HomeMy WebLinkAbout135-00 Ordinance _ _ b - ern RECORD OF ORDINANCES Dayton Legal Blank Co Form No. 30043 135-00 Ordinance No Passed An Ordinance Authorizing the Purchase of a 2.644 Acre Parcel Located at 6501 WoernerTemple Road for the Purpose of Acquiring Additional Parkland and Declaring an Emergency WHEREAS, a goal of City Council is to continue to acquire parkland for recreation and open space purposes; and WHEREAS, the Community Plan identified the need and a general vicinity for a community scale park in the southwest area; and WHEREAS, the City recently executed a Development Agreement with the Edwards Golf Communities LLC agreeing to acquire parkland from willing sellers located adjacent to the Dublin Golf Course Community; and WHEREAS, 6501 WoernerTemple Road was available on the open market; and WHEREAS, funds were appropriated in the 2000 Operating Budget for the purpose of assembling parkland in the southwest area of the City. NOW, THEREF~$~ BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute a Real Estate Purchase Agreement and any necessary closing documents related to the acquisition of 6501 WoernerTemple Road. Section 2. This Ordinance is declared to be an emergency measure for the preservation of public peace, health, safety or welfare and for the further reason to complete the real estate transaction as agreed to by the City; therefore, this Ordinance shall take effect and be in force immediately upon its passage. Grigsby, Director of Finance a As stated in the Ordinance, the Development Agreement executed between the City and the Edwards Golf Communities LLC obligated the City to acquire approximately 46.9 acres of land located adjacent to the Dublin Golf Course Community (the Property). Appraisals were obtained on the land located adjacent to the Property prior to executing the Development Agreement. After the Development Agreement was executed and based on the appraisal, the City reached agreement on the purchase price with the property owner located at 6501 Woerner-Temple Road. This property is identified as Parcel A on the attached map. The Purchase Agreement was recently executed based on the authorization included in the Development Agreement. Because the Development Agreement did not identify the specific properties to be acquired, the administration felt this Ordinance was necessary to provide a clear record as to the authority to acquire this specific property. As the other properties adjacent to the Property become available, legislation will be presented to City Council for their authorization.
