of Uhio, ~f the elected members concurring:
Section 1. That the following described real. estate (see attached map marked Exhibit "A")
situated in the City of Dublin, State of Ohio, is h~rebY rezoned PI1D, Planned Unit
Development District and shall be subject to regulations ar~d procedures contained in
Ordinance No. 21-70 (Chapter 153 of the Codified Ordinances) the City of Dublin Zoning
Code and amendments thereto.
Section 2. That application, F..xhibit "B", including the list of contiguous and affected
property owners, and the recommendations of the Planning and Zoning Commission,
Exhibit "C", are all incorporated into and t:iade an official part of this Ordinance and said
real estate shall be developed and used in accordance therewith.
Section 3. That this Ordinance shall take effect and'oe in force from and after. the earliest
period rillowed by law.

The proposed development of 11 two-family condominiums and a small
office/daycare center will~"cohesive with the existing and future
uses of the area. This proposal will serve as a good transition from
the Avery Road Corridor back to the future Kendall Ridge Subdivision.
The design of the site and the buildings has placed an emphasis on
blending into a single-family neighborhood.
STATEMENT:
State briefly how the proposed zoning and dcvcloprnent relates to ttre Dublin Community flan.
The proposed development is consistent with the Southwest Area Plan
and the Dublin Community Plan. The Dublin Community Plan calls for
a maximum density of 2-5du/acre and this proposal is approximately
2.64du/acre.
The Southwest Area Plan encourages the corridor to have a residential
character. The design of this proposal strives to reflect a
residential character while providing needed uses for the area.

A. PERMITTED USES
"' The 8.3 acre parcel shay. be developed in accordance with the approved Concept
Plan 97-035CP (Trees Property) approved by Planning and Zoning Commission on 4/17/97
'~°"` and later approved by City Council on 6/23/97. The uses shall consist of 11 two-family lots
(22 units total) and an office/daycare center. Uses for the office/daycare center shall be
consistent with Section 153.026 of the Zoning Code to include daycare center.
B. SITE PLAN
The gross density of the site shall be 2.64 du/acre with a 1.8 acre parcel for an
office/daycare center with 0.9 acres (Reserve "A") shall be developed as a retention pond to
be built to serve Kendall Ridge Subdivision and other off-site properties. A 0.5 acre parcel
(Reserve "B") shall be reserved as open space with landscaping and maintained by the
Association. The average lot size for the 11 two-family units shall be 100' x 150'.
C. DEVELOPMENT STANDARDS
ROW Setbacks: All buildings shall be setback 25' from the right-of--ways of
Tusswell Drive and Kendall Ridge Loop. The building setback for the office/daycare from
the proposed right-of--way for Avery Road shall be a minimum of 30'. Parking shall be
setback 25' from the proposed right-of--way.
Side Yard Setbacks: The side yard setback shall be a minimum of a 5' and this
shall include fireplaces, bay windows, eaves, and overhangs. The office/daycare shall have
a minimum of 25' setback from the north property line. The parking for the office/daycare
shall have a setback of 10' from the north property line.
Rear Yard Setbacks: A minimum rear yard setback of 25% or more of the lot depth
but not more than 50' with a minimum of 30' for the 11 two-family units. The parking for
the office/daycare shall be 10' from the property line for Reserve "A" and maneuvering
shall be permitted at the lot line. The parking area shall be screened from Reserve "A" in
accordance with City of Dublin regulations.
Maximum Building Height: 35'.
Access: Access to the office/daycare shall be permitted only from Tusswell
Drive and shall be a minimum of 200' from the centerline of Avery Road. A left-turn lane
on Avery Road shall be provided at the entrance to the site along with adequate street
lighting as approved by staff. A 4' concrete sidewalk shall be installed on both sides of all
public roads and an 8' asphalt path shall be installed along the frontage of Avery Road.
D. DESIGN GUIDELINES
11 Tivo-Family Condominiums: Each unit shall be a minimum of 1,550 sq. ft. in
area. Natural materials shall be used on the exterior of the units to include: stone, brick and
wood siding. Each building has been designed to reflect the appearance of asingle-family
structure. The individual buildings shall vary in the amounts of stone, brick or wood siding
is used, but in no case shall they be less than 70% of the exterior material used. A maximum

of two buildings shall be done all in wood siding for the exterior material. All sides of the
buildings shall have equal quality in architecture and materials used. This will create an
individual identity for each building, similar to single-family development. All chimneys
shall be masonry. Buildings shall share driveways to reduce the number of curb cuts.
Oj~ce/Daycare Center: The building shall be a maximum of 7,500 sq. ft. in
area. Natural materials shall be used on the exterior of the building to include: stone, brick
and wood siding, but in no case shall they be less than 70% of the exterior material used.
All sides of the building shall have equal quality in architecture and materials used and shall
be coordinated with the residential buildings. The building shall be designed as a single
story structure. Lot coverage for the office/daycare site shall not exceed 60% of the lot.
Parking lot lighting shall be the minimum required by the City of Dublin to minimize the
impact on the residential character. Any playground associated with a daycare shall be to
the north and west of the building and surrounded by a 5' high wrought iron fence.
Signage: The signage for the 11 two-family condominiums shall be two stone
pillars with limestone caps and coach lights. The pillars dimensions shall be 2.5'x 2.5' and
4.5' in height. One pillar shall be located at the southeast corner of the eastern intersection
of Tusswell Drive and Kendall Ridge Loop. The other pillar shall be located at the
southwest corner of the western intersection of Tusswell Drive and Kendall Ridge Loop.
Signage for the office/daycare center shall be a monument sign limited to 6' in height and
the sign area shall be regulated by Section 153.164 of the Dublin Zoning Regulations. Any
proposed signage shall be submitted to the City of Dublin for review and approval.
Landscaping: Street trees shall be 13/4" caliper Silver Lindens spaced
approximately 45' on center. Landscaping for buffering, replacement trees, open spaces and
each individual building and the office/daycare center shall be submitted at a later date to the
City of Dublin for review and approval. The landscaping shall provide buffers between this
site and Dan-Sherri Avenue and between any non-residential areas. The landscaping for the
office!daycare building shall include a unique landscape design along Avery Road that shall
be subject to approval at the final development plan.
All trees that meet the definition of a protected tree by the City of Dublin Code shall
be saved or replaced on-site in accordance with the Tree Preservation Ordinance and
Landscape Code.
Fe~icing: One type offence shall be used on the site subject to approval at the
final development plan. Chain-link, board-on-board privacy and plastic fencing shall be
prohibited.

1~Vater: A 12" watermain has been installed by others along the length of the future
Tusswell Drive. A 16" waterline has been installed along the frontage of Avery Road.
Sanitary Sewer: A sanitary sewer line shall be installed by others from the future
Tusswell Drive offsite to the Cosgray Trunk Sewer.

Storm Sewer: The retention basin and storm sewers from the adjacent Kendall
Ridge Subdivision shall be installed by others. The surface drainage for the site shall be
handled in conjunction with the retention basin and shall meet all applicable requirements of
the City of Dublin.
G. TRAFFIC CIRCULATION
Tusswell Drive shall serve as the main east/west collector and shall connect to the
Kendall Ridge Subdivision as a secondary access point. Tusswell shall have a pavement
width of 28' (back to back) roadway with a 50' right-of--way. A third lane shall be installed
at the intersection of Tusswell Drive and Avery Road. The pavement shall have a pavement
width of 36' (back to back) with a 60' right-of--way at that point. An island 50' in length
shall be installed at the entrance from Avery Road to give the appearance of a boulevard
street. Kendall Ridge Loop shall have a pavement width of 28' (back to back) with a 50'
right-of--way.
All roads shall be dedicated right-of--way and shall be constructed in compliance
with all applicable City of Dublin standards.
H. CONDOMINIUM ASSOCIATION
A Condominium Association will be formed that shall establish the Association as
responsible for the care and maintenance of all common areas, landscaping, open space,
signage, exteriors of the structures and any other items commonly associated with
Condominium Association responsibilities.

Condominiums (previously known as Trees Property)
Location: 8.3 acres located on the west side of Avery Road, approximately 600 feet
north of Dan-Sherri Avenue.
Existing Zoning: R-1B, Restricted Suburban Residential District (Washington
Township).
Request: PUD, Planned Unit Development District.
Proposed Use: Eleven two-family condominiums and an office/daycare center of
7,500 square feet. Suite
Applicant: The Stonehenge Company, c/o l~io Dioun, 6253 Riverside Drive,
200., Dublin, Ohio 43016; represented by Jack Reynolds, Smith and Hale, 37 West
Broad Street, Columbus, Ohio 43215.
MOTION: To approve this rezoning application with 13 conditions:
1) That the text be revised to include a commitment for a unique landscape design
along the Avery Road frontage subject to approval at final development plan;
2) That the text be clarified to commit to equal quality architecture on all sides of
all buildings, coordinating the architecture of the office/daycare with the
residential component, complying with the Tree Preservation Ordinance and
Landscape Code, and providing buffers between this site and Dan-Sherri
Avenue and along any non-residential areas;
3) That all bikepaths and sidewalks be shown on the plans;
4) That right-of--way for Avery Road, which complies with the MS Consultants
alignment study (100 feet from the existing centerline), be deeded to the City;
5) That left turn widening on Avery Road be provided at the entrance to the site
along with adequate street lighting, as approved by staff;

Council consideration.
RESULT: This rezoning application was approved. It will be forwarded to City Council with a
positive recommendation.

10) That only one type of fence be used within the development and be approved at
the final development plan stage;
11) That there be a maximum of two residential buildings with all wood siding, and
the remaining buildings be a mixture of masonry and wood;
12) That the homeowners' association maintain all common property; and
13) That Conditions 1, 2 and 3 be met prior to this case being scheduled for City
Council consideration.
RESULT: This rezoning application was approved. It will be forwarded to City Council with a
positive recommendation.
