AN ORDINANCE DIRECTING THE LAW DIRECTOR OF
THE CITY OF DUBLIN TO PETITION THE COUNTY
COMMISSIONERS OF FRANKLIN COUNTY, OHIO FOR
ANNEXATION OF APPROXIMATELY 1.640 ACRES OF
VACANT COMMERCIAL LAND, LOCATED WEST OF
STATE ROUTE 257 (RIVERSIDE DRIVE) AND SOUTH OF
TULLER ROAD, TO THE CITY OF DUBLIN

WHEREAS, the City acquired a 1.640 acre parcel of vacant commercial land, as described
and depicted in the attached Exhibits "A" and "B," located on State Route 257 (Riverside
Drive), in June 2000 from the Trustees of Elizabeth A. Herdman; and
WHEREAS, the subject property is owned by the City of Dublin and is located
contiguous and adjacent to the City of Dublin; and
WHEREAS, it is necessary to annex the subject property to the City of Dublin for the
purpose of providing municipal services to the subject property, which is owned and
surrounded by Dublin, but not within the Dublin corporate limits; and
WHEREAS, the municipal annexation procedure must be initiated by petition to the
Franklin County Board of Commissioners pursuant to Ohio Revised Code Sections 709.14
through 709.16; and
NOW, TH~F. BEFORE, BE IT ORDAINED by the Council of the City of Dublin, State
of Ohio, ` / of the elected members concurring:
Section 1. Council considers it necessary to annex the subject property to the City of
Dublin for the purpose of providing municipal services to the subject property, which is
owned and surrounded by Dublin, but not within the Dublin corporate limits.
Section 2. The Law Director of the City of Dublin is hereby directed to petition the
Franklin County Commissioners for annexation of 1.640 acres of land located in Perry
Township, Franklin County, Ohio, in accordance with Ohio Revised Code Section 709.16.
Section 3. The ordinance shall take effect and be in force from and after the earliest
date permitted by law.

FOR THE CITY OF DUBLIN
Situated in the State of Ohio, County of Franklin, City of Dublin, in Quarter Township 2, Town-
ship 2 North, Range 19 West, United States Military Lands, and being all of a 5 acre tract of
land (1.640 acres by recent survey) conveyed to Elizabeth A. Herdman, Trustee, by deed of
record in Instrument 199804150089292, Recorder's Office, Franklin County, Ohio, to Donna M.
Herdman, Trustee, by deed of record in Instrument 199808120204382, Recorder's Office,
Franklin County, Ohio, to Willis A. Herdman, III, Trustee, by deed of record in Official Record
1474, Page B 05, Recorder's Office, Franklin County, Ohio, and to Robert S. and Dorothy I.
Herdman, Co-Trustees, by deed of record in Instrument 199810090259323, Recorder's Office,
Franklin County, Ohio, and bounded and described as follows:

Beginning at a P.K. Nail found at the intersection of the centerline of Tuller Road with the
pavement centerline of Riverside Drive-Ohio Route 257, as established by Ohio Department of
Transportation right-of-way plans for S.H. 558 Section A, dated December 4, 1939, said P.K.
Nail being at the northeast corner of said 1.640 acre tract and at a corner of an 8.939 acre tract
of land conveyed to The Thomas Family Limited Partnership by deed of record in Official Rec-
ord 17716, Page E 17, Recorder's Office, Franklin County, Ohio, said P.K. Nail also being 8.5
feet, more or less, east of the centerline of Riverside Drive;
thence S 10° 45' S1" W along the east line of said 1.640 acre tract a distance of 912.45 feet to
a 3/4-inch I.D. iron pipe found bent and reset in the east bank of the Scioto River at water's
edge (in February, 1997), at the south corner of said 1.640 acre tract, at the southwest corner
of an original 22.215 acre tract of land conveyed as Parcel 4 to Herbert W. Bash, Jr. by deed of
record in Official Record 15620, Page F 09, Recorder's Office, Franklin County, Ohio, and at
the northwest corner of a 5.00 acre tract of land conveyed as Parcel 3 to Herbert W. Bash, Jr.
by deed of record in Official Record 15620, Page F 09, Recorder's Office, Franklin County,
Ohio (passing a point in the curved centerline of Riverside Drive at 241.54 feet);
thence northerly along the east bank of the Scioto River at water's edge (in February, 1997)
and along the west lines of said 1.640 acre tract the following seven (7) courses:
1. N 4° 13' 13" E a distance of 111.38 feet to a point;
2. N 5° 53' 10" E a distance of 94.84 feet to a point;
3. N 1° 39' 07" E a distance of 156.39 feet to a point;
4. N 3° 06' 53" W a distance of 115.33 feet to a point;
5. N 2° 14' 26" W a distance of 142.57 feet to a point;
6. N 7° 36' 19" W a distance of 131.28 feet to a point and
7. N 10° 01' S9" W a distance of 162.69 feet to a point at the northwest corner of said 1.640
acre tract and at the southwest corner of said 8.939 acre tract;

thence S 86° 18' 04" E along the north line of said 1.640 acre tract, along a south line of said
8.939 acre tract and along the centerline extended westerly of Tuller Road a distance of 205.97
feet to the place of beginning;
containing 1.640 acres of land more or less and being subject to all legal highways, easements
and restrictions of record.

& R.J. Bull, Inc., Consulting Engineers & Surveyors, Columbus, Ohio, from an actual field sur-
vey performed under his supervision in February, 1997. Basis of bearings is the centerline of
Tuller Ridge Road, being S 3° 35' 11" W, as shown of record in Plat Book 71, Page 60, Re-
corder's Office, Franklin County, Ohio.
