AN ORDINANCE WAVING COMPETITIVE BIDDING
REQUIREMENTS, PURSUANT TO SECTION 8.04
("CONTRACTING PROCEDURES"), PARAGRAPH C.
("WAIVING OF COMPETITIVE BIDDING") OF THE
REVISED DUBLIN CHARTER FOR THE

WHEREAS, Section 8.04 C ("WAIVER OF COMPETITIVE BIDDING") of the Revised
Dublin Charter authorizes Council, by a vote of no less than five (5) Members, to waive
competitive bidding requirements if it determines that such waiver is in the best interest of the
City; and
WHEREAS, Council has determined that waiving competitive bidding requirements for the
renovation of office space within the Division of Planning is in the best interest of the City;
NOW, 'THEREFORE BE IT ORDAINED by the Council of the City of Dublin, State of
Ohio, of the elected members concurring:
Section 1. That competitive bidding requirements are hereby waived for the renovation of
office space within the Division of Planning, in an amount not to exceed $38,000, and that
such waiver is in the best interest of the City.
Section 2. That this Ordinance shall take effect and be in force a the earliest point permitted
~ by law.

Re: Renovation of Office Space within the Division of Planning

Attached for your consideration please find Ordinance No. 144-00 waiving competitive bidding
requirements for the renovation of office space within the Division of Planning. (Section 8.04 (C) of the
Revised Dublin Charter authorizes Council by a vote of not less than five (5) members, to waive
competitive bidding requirements if it determines that such waiver is in the best interest of the City.)
Since adoption of the 2000 Capital Budget, which authorized this renovation project, the Divisions of
Grounds & Facilities, Planning, and Building Standards have been formulating a plan which addresses the
space needs as well as compliance with applicable codes. Staff has solicited proposals from various trades
and the cost for completion of this project will be approximately $38,000. As you are aware, the City's
bidding threshold is $20,000. Based upon the following reasons, Staff believes it would be in the City's
best interest to waive competitive bidding requirements:
? Complexity and required flexibility of the work itself -While staff does its best to develop
a plan of action that recognizes the issues surrounding renovation work in existing offices, the
best-laid plans often require significant modifications to the schedule, which would be nearly
impossible to quantify in a bid document. This type of work requires a great deal of flexibility
by all parties, which would be much easier to accommodate if the City of Dublin is acting as
the General Contractor.
? Cost Savings - The level of complexity in the plans required to obtain a building permit is
much different than that required for a bid project. Staff would have to meet the level of detail
required to secure the necessary building permits to complete the renovation, however, to bid
out the project would require the services of an architectural firm at a significant cost to the
City. In addition to the architectural services, the work itself would, in all probability, cost
more than the $38,000 currently programmed. A general contractor would have the standard
mark up on the various trades as well as program additional costs due to the required flexibility
in schedule changes. The proposals we have received are most competitive and proper for the
level of services provided.
? Timin -The Division of Planning currently has the need for the expanded offices. We are
in a position to start the renovations upon approval to proceed without competitive bidding.
If this approval is not received, it is anticipated that the project would not be initiated until
February of 2001.
In conclusion, Staff believes it would be in the best interest of the City of Dublin to proceed on this
project without competitive bidding. It is virtually guaranteed that the competitive bidding of this
project will result in additional costs to the City and cause significant time delays in its completion.
