AN ORDINANCE TO APPROPRIATE A 0.069 ACRE, MORE OR
LESS, FEE SIlVIPLE INTEREST IN PROPERTY OWNED BY
RAYMOND C. DAMS AND THE UNKNOWN HEIRS, LEGATEES
AND DEVISEES OF OSSA GEESE, LOCATED ON THE EAST SIDE
OF DUBLIN CENTER DRIVE, IN THE CITY OF DUBLIN, COUNTY
OF FRANKLIN, STATE OF OHIO, AND DECLARING AN
EMERGENCY.
WHEREAS, the City of Dublin intends to improve Krier Drive, Dublin Center Drive and the
Martin Road intersection; and
WHEREAS, said improvement will require the City of Dublin to obtain a fee simple interest
in and to the premises described in the attached Exhibit "A° located in the City of Dublin,
Franklin County, Ohio.
NOW, THEREFORE, BE IT ORDAINED by the Council, of the City of Dublin, State of
Ohio, ~ of the elected members concurring that:
Section 1 _ A fee simple interest in and to the premises located in the City of Dublin,
Franklin County, State of Ohio, and more fully described in the legal description attached
hereto as Exhibit "A" is hereby appropriated for the public purpose of improving Krier Drive,
Dublin Center Drive and the Martin Road intersection, pursuant to Ohio Revised Code Chapter
163 and the Constitution of the State of Ohio.
S .inn 2_ Council hereby fixes the value of the interests appropriated at Six Thousand
Nine Hundred Dollars and 00/100 Cents ($6,900.00) which sum shall be deposited with the
Franklin County Common Pleas Court for the use and benefit of the owners of the property
appropriated as their interests may appear. Upon such deposit, the City of Dublin shall take
possession of and enter upon the property pursuant to law.
Section 3_ Council finds that the appropriation is necessary for the stated purpose, that
the City has been unable to agree with the owners of the property as to appropriate
compensation, and that the City intends to obtain immediate possession of the property.
~ t~ inn 4_ The City Law Director is directed to file a petition for appropriation in the
Franklin County Common Pleas Court, to have a jury impaneled to assess the compensation
to be paid for the real estate herein described above.
~ tie~nn S_. The funds related thereto have been previously appropriated within the Capital
Improvements Tax Fund for the purpose of paying all costs incident to such acquisition.
S ..inn 6_ This ordinance is hereby declared to be an emergency necessary for the
immediate preservation of the public health, safety and welfare. The reason for such necessity
is that the prompt improvement of Krier Drive, Dublin Center Drive and the Martin Road
intersection is necessary to improve traffic circulation and relieve traffic congestion for the
citizens of Dublin. Therefore, this ordinance shall go into immediate effect.

Beginni»g at a railroad spike found at the centerline intersection of Sawmill Road and
Martin Road;
Thence North 84° 30' 00" West, a distance of 1096.01 feet to a railroad spike set;
Ti~ence North 06° 07' 34" East, a distance of 479.15 feet to an iron pin found, aid the
true point of beginning at the Northwest corner of the parcel herein described;
Thence South 84° 19' 47" East, a distance of 99.87 feet to an iron pin found at the
Northeast corner;
Thence South OS° 45' 03" West, a distance of 29.82 feet to an iron pin found at the
Southeast corner;
Thence North 84° 22' OS" West, a distance of 100.06 feel to an iron pin set at the
Southwest corner;
Thence North 06° 07' 34" East, a distance of 29.89 feet to the true point of beginning and
containing 0.069 acres, more or less.
The basis of bearing for this description is based on the centerline of Martin Road as recorded in
O.R. 13506, Page J-19 and is North 84° 30' 00" West.
This description is based on a field survey of the property in July of 1997 under the direction and
supervision of .lonathan I-Iardbarger, Ohio Registered Surveyor No. 7687.
