RECORD OF ORDINANCES Dayton Legal Blank Co. Form No. 30043 123-00 ___19_______ Ordinance No.-- Passed-- AN ORDINANCE TO ESTABLISH SECTION 53.071 OF THE DUBLIN CODE OF ORDINANCES WITH RESPECT TO CHAPTER 53, STORMWATER MANAGEMENT, WITHIN HISTORIC (OLD) DUBLIN WHEREAS, Historic (Old) Dublin is awell-preserved historic district which plays an important part in the history, azchitecture, culture, education and general significance of the lazger Dublin Community; and WHEREAS, the Dublin Community Plan recommends the reduction of pazking standards in Old Dublin in order to facilitate re-use of existing buildings and to assure the continued preservation of historic structures; and WHEREAS, most of Historic Dublin was subdivided over 100 yeazs ago into pazcels less than one-half acre; and WHEREAS, the existing regulations as applied to Historic Dublin are not compatible with the type of traditional development within this area; and WHEREAS, it is necessary from time to time to amend existing regulations to promote the development of the community; and WHEREAS, City Council desires to encourage growth and revitalization in Historic Dublin; and NOW, T~IEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring: Section 1. That Section 53.071 titled Historic (Old) Dublin of the Dublin Code of Ordinances be established and read as follows: The City Engineer shall review and approve the expansion of existing parking lots and construction of new pazking lots of four (4) spaces or less within the boundaries of Historic (Old) Dublin, as illustrated in Appendix F of the Dublin Zoning Code, consistent with the following standards: (A) The pazking lot shall be constructed of materials consistent with the existing adjacent parking area or other materials including bituminous asphalt, concrete, porous or non- porous brick or concrete pavers, or gravel. (B) The parking lot shall be exempted from all stormwater regulations set forth in Chapter 53. (C) A detailed plan, prepazed by a licensed professional engineer, is submitted for approval and demonstrates stormwater conveyance in a manner that will not adversely impact adjacent and downstream properties. ~ (D) The new or expanded pazking lot shall not be exempt from compliance with other applicable City, State, and Federal codes and regulations. Kindra, Director of Engineering/City Engineer G~ Subject: Ordinance No. 123-00 Historic (Old) Dublin, Stormwater Management Date: October 9, 2000 This Ordinance is one of several items to be presented to City Council, in accordance with their request, for consideration in regards to addressing parking concerns within Old Dublin. In particular, this Ordinance establishes Section 53.071 of the Dublin Code of Ordinances permitting, the expansion of existing parking lots and the construction of new parking lots, of four (4) spaces or less, within the established boundaries of Old Dublin. The attached copy of Appendix F from the Dublin Zoning Code depicts the boundaries of Old Dublin. These parking lots are to be constructed of materials consistent with the existing adjacent parking area or other materials including bituminous asphalt, concrete, porous ornon-porous brick or concrete pavers, or gravel. Most important, the Ordinance provides for these parking lots to be exempt from all stormwater regulations as set forth in Chapter 53. However, so not to adversely impact adjacent or downstream properties, the Ordinance requires the preparation of a plan demonstrating the stormwater conveyance from the parking lots. Lastly, the language in the Ordinance exempting the parking lots from various Sections of the Dublin Parking Code has been removed from this present version. I recommend approval of this Ordinance as means of providing additional parking areas within Old Dublin without being subjected to limitations on material composition and compliance with existing stormwater regulations.
