NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring: Section 1. That the following described real estate (see attached map marked Exhibit "A") situated in the City of Dublin, State of Ohio, is hereby rezoned SO, Suburban Office and Institutional District, and shall be subject to regulations and procedures contained in Ordinance No. 21-70 (Chapter 153 of the Codified Ordinances) the City of Dublin Zoning Code and amendments thereto. Rezoning Application 00-1192 -Northwest Corporate Centre - 5695 Avery Road Location: 1.401 acres located on the west side of Avery Road, 300 feet north of Corporate Centre Drive. Existing Zoning: PIP, Planned Industrial Park District (Washington Township classification). Request: SO, Suburban Office and Institutional District. Proposed Use: General offices. BACKGROUND: On August 24, 2000 the Board of Zoning Appeals (case #00-079) granted a variance on this site. One of the conditions required the applicant to submit a rezoning application to "downzone" this parcel to SO, Suburban Office and Institutional District. This variance reduced setbacks for a proposed office building in the PIP, Planned Industrial Park District. This rezoning was recommended by the staff to assure the long-term land use stays consistent with the development standards. At this stage the application is a housekeeping measure, as-the building permits are underway. After Planning Commission review, the case will be returned to City Council for a public hearing and final vote. A two-thirds vote is necessary to override a negative recommendation by the Commission. If approved, the rezoning will become effective 30 days following the Council vote. CONSIDERATIONS: Site Characteristics: The site is relatively flat with little vegetation. It is L-shaped with the narrowest part of the parcel perpendicular to Corporate Center Drive and access to the site is via this long narrow strip of land. Developed parcels are on either side of the site. Sparse vegetation exists on the site and a tree row borders most of the north end. Construction on the office building has begun. The subject site is 1.401 acres and is located on Lot 1 of the Northwest Corporate Center. The lot is located on the west side of Avery Road, 300 feet north of Corporate Centre Drive. Adjacent uses include the developed industrial property to the south which retains asix- foot wooden fence that wraps around to the southwest. Directly to the west of the property is an irrigation and landscape supply business with a large garage and storage facility. To the north.is Shamrock Lane zoned RI, Restricted Industrial District. Property to the west is Cramer's Crossing subdivision, which is zoned PUD, Planned Unit Development District. The Balgriffin subdivision is located to the east of the site across Avery Road and is zoned PUD. Property to the south is zoned R-1B, Limited Suburban Residential District. The 20.08-acre Northwest Corporate Centre was annexed to Dublin in 1990. The subject site is part of a larger development that has retained its original Washington Township zoning classification of PIP, Planned Industrial Park District. The permitted uses in the PIP district include manufacturing, processing, warehousing, industrial, and commercial including financial institutions, restaurants and recreational Dublin Planning and Zoning Commission Staff Report -January 11, 2001 Page 9 facilities. Under the new auto-oriented commercial facilities ordinance, gasoline service stations and outdoor service facilities are conditional uses. • The proposal is to downzone this parcel in the Northwest Corporate Centre for office and professional uses. Permitted uses within the SO District includes all types of offices, hospitals, libraries, schools, museums, art galleries, labor unions, professional membership organizations and nonprofit membership organizations. Conditional uses include facilities with adrive-in or any type of auto-oriented commercial facilities, outdoor service facilities, personal services, research, development .and testing laboratories, vocational schools, eating and drinking places, and exceptional uses (animal hospitals). Conditional uses are subject to separate review by the Planning and Zoning Commission. it The "Avery Road Plan," an area study in the Community Plan, primarily maintains residential uses with office development south of the Shier-Rings Road corridor. This specific area is designated as future office park with single-family residential further to the north. • Industrial yard requirements are generally larger to protect adjacent land from possible negative characteristics. As offices are a less intense land use they do not need the same level of separation. • This property received a variance on August 24, 2000 to Section 153.055(C)(3) and 153.055(C)(4) to reduce minimum required side yard setbacks from 39 feet to 15 feet on both the north and south property lines. A variance was also granted to Section 153.212 to reduce the required minimum number of parking spaces from 40 spaces to 25 spaces. Staff supported both variances. • The schematic proposal includes atwo-story, 8,800 square foot corporate office. building with a 1,200 square foot garage. The building is approximately 24 feet in height, 102 feet in depth and 90 feet wide. The main entrance faces the west. External building materials include stucco, stucco stone, and Hardi-plank. Forty parking spaces are required, but only 25 parking spaces are initially being installed. The other 15 parking spaces will be constructed as needed. STAFF RECOMMENDATION: R""* Staff recommended this downzoning as a condition of the side yard variance. This rezoning displaces a broad set of manufacturing uses currently permitted in the existing PIP and creates an extremely appropriate office zoning for this site. It is reasonable, even preferable, to incorporate the SO district into this area and create a precedent for office park development. Staff recommends approval of the request with two conditions: Conditions: 1) That all parking surfaces be identical, and meet all Landscaping Code requirements, subject to staff approval*; and 2) That if additional parking is deemed necessary, staff has the discretion to initiate and approve additional parking.* * Conditions carried over from Board of Zoning Appeals Case #00-079V. Rezoning Application 00-1192 -Northwest Corporate Center - 5695 Avery Road Anne Warmer said the Board of Zoning Appeals (Case 00-079V) granted a sideyard variance and parking reduction on this site. As a condition, the BZA required the applicant to submit a rezoning application to downzone this parcel from a PIP, Planned Industrial Park District, to SO, Suburban Office and Institutional District. The proposed building is an office, and this rezoning will assure the long-term land use will be appropriate with the reduced sideyards. Ms. Wanner said this is a housekeeping measure. Ms. Wanner showed several slides. She said the flag-shaped site is 1.401 acres. The surrounding parcels include RI, Restricted Industrial sites and the Cramers Crossing and Balgriffin PUDs. This is an 8,800 square foot office with 25 parking spaces. She said the building permits are underway. Ms. Wanner said this rezoning substitutes office uses for the present wide list of manufacturing uses permitted under the existing PIP. She said the SO District is much more appropriate. She said staff recommends approval of this application, with two conditions carried forward from the Board of Zoning Appeals: 1) That all parking surfaces be identical, and meet all Landscaping Code requirements, subject to staff approval; and 2) That if additional parking is deemed necessary, staff has the discretion to initiate and approve additional parking. Dublin Planning and Zoning Commission Minutes -January 11, 2001 Page 7 Ms. Wanner said parking could be added if needed. The building will have 35 parking spaces instead of 40. The building is smaller than the drawing presented to the BZA. Ms. Clarke said the Commission requested that the staff initiate action to establish zoning consistent with the Community Plan in this area. The Law Director decided that it would be processed as a regular rezoning process, including public notice, recommendation by the Commission and two readings at City Council. Applications will begin soon. ...~, Mr. Lecklider appreciated that staff pursued this rezoning when given the opportunity. ,r,,, Randall Asmo, Vice President of Mid-States Development, said they were glad to cooperate with Dublin. This will be their own corporate office, and they will have nine employees. He had understood the purpose of the SO rezoning was to have higher standards in the future. He did not think the higher standards should apply to Mid-States. He said they are concerned that the rezoning might take effect in the middle of the building construction, and the City would make them change materials or colors. He wanted this comment to be included in the record. Mr. Asmo said the existing three buildings would be an easy transition to something less than an industrial PIP zoning. They would like to keep the existing zoning until they are ready to change. He noted they are very interested in high-quality apartments on the last four lots on the street. That would get rid of Dublin's objections to the PIP uses. Mr. Lecklider said the Commission appreciated Mr. Asmo's cooperation and assured him that there will be no complaint from them about the colors, materials, windows, etc. Mr. Fishman wanted to remove any false impression about an agreement to rezone those lots for apartments. Mr. Lecklider agreed. Mr. Peplow made the motion to approve this rezoning because it keeps the long-term land use consistent with the reduced development standards, is consistent with the Community Plan, and ~* provides an appropriate transitional land use, with two conditions: 1) That all parking surfaces be identical, and meet all Landscaping Code requirements, subject r to staff approval; and 2) That if additional parking is deemed necessary, staff has the discretion to initiate and approve additional parking.
