AN ORDINANCE DECLARING THE PROCUREMENT OF
COMPUTER EQUIPMENT AS A "SINGLE SOURCE" PURCHASE,
WAIVING COMPETITIVE BIDDING REQUIREMENTS

WHEREAS, Section 8.04 (c) ("WAIVER OF COMPETITIVE BIDDING") of the Revised
Dublin Charter authorizes Council, by a vote of no less than five (5) Members, to waive
competitivebiddingrequirements if it determines that an item is available and can be acquired
only from a "single source"; and
WHEREAS, Council has determined that there is a legitimate need to declare the procurement
of computer equipment as a "single source" purchase for reason that only one manufacturer's
equipment is compatible with the equipment presently in use with the City of Dublin;
NOW, THEREFORE BE IT ORDAINED by the Council of the City of Dublin, State of
Ohio, ~ of the elected members concurring that:
Section 1. That the procurement of certain computer equipment, in the amount of $94,035.00,
is hereby declared to be a "single source" purchase.
Section 2. That competitive bidding requirements are hereby waived for the procurement of
the above referenced equipment.
~ Section 3. That this Ordinance shall take effect and be in force at the earliest point permitted
by law.

Attached for your consideration is Ordinance No. 44-99 declaring the procurement of certain computer
equipment as a "Single Source" purchase and, thereby, waiving competitive bidding procedures. (Section
8.04(c) of the Revised Dublin Charter authorizes Council, by a vote of no less than five (5) Members, to
waive competitive bidding requirements if it determines that an item is available and can be acquired only
from a "single source".)This purchase involves the acquisition of computer hardware, in the amount of
$94,035.00, for the IBM AS/400 computer systems located at both Justice Center and the Municipal
Building.
A very complicated environment exists between the two computer systems at the Justice Center and the
Municipal Building, which requires the implementation of a redundant operational environment for Police
Dispatch and E-911 applications. A redundant system is necessary in that should the primary system fail,
or if one system is in the process of being updated, the redundant system can be utilized by Police
Dispatch and should minimize potential disruptions in service.
Expenditures for computer hardware in the amount of $20,000 or greater would normally require formal
competitive bidding; however, Staff has determined that only one manufacturer's equipment (IBM) is
compatible with the existing equipment presently in use at the above referenced locations. Therefore,
in Staff's judgment, pursuing formal competitive bidding would serve no useful purpose.
In conclusion, Staff believes that sufficient justification exists to declare the purchase of the required
equipment as a "single source" purchase; Staff, therefore, respectfully requests that Council adopt the
attached legislation.
