Form No. 30043 21-99 (Amended) Ordinance No Passed YEAR AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT TO PURCHASE A 1.3290 ACRE TRACT OF LAND, FROM BISCAR PROPERTIES LLC, LOCATED EAST OF SHAWAN FALLS DRIVE, CITY OF DUBLIN, COUNTY OF FRANKLIN, STATE OF OHIO, AND EXECUTE A PAYBACK AGREEMENT WITH WASHINGTON TOWNSHIP FOR REIMBURSEMENT OF SAID PURCHASE, AND DECLARING AN EMERGENCY. WHEREAS, a goal of the Dublin City Council is to continue to acquire land for parkland and recreation purposes; and WHEREAS, the City desires to enter into an agreement to purchase a 1.3290 acre tract of land for the preservation of open space along Shawan Falls Drive for $375,000.00 plus costs, not to exceed $390,000.00 ;and WHEREAS, the agreement of intent to purchase will set forth the payment plan to acquire the 1.3290 acre tract of land, with the final installment due and payable on March 15, 2002; and WHEREAS, the City intends to enter into a payback agreement with Washington Township for reimbursement of said purchase; and WHEREAS, the aforementioned objectives will require the City of Dublin to obtain a fee simple interest in the 1.3290 acre premises more fully described in the attached Exhibits "A" and "B", located in the City of Dublin, Franklin County, Ohio. ~ NOW, THEREFORE, BE IT RESOLVED by the Council, of the City of Dublin, state of Ohio, Vr of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute an Agreement to Purchase and any necessary closing documents related to the acquisition of the 1.3290 acre tract of land and paying any related costs. Section 2. The City Manager is hereby authorized to execute a Payback Agreement for the reimbursement by Washington Township of the acquisition of the 1.3290 acre tract of land. Section 3. This Ordinance is declared to be an emergency measure for the immediate preservation of the public peace, health, safety or welfare, and for the further reason of executing and closing on the purchase in accordance with the Agreement of Intent to Purchase; therefore, this Ordinance shall take effect and be in force immediately upon its passage.
