional uses permitted in this district include borrow pits, and telecommunication
towers.
• The majority of the land being rezoned is currently being used for single-family
residences. This rezoning is primarily a housekeeping issue that, in the view of the
staff, should not have an immediate impact on the overwhelming majority of the
affected residents. nt
• Dublin's ability to administer its setback, sign, or landscape ordinances, for example,
is hampered where Dublin zoning has not already been established.
• Staff has received a limited number of calls from residents regarding this matter. Most
concerns involved the minimum lot size issue. Some concerns were raised about non-
conforming uses and sewer extensions through township land.
Development Standards (Dublin R-1 District):
• The minimum lot size in the R-1 District is 40,000 square feet. The minimum lot
width is 150 feet at the front line of the dwelling, and there must be at least 60 feet of
frontage along at least one public right-of--way.
• The maximum building height for a dwelling is 35 feet. Other structures, such as
church steeples, may exceed this height if approved and deemed safe by the Fire Chief
and the Planning Commission.
• The combined minimum required side yard is 25 feet, with a minimum on one side of
eight feet. The minimum required rear yard is equal to 20 percent of the lot depth, up
to 50 feet.
• Only one principal use is permitted on a lot. No more than 20 percent of the lot can be
covered by a structure. The maximum lot coverage in any residential district is 45
percent.
Utilities:
• A combination of on-site septic tanks or aeration systems and public sanitary sewers
serve these properties. Wells and municipal water service potable water to these
properties. No part of this rezoning action will affect the utility services in place or
planned for the affected areas.
STAFF RECOMMENDATION:
Since annexation, these properties have not received an appropriate Dublin zoning
classification as directed by Code. In the opinion of Dublin's Law Director this rezoning
will resolve further Code enforcement problems with township or county zoned properties.
In summary, this action provides proper zoning for a large area of the City and is primarily a
housekeeping effort. Staff recommends approval of this rezoning application with the
following two conditions:

Anne Wanner said for 25 years, Dublin annexed land without establishing Dublin zoning. She
noted about 500 acres of the Northeast Quadrant are zoned PUD, but the large residential lots
were not generally rezoned after annexation. This was recently uncovered, and it may cause
code enforcement difficulties. Dublin has been enforcing the usual Dublin standards in virtually
all instances. The Law Director advised initiating this rezoning immediately.
Ms. Wanner said this application involves about 525 parcels totaling 883 acres. The area is ~
bounded by the Delaware County line, Sawmill Road, I-270, and the Scioto River. She noted the
McKitrick property currently is shown as being zoned CC, Community Commercial District, and
all of the others show up as R-1, Restricted Suburban Residential Districts. She said the
McKitrick land and the Perry Township offices are being removed from this rezoning.
Ms. Wanner said staff has received phone calls, dealing mainly with the minimum lot size. She
said this proposal is to convert from the Perry Township R-1 District to the Dublin R-1 District,
both of which require a 40,000 square foot minimum lot size. She noted that lots in
O'Shaughnessy Hills and along Tonti Drive do not meet the minimum lot size.
Ms. Wanner said this establishes the proper Dublin zoning and is a housekeeping issue. She said
staff recommends approval with two conditions:
1. That the legal descriptions of all the effected properties be finalized prior to scheduling the
public hearing with City Council; and
2. That the property owners be notified by certified mail of the future public hearing as directed
by the Law Director.
John Yeager, on behalf of his mother Rosemary Hussie, said she owns three half-acre lots platted
in the mid-SOs on the south side of Tonti Drive. He wanted to confirm on the record, that this
rezoning will not change their ability to build on these half-acre lots when a sanitary sewer or
some other acceptable sewage disposal system is approved in the future.
Mack Parkhill, Northeast Dublin Civic Association, said this will benefit all homeowners that are
under the impression that they are functioning under an R-1 status.
Jim Hanneman, for his mother, Regina Hanneman, who owns three lots on Tonti Drive, is
concerned about the ability to build on these half-acre lots. They do not oppose the rezoning.
Mr. Banchefsky said rezoning should have been done just following annexation. He noted this
will be needed in other areas of the City also. He said the Perry Township/Franklin County R-1
zoning is virtually identical to the Village/City of Dublin's R-1 District. He agreed that this is
not a major change; it is simply a housekeeping issue. He said the core problem is that the
county/township zoning records from 1950-1960 were lost. This rezoning will settle any
questions that remain about how the land is zoned. Mr. Banchefsky said the lots that came into
existence legally prior to the annexation remain in existence after. He said this is simply to bring
it into the corresponding Dublin district.
Mr. Banchefsky said this does not take away property rights for platted lots, whether developed
or not. The lots are 20,000 square feet, and have been developed with homes. Generally, the
county requires 40,000 square feet to meet the on-site sanitary requirements. Several of these

lots remain vacant, and if there is an available sanitary sewer connection, they can be built. Mr.
Banchefsky said the caveat here was that if two non-conforming lots are under the same
ownership, those abutting lots would have to be combined to meet the minimum lot area.
Mr. Banchefsky said the McKitrick land was zoned CC, Community Commercial District in the
township. Depending on the property owner's records, that property might come back for a
subsequent rezoning. It may be a request for Dublin Community Commercial or Dublin R-1
District, but that has not been decided. The Perry Township office site was removed because the
~ Township has an ordinance that exempted it from zoning.
Mr. Lecklider asked about the lots combined to meet the 40,000 square foot area for sanitary
reasons. Mr. Banchefsky because those lots were under, the lots were combined. Lots less than
40,000 square feet will be buildable either through a new sanitary disposal technology or by
connection to the public sanitary sewer. He said it is the property owner's burden to prove that
they had a legal existing lot of record at the time that the property was annexed.
John Ferrara, Tamarisk Court, said when they bought their lots in the Woodlands, they clearly
understood that the vacant lots would be developed in the future.
Mr. Banchefsky said if the sanitary regulations change, Franklin County Health Department has
jurisdiction over those systems. If property owners can comply with the new regulations, they
can build. If the regulations allow smaller lot sizes in the future, they could also be built.
Ms. Salay was glad these issues were being resolved. Mr. Gerber was comfortable with this.
Mr. Lecklider appreciated Mr. Ferrara coming forward to say that he was fully aware that there
was a potential for other houses. It is very rare to hear this.
Mr. Fishman made a motion to approve this rezoning because it provides an appropriate Dublin
zoning classification, maintains the established development pattern and eliminates the use of
outdated township regulations, with two conditions:
1) That the legal descriptions of all affected properties be finalized prior to scheduling the
public hearing with City Council; and
2) That the property owners be notified by certified mail of the future public hearing, as directed
by the Law Director.
Mr. Lecklider seconded the motion, and the vote was as follows: Mr. Gerber, yes; Mr. Sprague,
yes; Ms. Salay, yes; Mr. Lecklider, yes; Mr. and Fishman, yes. (Approved 5-0.)

There are apparetrtly multiple lots in the Northeastern Quadrant of the City that do mot
meet City of Dublin residential zoning standazds. Specifically, there are lots that do not contain
the minimum lot size of 40,000 square feet with a minimum required frontage of 150 feet.
II. Issue
Can the City of Dublin enforce the Dublin R 1 Restricted Suburban Residential District
lot size development standards against the current landowners that have not yet built homes on
their properties and whose properties will be rezoned from Township to the above Dublin zoning ~
district.
IYI. Shoat Answer
In most instances, Dublin cannot enforce the lot size development standazds against
property owners who currently own property that is rezoned as a result the Northeast Quadrant
rezoning. The only situation under the Dublin Code that the City can enforce the lot size
standards is when a property owner owns two parcels adjacent to each other, which can be
combined thereby complying with the R-1 lot size development standards.

Dublin Codified Ordinance Section 153.004 states:
(C) Nonconforming lots, structures or uses. Existing lots, structures and
accessory development or the use of lots and/or structures which would be prohibited
under the regulations for the zoning district in which they are located shall be considered
as nonconforming. A nonconforming use in violation of a provision of the zoning

of the Zoning Ordinance. Otherwise development shall be permitted only in
accordance with the development standards of the zoning a£istrict in which such
o~vnersl~ip is located.
The above Dublin code section demonstrates the City's intent with regard to
nonconforming lots. This section permits lot owners to proceed with the wnstruction of
conforming structures, i.e. residential houses in the present situation, even though they do not
have the requisite lot azea and/or width. This is necessary because the property would probably
be worthless and the landowner could not build any structure on the nonconforming lot if such
construction were not allowed.
However, there is one notable exclusion to this exception. According to the above
Dublin code section, if a property owner owns two nonconforming lots that are side-by-side, that
property owner cannot take advantage of the exclusion. The readily appazent reason for this is
that if one property owner owns two lots that are side-by-side, that property owner could easily
combine the lots and comply with the current development standards. While this appears to be a
rational requirement, it must be noted that several courts have refused to uphold ordinances
requiring the purchase of additional property or the combination of adjacent lots in order to
comply with new zoning regulations. See, Schreiner v. Russell ~'ownship Board of 7Yustees
(1990), 60 Ohio App.3d 152, Negin v. Mentor (1982), 69 Ohio St.2d 492. Consequently, Dublin
could face a takings challenge if it requires persons who own adjacent property to combine lots
in order to meet Dublin's R-1 lot requirements.

In response to such a takings aggument, the City could assert that municipalities are free
to change zoning requirements before an application for the use of premises is filed. Slate ex rel,
Mar-Well, Inc. v. Dodge, et al. (1960), 113 Ohio App. 118, cititrg Smith v. Juillerat, 161 Ohio St.
424. The mere fact than a plax is approved and recorded does not irrevocably fix the rights of the
parties. Id. Valid changes in the zoning regulations may be made. Id. Accordingly, the City
could argue that the platting of the land does not sufficiently vest the nonconforming use status
of the property and that the City can impose new development standards, such as minimum lot
width and frontage, on the rezoned property. However, this conclusion would seem to contradict
the clear language of the Dublin Code, which permits the erection of conforming structures when
only the frontage and area requirements are nonconforming. Nonetheless, it could be used in
response to a talcu~s argument made when the City requires the combination of adjacent lots
held in common ownership.
