Passed AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO AGREEMENTS WITH JEROME TOWNSHIP, PERRY TOWNSHIP, VILLAGE OF SHAWNEE HILLS, AND DUBLIN CITY SCHOOLS FOR THE PROVISION OF ROAD SALT AND DECLARING AN EMERGENCY WHEREAS, The City of Dublin seeks to provide the safest travelling environment possible for vehicular and pedestrian traffic; and WHEREAS, certain public jurisdictions desire to access the City's supply of road salt in order to respond to inclement weather conditions; and WHEREAS, it is necessary to formally establish and make clear the terms and conditions by agreement under which these jurisdictions can access and compensate the City for road salt. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, ~C.~ of the elected members concurring that: Section 1. That the City Manager is hereby authorized to enter into agreements with Jerome Township, Perry Township, Village of Shawnee Hills, and Dublin City Schools for the provision of road salt. .~ri~ Section 2. This Ordinance is hereby declared to be an emergency measure necessary for the preservation of the public peace, health, safety and welfare in that road salt is essential to the safe, effective and immediate use of public streets. Therefore, this Ordinance shall take effect and be in force immediately upon adoption. Hansley, City Manager ~ ` Initiated by: Dana L. McDaniel, Director of Service Date: October 26, 1999 ~ Re: Ordinance 125-99 Staff recommends that City Council pass Ordinance 125-99, attached. This Ordinance will authorize the City Manager to enter into an Agreement with certain local jurisdictions to provide and be compensated for road salt. The City has for sometime informally allowed access to its supply of salt and recovered the cost of salt used. Over time the demand for road salt has increased and the relationship and processes to accommodate this have become more complex. Therefore, it is necessary to formalize this process via written agreement in order that terms, conditions, and expectations are clear. Also, it is necessary to formalize this process for purposes of accountability. The Agreements basically address the following: 1. Responsibilities of each party. 2. Establish points of contact. 3. Compensation -salt provided "at cost" 4. Payment 5. Termination W 6. Indemnity Additionally the Agreements give the City the right to not provide salt when supply is determined to be critically low.
