AN ORDINANCE AUTHORIZING THE CITY MANAGER
TO ENTER INTO AN AGREEMENT WITH WASHINGTON TOWNSHIP
FOR THE PURPOSE OF COLLECTING
"AFTER-HOURS" INSPECTION FEES,
AND DECLARING AN EMERGENCY
WHEREAS, The Washington Township Fire Department has determined it is
necessary to collect fees for "after-hours" inspections, which have been requested at
the owner's convenience; and
WHEREAS, The Washington Township Trustees have established such fees by
resolution; and
WHEREAS, The Washington Township Trustees have requested the City of
Dublin to collect said fees; and
WHEREAS, said services are deemed necessary to insure the public welfare,
health and safety,
NOW THEREFORE BE IT ORDAINED, by the Council of the City of Dublin,
State of Ohio, ~ of the elected members concurring that:
Section 1. The City Manager is hereby authorized to enter into an agreement with
the Washington Township Board of Trustees to collect fees for "after-hours
inspections" established by Washington Township.
Section 2. This Ordinance is hereby declared to be an emergency measure for the
immediate preservation of the public welfare, health and safety.

Memo
The scheduling of "After-hours Inspections" is always completed with both, the Building Standards
Division and the Washington Township Fire Department Inspection staff being involved. Therefore,
both entities have realized it would be much easier to schedule and pay for this service if it were
completed at a single point. The logical point is at the Building Standards Division.
These inspections are scheduled only at the owner's request, and then only because there is need to
schedule ashut-down and testing in a controlled manner that will not disrupt business operations. The
City of Dublin has charged an "After- hours Inspection" fee for several years to offset the cost of
overtime. The Washington Township Fire Department has not previously charged a fee to offset their
overtime costs. They now wish to change that policy and collect offsetting revenue. The Township
Trustees have adopted a resolution establishing a prevention fee effective September 1, 2001.
We are currently writing a receipt for collection of the "After-hours Inspection" fee, before the
inspection will be scheduled for the Building Standards Division staff. The only change we will incur
is to adjust our receipt and collect the Washington Township portion concurrently. This process will
make scheduling very easy, since the requestor will have only one point of contact and will be required
to write only one check. The fees collected on behalf of Washington Township will be credited to the
City's Agency Fund and remitted to Washington Township on a quarterly basis.
The attached Ordinance will allow the City Manager to enter into an agreement whereby the City of
Dublin will collect the above mentioned "After-hours Inspection" fees for the Washington Township
Fire Department.
I recommend Council approve this ordinance because the process will benefit those we serve, with
virtually no expense to the City.
WASHINGTON TOWNSHIP & CITY OF DUBLIN
CONTRACT FOR COLLECTION OF FEES
FOR "AFTER-HOURS" INSPECTIONS
THIS CONTRACT, entered into as of this day of , 2001 by and
between Board of Township Trustees of Washington Township, Franklin, Delaware and Union
Counties, Ohio (hereinafter referred to as the "Township") and the City of Dublin (hereinafter
referred to as the "City").
ARTICLE I -SCOPE OF SERVICES
The City agrees to provide services as specified in Exhibit A.
ARTICLE II -TERM OF CONTRACT
This contract shall become effective immediately and shall be in effect until terminated as
provided for in Article VI of this agreement.
ARTICLE III -TOWNSHIP RESPONSIBILITIES
The Township shall accomplish the following:
Give prompt notice to the City whenever the Township observes, or otherwise becomes
aware of any fault or deficit in the service or any non-conformance with this contract.
2. The Township shall designate a representative of the Township for day-to-day
coordination and shall notify the City as to who shall serve as this representative. The
representative:

b. Shall coordinate services with the City.
`~""" c. Shall notify the City of any change in the fee 30 days in advance of its effective
date.
Full compliance with this contractual Agreement.
ARTICLE IV -CITY RESPONSIBILITIES
The City shall accomplish the following in addition to Exhibit A:
1. Execute the services as defined in Article I and within the designated time frame.
2. Give prompt notice to the Township whenever the City observes, or otherwise becomes
aware of any fault or deficit in the service or any non-conformance with this contract.
The City will provide the Township quarterly reimbursement of fees collected.

4. Provide services to all areas within the unincorporated portions of the Township.
ARTICLE V -COMPENSATION AND PAYMENT
Collection of fees and reimbursement is provided at no cost to the Township. It has been
determined that this service will be concurrent to the City's present system.
ARTICLE VI -TERMINATION
Either party may terminate this agreement by providing written notice of their intent to
terminate. Such notice shall be given at least 60 days prior to the effective date of termination.
ARTICLE VIII -NON-WAIVER
Nothing in this contract including, without limitation, the insurance provision hereinbefore
provided, shall in any way serve to supersede, waive, limit and/or otherwise affect any rights,
privileges and/or immunities afforded to either party under applicable law, including, but not
limited to, those contained in Chapter 2744 of the Revised Code of the State of Ohio.
IN WITNESS THEREOF, the parties hereto have executed this Agreement in triplicate
originals.

EXHIBIT A
The City of Dublin will collect the fee required by Washington Township to schedule after hour
inspections.
The amount collected will be as indicated in the Washington Township Resolution which was
passed on July 12, 2001 (attached).
The Washington Township representative shall be held responsible to inform the City of Dublin
of any changes that affect this agreement.
The City of Dublin will remit to Washington Township all those fees collected on behalf of the
Township on a quarterly basis.
