AN ORDINANCE AUTHORIZING THE CITY MANAGER
TO ENTER INTO AN AGREEMENT FOR THE LOCATION OF
A WIRELESS TELECOMMUNICATIONS STRUCTURE

WHEREAS, AT&T Wireless Services PCS, Inc. desires to locate a wireless
telecommunications structure on the Blazer Parkway water tower and ground equipment
inside the tower; and
WHEREAS, the Telecommunications Act of 1996 requires the reasonable accommodation
of such structures; and
WHEREAS, the City of Dublin desires to employ innovative techniques to accommodate
such structures in accordance with Chapter 99 of the Codified Ordinances of the City of
Dublin; and
WHEREAS, the City of Dublin and AT&T Wireless Services PCS, Inc. have determined
the Blazer Parkway water tower site and design of the wireless structure is mutually
beneficial to both parties.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of
Ohio, r of the elected members concurring that:
Section 1. The City Manager is hereby authorized to enter into a lease agreement with AT&T
Wireless Services PCS, Inc. for the purpose of constructing, owning and operating a wireless
telecommunications structure on the Blazer Parkway water tower with associated ground
equipment inside the tower.
Section 2. This Ordinance shall be in effect on the earliest date permitted by law.

Re: Ordinance 63-99, AT&T Wireless Services PCS, Inc. Lease Agreement
Staff recommends Council approve Ordinance 63-99, attached. This Ordinance authorizes the City
Manager to enter into a lease agreement with AT&T Wireless Services PCS, Inc. This lease
agreement will allow AT&T to place a wireless structure on top of the Blazer parkway Water
Tower and allow the placement of ground equipment within the tower.
As you know Chapter 99 of the Codified Ordinances of the City of Dublin encourages pro-active
actions by staff to facilitate the location of wireless structures onto public lands and/or existing
facilities. The placement of the proposed structure on the water tower achieves both objectives.
Because the structure will be placed on the water tower, the review and approval of this placement
is administratively approved. However, it is necessary for Council to act on Ordinance 63-99
regarding the lease agreement to use the public facility.
I have also attached a rather extensive set of plans for your detailed review. These plans give you
an idea of how the structure and antennas will be placed and screened, as well as, a sense of how
ground equipment will be placed within the tower. I apologize for the awkward size of these plans.
The structure will look very similar, if not exactly like that currently on the Avery Road water
tower.
The lease agreement is structured in the same manner as the two most recent agreements approved
by Council including Sprint PCS at Avery Park and Scioto Park. The initial term of the lease is
five years with five possible renewal terms of five years each. AT&T will pay the City $24,000

annually for the initial term ($120,000 total). The first payment shall be for the first two years of
the lease term ($48,000) and shall be paid to the City upon commencement of the Lease
Agreement. Each subsequent term will be adjusted by the Consumer Price Index. In addition to
the lease payments, AT&T will run cable TV conduit and cable to serve the existing fire station.
Time Warner will provide the actual cable TV service, as required by their Franchise Agreement
with the City.
Staff is convinced that this arrangement continues to represent an innovative and pro-active
approach to meet all the City's desired objectives regarding wireless structures.
