Form No. 30043 Ordinance No______________-----__-.__ Passed--------__- --19______-- 43-99 AN ORDINANCE DECLARING THE PROCUREMENT OF MOBILE AND PORTABLE RADIO EQUIPMENT FOR THE DIVISION OF POLICE AS A "SINGLE SOURCE" PURCHASE, WAIVING ~ COMPETITIVE BIDDING REQUIREMENTS, AND DECLARING AN EMERGENCY. WHEREAS Section 8.04 c "WAIVER OF COMPETITIVE BIDDING") of the Revised Dublin Charter authorizes Council, by a vote of no less than five (5) Members, to waive competitive bidding requirements if it determines that an item is available and can be acquired only from a "single source"; and WHEREAS, Council has determined that there is a legitimate need to declare the procurement of the above referenced radio equipment as a "single source" purchase for reason that only one manufacturer's equipment is compatible with the City's existing equipment for "800 MHz trunking" purposes; NOW, T EREFORE BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring that: Section 1. That the procurement of mobile and portable radio equipment, in the amount of $153,980.00, for the Division of Police is hereby declared to be a "single source" procurement. r... Section 2. That competitive bidding requirements are hereby waived for the procurement of the above referenced equipment. Section 3. That this Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public welfare in that in order to comply with IRS regulations relating to the issuance of debt, this expenditure must be completed by May 5, 1999. Therefore, this Ordinance shall take effect and be in force immediately upon passage. Harding, Director of Human Resources/Procurement Rob Geis, Chief of Police Attached for your considerationplease find Ordinance No. 43-99 declaring the procurement of mobile and portable radio equipment for the Division of Police as a "single source" purchase, thereby waiving competitive bidding requirements. (Section 8.04(c) of the Revised Dublin Charter authorizes Council, by a vote of no less than (5) Members, to waive competitive bidding requirements if it determines that an item is available and can be acquired only from a "single source". This purchase involves the acquisition of mobile (car) and portable (walkie) radios, which are part of the Division's overall radio system capital improvementsproject. These mobile and portable radios are upgrades and are required to make the switch to a simulcast trunked 800 MHz system. Below is a breakdown and description of the needed equipment and associated costs: ITEM DESCRIPTION iJNIT TOTAL COST COST 20 -Motorola Mobile Radios Police Cruiser Main Radio $2,471.00 $49,420.00 20 -Mobile Programming and Installation into Cruisers $230.00 $4,600.00 Installation 40 -Motorola Portable Radios Walkie Radio Assigned to Officers $2,307.00 $92,280.00 40 -Accessory Items Speaker Microphone, Antenna & Cord $107.00 $4,280.00 40 -Portable Programming Programming for Each Walkie $85.00 $3,400.00 TOTAL COST $153,980.00 Expenditures for radio communications equipment in the amount of $20,000 or greater would normally require formal competitive bidding, however, given the nature of our upgraded radio system, Staff has determined that only one manufacturer's equipment (Motorola) is compatible with the City's existing technology and the City's need to upgrade to an 800 MHz trunking system. This trunking technology is proprietary to the vendor (Motorola) and portable and mobile radios from vendors other than Motorola will not be compatible with the analog trunking technology employed in the radio system upgrade. Additionally, Motorola Corporate Sales is the sole authorized direct seller of the needed radio equipment and has agreed to extend a purchase price equal with that of the City of Columbus' universal term contract for this equipment. Please note that the attached Ordinance has been drafted as emergency legislation. Given that IRS regulations relating to the issuance of debt require the City to expend funds for this equipmentby May 5, 1999, it is critical that Ordinance No. 43-99 be adopted as emergency legislation at the April 19, 1999 Council Meeting.
