Passed YEAR AN ORDINANCE WAIVING CERTAIN FEES AND REQUIREMENTS TO ALLOW FOR THE TIMELY CONSTRUCTION OF WASHINGTON TOWNSHIP FIRE STATION #97, AND DECLARING AN EMERGENCY WHEREAS, a goal of the Dublin City Council is to continue a favorable relationship with the Trustees of Washington Township; and WHEREAS, Washington Township is preparing to construct Fire Station #971ocated at 4497 Hard Road, Dublin, Ohio; and WHEREAS, the City is currently working with Washington Township to ensure that the site development adheres to all ordinances and City codes; and WHEREAS, Washington Township is a governmental entity and may be partially exempt from local zoning regulations; and WHEREAS, Washington Township has requested a partial waiver to the Tree Preservation Ordinance due to the unique nature of the site; a delay of the installation of a 12-inch water line across the site; and a delay in constructing a bike path along Riverside Drive; and WHEREAS, the City desires to cooperate with Washington Township to allow for the timely construction of Fire Station #97. NOW, TREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring that: Section 1. The City agrees to waive the Dublin portion of certain fees related to water and sewer service for the site, the details of which are to determined by staff. Section 2. The City agrees to partially waive the requirements of the Tree Preservation Ordinance, with the understanding that Washington Township's landscape plan, designed by the landscape architect for the project in consultation with the City's Planning staff, will be of the highest quality possible. Section 3. The City agrees to the Township's delay of the installation of a 12- inch water line across the site and a delay in the construction of a bike path along their Riverside Drive frontage until future development requires said installation and construction. Section 4. In exchange for receiving favorable consideration toward delaying these required public improvements, the Township agrees to enter into a contract with the City which stipulates that, at a minimum, the improvements will be installed when required to service other abutting developments or at an earlier date, as determined by City staff. Section 5. Prior to listing the items, it shall be briefly noted and considered that there are substantive reasons to request a waiver for each item. 1. The Dublin portion of all water capacity, tap, and frontage capacity charges. RElelBoN: Washington Township is. a public service provider for Dublin_ 2. The Replacement Trees Ordinance deficit. REASON: This tree replacement ordinance is a new ordinance and this project is among the first to be scrutinized under the ordinance. Due to the unique nature of this site, it is not possible to meet the "strict letter" of the requirements of the ordinance, though the landscape architect has pushed the design. as far as it can go toward that end. As is .commonly learned in life, it is difficult to make general rules apply to all situations. 3. Extension pf a 12 inch water line across the site. Installation of: an 8 foot wide asphalt bike path along Riverside Drive,. REABoR: simXlar to the water line extension, the Township is not., opposed to installing the bike path in the future when development to the south provides a "place" for the proposed bike path to extend to.
