AN ORDINANCE TO ACCEPT THE LOWESTBEST BID FOR THE
DAN SHERRI AVENUE CUL-DE-SAC AND WATERMAIN
IMPROVEMENTSBLACKSMITH LANE RETAINING WALL AND STORMWATER
IMPROVEMENTS 2000 PROJECT FOR THE CITY OF DUBLIN AND DECLARING
AN EMERGENCY
WHEREAS, after advertising, receiving and opening bids on January 25, 2001 bids were
received for the Dan Sherri Avenue Cul-de-sac and Watermain ImprovementsBlacksmith Lane
Retaining Wall and Stormwater Improvement 2000 project; and
WHEREAS, Council has determined that the lowest and best bid for said project is from,
Shelly and Sands Company in the amount of $495,434.00; and
WHEREAS, Council has determined that there may be a legitimate need to declare the
relocation of the utilities in connection with the above-referenced project as a "single source"
procurement, for reason that the company owning the utilities in question has the exclusive
rights to relocate such utilities; and
WHEREAS, it is in the best interest of the City to execute this contract as soon as possible so
that construction can start early in the spring of 2001; and
WHEREAS, it is necessary to amend the annual appropriations measure to provide funding
authorization for the projects.
NOW THEREFORE BE IT ORDAINED by the Council of the City of Dublin, Ohio,
~ of the elected members concurring:
Section 1. That the bid from Shelly and Sands Company. in the amount of $495,434.00 be,
and hereby is, accepted.
Section 2. That the City Manager is hereby authorized and directed to execute a contract
with Shelly and Sands Company for completion of said project pursuant to the bid
specifications and documents on file in the office of the City Engineer.
Section 3. That there be appropriated from the unappropriated balance in the Capital
Improvements Tax Fund the amount of $423,800 for construction and utility relocation. Of the
total, $200,800 is to be appropriated to account 401-0314-780-2550 for the cul-de-sac and the
retaining wall and $223,000 is to be appropriated to account 401-0314-780-2562 for the
stormwater improvements.
Section 4. That there be appropriated from the unappropriated balance in the Water Fund
the amount of $96,600 to account 610-0312-780-2561 for the watermain improvements.
Section 5. That this Ordinance be, and the same hereby is, declared to be an emergency
measure for the preservation of the public peace, health or welfare of the residents of this City,
and, therefore, this Ordinance shall take effect and be in force immediately upon its passage.

On January 25, 2001 bids were received and publicly opened and read for the Dan Sherri
Avenue Cul-de-sac and Watermain ImprovementsBlacksmith Lane Retaining Wall and
Stormwater Improvements 2000 projects. Two (2) bids were received, as shown on the
attached memorandum from Jay Herskowitz.
Both bids have been reviewed and it is recommended that we award this contract to Shelly and
Sands Company, the lowest and best bidder. Shelly and Sands Company's bid for Alternative
"A" was $495,434. The Engineer's estimate for Alternative "A" was $463,688.
Funding for the projects was programmed in 2000. Appropriations were included in the 2000
Operating Budget for the retaining wall and the stormwater improvements; however, the
appropriations lapsed at year-end. The attached ordinance provides the funding authorization
necessary for the projects.
I recommend approval of this contract to Shelly and Sands Company. Attached is an
emergency Ordinance for approval by City Council prior to awarding the contract to Shelly and
Sands Company.

The following tables summarizes the bid price data received in response to the
advertisement for the subject set of capital improvement projects.

As a means to provide flexibility in selecting the most appropriate construction approach,
the City requested that each contractor provide a bid for one of three methods proposed
for constructing the Tonti Drive/Riverside Drive component of the Stormwater
Improvements 2000 program. Division of Engineering staff analyzed each approach and
determined that the Alternate Adesign/construction approach provides the City with the
best overall product for conveying stormwater runoff beneath Riverside Drive. This is
accomplished by using a combination of open cut and cured in-place pipe replacement
techniques that will ensure that the culvert system will be installed with maximum
stability and minimal traffic disturbance during construction.
The Engineers Estimate for Alternate A is $463,688. The Alternate A bid price of
$495,434 submitted by Shelley & Sands is within 7% of the Engineers Estimate. It is my
recommendation that the City enter into a contractual agreement with Shelley & Sands
with anot-to-exceed amount of $495,434 established for accomplishing the work.
