YEAR AN ORDINANCE AUTHORIZING THE PURCHASE OF A 0.139 ACRE TRACT OF LAND, LOCATED SOUTH OF BRIDGE STREET, WEST OF SOUTH HIGH STREET, CITY OF DUBLIN, COUNTY OF FRANKLIN, STATE OF OHIO, ' AND THE EXECUTION OF A DEVELOPER'S AGREEMENT, AND DECLARING AN EMERGENCY. WHEREAS, the Dublin City Council passed Resolution No. 24-96, a Resolution of Intent to Appropriate a Fee Simple Interest in a 0.3875 acre + or -Parcel Owned by Dublin Marathon Service Company, Located on the West Side of High Street and South Side of Bridge Street, in the City of Dublin, County of Franklin, State of Ohio, on June 17, 1996; and WHEREAS, said acquisition was for the purpose of enhancement of the historic area, community definition, downtown re-development and to encourage additional private investment throughout the entire Old Dublin Historic Area; and WHEREAS, the City is currently involved in the development of the Olde Dublin Town Center; and WHEREAS, the Dublin City Council has discussed the purchase of only 0.139 acre, a portion of the above-referenced parcel, for the construction of a parking lot to facilitate the Olde Dublin Town Center; and WHEREAS, the City intends to coordinate the development of said parking lot to ensure all ordinances and City codes are strictly adhered to; and WHEREAS, the aforementioned objectives require the City to obtain a fee simple interest in the 0.139 acre premises more fully described in the attached Exhibit "A", located in the City of Dublin, Franklin County, Ohio. NOW, THE~.tEFORE, BE IT ORDAINDED by the Council, of the City of Dublin, state of Ohio, of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute a Real Estate Purchase Agreement and any necessary closing documents related to the acquisition of the 0.139 acre tract of land and pay any related costs. Section 2. Whereas, sufficient funds have been appropriated in the 1999 Operating Budget for land acquisition in the Capital Improvements Tax Fund. Section 3. The City Manager is hereby authorized to execute a Developer's Agreement for the construction of a parking lot to be located adjacent to the proposed Olde Dublin Town Center with a cost not to exceed $164,000.00. Section 4. This Ordinance is declared to be an emergency measure for the immediate preservation of the public peace, health, safety or welfare, to provide parking for Old Dublin, for the quick and safe removal of storage tanks, and for the further reason of executing and closing on the purchase in accordance with the Real Estate Purchase Agreement; therefore, this Ordinance shall take effect and be in force immediately upon its passage. McDaniel, Director of Service Date: February 10, 1999 Re: Ordinances 15-99, 16-99, and 17-99 Please find attached Ordinances 15-99, 16-99 and 17-99, respectively. These Ordinances are intended to reflect the guidance provided by the Administrative Committee. The three ordinances have very similar language in all aspects of the three proposed commissions, except of course for specific duties. New concepts added to each Commission include: A. Broader yet snore definitive duties. B. Requirement to provide an Annual Report to Council summarizing their activities. C. Ability to establish (a) Task Force(s) with Council approval. The net effect on existing boards and commissions includes a consolidation of the Cemetery Advisory Board and Solid Waste Advisory Board functions under a new Community Services Advisory Commission; the Child Care Advisory Committee will be repealed but may be resurrected as a Task Force under the Parks R Recreation Advisory Commission; the Transportation Task Force will also be repealed; and the Tree and Landscape Advisory Commission is renamed "Natural Resources Advisory Commission" to reflect their broader purpose a~Id scope. The following briefly summarizes each Ordinance: I5-99 Parks & Recreation Adviso~~ Conrnrissiorr. This Commission is reinvented from the previous Parks • & Recreation Advisory Board. This Ordinance sets forth more specific guidance as to the duties of this Commission. It is necessary to amend the Code to reflect those changes desired by Council. As previously mentioned, the Child Care Advisory Committee will be repealed as part of this Ordinance. 16-99 ~\'atnral Resources Advisory Connnission. This Commission effectively renames the existing Tree & Landscape Advisory Commission and broadens its duties in regard to the City's natural beauty and resources. It also sets forth more specific guidance as to the duties of the Commission. It is necessary to repeal the existing code regarding the Tree & Landscape Advisory Commission and replace it with new language to reflect the desired changes. 17-99 Conrutcurit~~.ServicesAdvisory Coutnrission. This Commission consolidates the duties of the Cemetery and Solid Waste Advisory Boards while expanding their pun'iew to include more Department of Service and Safety related programs and issues. It is necessary to repeal the existing code and Ordinance 91-97 to implement the desired changes. These proposed revisions are in keeping with Article V11 of the Revised Charter of the City of Dublin. Therefore, please find attached Ordinance 15-99 (amended) which includes a new §32.77 which will read: "The Parks & Recreation Advisory Commission shall organize annually and elect a chairperson, vice chairperson, and secretary."
