Passed AN ORDINANCE ACCEPTING THE LOWEST AND BEST BID FOR THE COFFMAN PARK POND RENOVATION PROJECT, AND DECLARING AN EMERGENCY rt ` WHEREAS, after advertising and receiving bids on November 16, 2000 for the Coffman Park Pond Renovation Project, an approved 2000 expenditure, Council has determined that the base bid submitted by Nadalin Company in the amount of $152,000.00 is the lowest and best bid for the project. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring: Section 1. That the base bid submitted by Nadalin Company in the amount of $152,000.00 for the Coffinan Park Pond Renovation Project is hereby accepted. Section 2. That the City Manager is hereby authorized to enter into a contract for the project as listed above, and as specified within the bid proposal and the City's bid documents on file in the Division of Grounds and Facilities. Section 3. That this ordinance is necessary for the immediate preservation of the public peace, health, safety or welfare, and for the further reason that it is desirable that the project be completed during the optimal construction season. This ordinance shall therefore be effective upon passage. Passed this ~ day of , 2000. Phone: 614-410-4400 Fax: 614-889-0740 To: Dublin City Council From: Tim Hansley, City Manager Re: Coffinan Park Pond Renovation Date: November 16, 2000 Initiated by: Fred Hahn, Director of Grounds & Facilities On November 16, 2000 bids were opened for the Coffinan Park Pond Renovation Project. This vas a publicly advertised project that consists of a stone sitting wall, accent lighting, landscaping and connection to existing pathways. Two bids were received with the lowest being in the amount of $152,000.00 from the Nadalin Company. This bid was approximately 20% over the estimate of $126,995.00. Following the bid opening, Staff reviewed the project estimate in an attempt to determine why the bids came in high. During this evaluation, Staff discovered flaws in the preparation of the estimate. First, the estimated costs of asphalt and concrete were below current market estimates. Based on recent Dublin projects, this error accounts for approximately $8,000.00. Second, site electricity and lighting was under estimated by approximately $3,600.00. Finally no allowances were given for basic general conditions, including mobilization, temporary electric, bonds, insurance, construction fencing or site layout. This would account for an additional $8,000.00. If we had properly accounted for these items, our estimate would have come to approximately $146,595.00. This would have made the lowest bid approximately 4% over estimate. I feel it is important to note that the Nadalin Company has done several projects for the City of Dublin and we have found them to be a most capable, quality conscious contractor. Given the facts as stated, Staff is recommending acceptance of The Nadalin Company's bid in the amount of $152,000.00. Coffman Park Pond Renovation Memo Page 2 As a side note, Staff would like to emphasize that, although there was some initial concern about recommending acceptance of a bid that came in more that 10% above the established estimate, the City, under Section 37.01 of the Dublin codified Ordinances, is not precluded from doing so. When Chapter 37 ("CONTRACTING AND COMPETITIVE BIDDING" -adopted 6-17-96) was drafted, legal Staff inserted a "Home Rule" section (37.01) which exempts the City from an array of Ohio Revised Code sections. Specifically, one of the O.R.C. sections from which the City has exempted itself is 153.12, which prohibits political subdivisions from entering into competitively bid contracts if the bid price is in excess of 10% above the estimate. Given that the City has indeed exempted itself from this state requirement by "Home Rule Authority" and that the circumstances specific to this case support Staff's rationale for recommending acceptance, Staff believes acceptance of the bid is justified.
