AN ORDINANCE ACCEPTING THE LOWEST AND BEST BID FOR THE THE
M.L. "RED" TRABUE NATURE RESERVE PHASE III PROJECT, AND
DECLARING AN EMERGENCY
WHEREAS, after advertising and receiving bids on November 8, 1999 for the M.L. "Red"
Trabue Nature Reserve Phase III Project, Council has determined that the base bid submitted
by Gene Hazen & Sons in the amount of $294,642.24 and bid alternate #1 of $19,500.00 (for
landscaping) is the lowest and best bid for this project.
NOW, TH~REFORE, BE IT ORDAINED by the Council of the City of Dublin, State of
Ohio, _.1~- of the elected members concurring:
ection 1. That the base bid and bid alternate #1 submitted by Gene Hazen & Sons in the
amount of $294,642.24 and $19,500.00, respectively, for the M.L. "Red" Trabue Nature
Reserve Phase III Project is hereby accepted.
~e~tion 2. That the City Manager is hereby authorized to enter into a contract with Gene
Hazen & Sons for this project as specified within the bidder's bid proposal and the City's bid
documents on file in the Division of Grounds and Facilities.
Section 3. That this ordinance is declared to be an emergency measure necessary for the
immediate preservation of the public peace, health, safety or welfare, and therefore shall be
effective upon passage.

An emergency ordinance enacted by the City of Dublin, Union/Franklin County, Ohio, in the matter
,M,~F of the hereinafter described improvement and to request cooperation by the Director of Transportation. .
. WHEREAS, the State has identified the need for and proposes the improvement of a portion of the
public highway which is described as follows:
This project proposes to perform pavement planing and resurfacing with asphalt concrete on
mainline, paved shoulders, crossovers and rest areas. Partial depth pavement repairs will be
performed at locations to be determined. Pavement mazkings and raised pavement mazkers will be
replaced. Minor bridge work will be performed on various structures.
TERMINI: Beginning at a point approximately 0.40 miles east of structure UNI-33-1219
(US33 over US36) then proceeding southerly entering the corporate limits of the
City of Dublin in Union and Franklin Counties and ending at a point
approximately 0.41 miles west of the intersection of SR745 (High Street).

improvement, and
WHEREAS, the Director of Transportation further desires cooperation from the City in the
planning, design and construction of said improvement.
NOW THEREFORE, Be it ordained by the Council of the City of Dublin, Ohio:
SECTION I, (Cooperation)
That said Director of Transportation hereby requests the cooperation of the City in the cost of the
above described improvement as follows:
Consent is hereby given by the City for the above improvement and the City further agrees to assume
and beaz one hundred percent (100%) of the total cost of those features requested by the City which
aze not necessary for the improvement, as determined by the State and the Federal Highway
Administration.
SECTION II, (Consent)
That it is declazed to be in the public interest that the consent of said City be and such consent is
hereby given to the Director of Transportation to construct the above described improvement, in accordance
with plans, specifications and estimates as approved by the Director.
SECTION III, (Authority to sign)
That the City Manager of said City, is hereby empowered and directed on behalf of the City to enter
into agreements with the Director of Transportation necessary to complete the planning and construction of
this improvement.

SECTION IV, (Traffic Control Signals and Devices)
That traffic control devises installed within the limits of the project will conform with Section 4511
of the Ohio Revised Code.
SECTION V, (Maintenance and Pazking)
That upon completion of said improvement, said City, will thereafter, for all portions for which it
is responsible, keep said highway open to traffic at all times, and
(a) Maintain the improvement in accordance with the provisions of statutes relating
thereto and make ample financial and other provisions for such maintenance; and
(b) Maintain the right-of--way and keep it free of obstructions in a manner satisfactory
to the State of Ohio and hold said right-of--way inviolate for public highway purposes
and permit no signs, posters, billboards, roadside stands or other private installations
within the right-of--way limits; and
(c) Place and maintain all traffic control devices conforming to the Ohio Manual ofUniform
Traffic Control Devices on the improvement incompliance with the provisions of Section
4511.11 and related sections of the Ohio Revised Code.
(d) Regulate pazking in the following manner:
prohibit pazking in accordance with section 4511.66 of the Ohio Revised Code, unless
otherwise controlled by local ordinance or resolution.
SECTION VI, (Right-of--Way, Utility Rearrangement and Damage and Liability Responsibilities)
,
(a) That all existing street and public way right-of--way within the City which is necessary for
the aforesaid improvement, shall be made available therefore.
(b) That the State will acquire any additional right-of--way required for the construction of the
aforesaid improvement.
(c) That arrangements have been or will be made with and agreements obtained from all public
utility companies whose lines or structures will be affected by the said improvement and
said companies have agreed to make any and all necessary plant removals or
rearrangements in such a manner as to be clear of any construction called for by the plans
of said improvement and said companies have agreed to make such necessary
rearrangements immediately after notification by said City or the Department of
Transportation.
(d) That it is hereby agreed that the City shall at its own expense, make all rearrangements
of water mains, service lines, fire hydrants, valve boxes, sanitary sewer or other
municipally owned utilities and/or any appurtenances thereto, which do not comply
with the provisions of the Ohio Department of Transportation Utilities Manual inside or
outside the corporate limits as may be necessary to conform to the said improvement and

said rearrangement shall be done at such time as requested by the Department of
Transportation Engineer.
(e) That the construction, reconstruction, and/or rearrangement of both publicly and privately
owned utilities, referred to in subsections (c) and (d) above, shall be done in such a
~ manner as not to interfere unduly with the operation of the contractor constructing the
improvement and all backfilling of trenches made necessary by such utility rearrangements
shall be performed in accordance with the provisions of the Ohio Department of
Transportation Construction and Material Specifications and shall be subject to approval
by the State.
(f) That the installation of all utility facilities on the right-of--way shall conform with the
requirements of Title 23 CFR 645 Subpart B Utility Relocation and Adjustment and the
Department of Transportation's Utilities Manual.
(g) That the City hereby agrees to accept responsibility for any and all damages or claims
for which it is legally liable arising from the negligence of its officers, employees or
agents in the performance of the City's obligation made or agreed to in sections (a),
(b), (c), (d), (e) and (fj hereinabove. Likewise, The State agrees to accept responsibility
for any and all damages or claims for which it is legally liable arising from the
negligence of its officers, employees or agents in the performance of the State's
obligations made or agreed to in sections (a), (b), (c), (d), (e) and (f) hereinabove.
This ordinance is hereby declared to be an emergency measure by reason of the need for expediting
highway improvements to pmmote highway safety, and provided it receives the affirmative vote of two-thirds
of the members elected to Council, it shall take effect and be in force immediately upon its passage and
approval by the mayor; otherwise, it shall take effect and be in force from and after the earliest period allowed
by law.

Ordinance No. 131-99
Attached please find a copy of Ordinance Number 131-99 for your approval. This
ordinance authorizes the Ohio Department of Transportation to plane 1-1/2 inches of
existing bituminous asphalt surface and replace it with 2-1/2 inches of new bituminous
asphalt surface. The project will begin at U.S. 33, from the western corporation limit
near the Post Road interchange, to just west of Frantz Road/Post Road and the S.R.
161/U.S. 33 intersection.
The project is expected to be completed during the summer of the year 2001. No
financial participation is expected from the City of Dublin. The western termini of the
project will be in Marysville, Ohio. I recommend your approval.

programming of the radios, all of the talk-groups could be separate, yet could be tied together in the event
of an emergency so everyone could communicate throughout the city.
Current Federal Communications Commission (F.C.C.) rules do not allow a single governmental entity to
hold more than four (4) 800MHz channels unless they are utilizing franking technology. This means that
the City would not be able to add another channel in the future unless franking technology was already in
place. Additional channels will need to be added to the system in the future. However, by converting the
current system to franking, the City can delay the need for additional channels.
There are other significant advantages to converting the system to franking. The first is the individual
identification of radios. Each radio would receive a unique identification number allowing the dispatcher
in the Communications Center to know who is transmitting on the system. This becomes critical in an
emergency. With the unique identification system, if a police officer began fighting with a suspect, he or
she could press the "Emergency Button" on their walkie-talkie to alert the dispatcher of the emergency
situation. The dispatcher's console would display the user I.D. on the radio console and indicate an
emergency. Help could be immediately sent to the radio users last known location.
Another advantage to franking is the ability to interface our radio system to other franking radio systems
in the area. The City of Columbus operates aCounty-wide radio system for all public safety users within
Franklin County. With franking, our public safety radios could access the Columbus system and literally
communicate with any other public-safety radios in the county. Currently, this can only be accomplished
through special programming of each individual radio. With the franking system, a single talk group can
be tied to the County -wide system so all users can communicate on either system.
A third advantage to franking comes in the area of Disaster Planning. The computer processor that controls
the radio channel assignments can be preset for disaster conditions. This would allow an instant
re-prioritization of individual radios and talk groups to give priority to safety forces involved in a disaster.
With the activation of the Emergency Operations Center at the Justice Center, the disaster plan could
instantly allow for additional field radios being handed out to disaster service providers such as the Red
Cross, Franklin County Emergency Management Agency and area utilities. This would ensure everyone
working on a particular incident could communicate. The system would also allow for special "secure" talk
groups for City Administration and Senior Staff to communicate with each other without interfering with
line level safety forces conducting emergency operations.
