WHEREAS, Council has determined that there may be a legitimate need to declare the relocation of the utilities in connection with the above-referenced project as a "single- source" procurement, for reason that the company owning the utilities in question has the exclusive rights to relocate such utilities. Hansley, City Manager Initiated By: Director of Engineering/City Engineer_ Re: 1999 Street Maintenance Program -Ordinance No. 57-99 Date: May 12, 1999 In March of this year, Council was provided a memo and a report from the City Engineer containing details of the 1999 Infrastructure Maintenance Program. Construction plans were prepared and bids were solicited for the 1999 program. On May 12, 1999 five (S) bids were received and publicly opened and read for the 1999 Street Maintenance Program. Bids were received as shown on the attached bid form. All bids submitted have been reviewed. The two lowest bids were only $174.12 apart. Reference checks were made for the lowest bidder, and in my judgement, the best, responsible bidder is The Shelly Company. The 1998 Street Maintenance Program was also satisfactorily completed by the Shelly Company. It is recommended that we award this contract to The Shelly Company located in Columbus, Ohio. Funding for this project has been authorized in the annual appropriation ordinance and this bid is within the funds appropriated. Attached is an Ordinance for approval by City Council prior to awarding this contract to The Shelly Company. Your prompt approval is most appreciated, so that construction may begin as soon as possible. One of our most recent contracts was for improvements to County Line Road in 1996. As part of its award of the contract for that project, City Council stipulated that Miller Pavement Construction was to have been substantially completed with the project by a certain date or risk being disqualified from bidding on future City of Westerville work for a period of not less than 5 years. The project's contract was administered by the City under my direction through our field representative, Mr. Michael Doctor, Chief Construction Inspector. Miller Pavement Construction met the deadline. Miller Pavement Construction has been allowed to bid on subsequent City projects, and would have been favorably considered for an award of contract if they would have been the successful low bidder. Let me share my extreme disappointment in you and your organization for allowing this memo to become public. Further, let me tell you a few things about me. I work very hard to do the right thing. In doing the right thing, I sometimes have to put my personal feeling on hold. When someone calls me asking for references for someone or some company, I feel it is my duty to respond to those inquiries with truthful and straight forward answers. However, I feel your staff member, Paul Selegue, has seriously misrepresented my remarks. I would like to address each "confidential" quote separately. This will allow you to better understand what I said to Mr. Selegue. Quote # 1: Mr Selegue presented to me several issues (ie: " We have heard from various people that Miller Pavement is difficult to work with, they are slow and their work is not of good quality." Your memo states that my response was: "You (Dublin) would be very smart if you could get someone else." If fact my response was: "Well Paul, based on your concerns and what I'm hearing you say, you might be better off awarding to number 2." Quote #2: Mr. Selegue asked about our experiences with iVliller Pavement in Westerville and "would we like to see them be awarded work again." Your memo states that my response was: "Miller will be hard pressed to get any work in Westerville any time soon." In fact my response was: "Miller has done 3 projects for us in the last few years. There are better contractors out there and there are worst contractors out there. The last project they did for us was a very difficult project that caused both sides to strain their patience. They had certain deadlines to meet and although it appeared that they might not meet them, they did in fact meet those deadlines. Were there problems along the way? Yes. Did tempers flair? At times, yes. I doubt that Miller will be bidding any more work in Westerville any time soon." Quote #3: Mr. Selegue quote me as saying: "If Miller was ever low bidder again in Westerville, that I would go to bat to make sure they did not get the award." I did not say these words. I stated the names of three roadway projects David L. Pearson, P.S. currently under construction or completed during the past five years (since Suruey and G/SAdn:inistrator 1994). The projects were Galloway Road south of US 40 (1994-1990, Kenny David Philips, P.E. Planning Q Programming Road between King Avenue and Kinnear Road (1996-1998), and the Avery hark Sherman, P.E. Road project between Main Street and Hayden Run Road within the City of Bridge Engineer ~w Hilliard currently under construction. James Fra~anato Traffic Superintendent I stated that the Kenny Road project, Miller's asphalt plant operations, and Briohanr J. Mitten, P.s. excavation operations were in general, satisfactory. Superintendent The accepted final 404 asphalt riding surface on Galloway Road was a concern for this office. The 404 asphalt riding surface quality completed during the late fall of 1998 on Avery Road between Hayden Run and Davidson Road has been a concern to this office and comments have been made by the general public concerning the riding surface. I also stated that the 404 work completed in the fall of 1998 would be corrected at the contractor's e~cpense within a week or two [of our phone conversation). As of May 19, 1999, the 404 asphalt riding surface of the Avery Road project in Hilliard was corrected to a condition considered satisfactory by milling and adding a 1 '/a" overlay. A few normally typical minor manhole and valve cover adjustments will still be necessary. Other road projects prior to five years ago not discussed in the telephone conversation include Demorest Road at Briggs Road intersection (1992-1993), Alkire Road at a railroad crossing east of Kropp Road (1993), and Dellinger Road between Hubbard Road and Amity Road (1993). Also not discussed in the phone conversation, Miller Pavement performed two small bridge culvert replacement projects on Wilcox Road in Dublin during the spring of 1996. All of these projects mentioned in this paragraph were completed in a satisfactory manner with no corrective tivork necessary for the final 404 asphalt pavement surface. This affidavit will be accepted in lieu of complete copies of previously submitted documentation of knowledge and experience in performing work.
