AN ORDINANCE TO ACCEPT AN ANNEXATION OF
106+ /- ACRES IN JEROME TOWNSHIP,
UNION COUNTY TO THE CITY OF DUBLIN
WHEREAS, on May 3, 1999 the Union County Commissioners approved the
annexation application filed by Christopher T. Cline, Blaugrund, Herbert & Martin,
Inc., 5455 Rings Road, Dublin, OH 43017 Agent for Petitioners William R. Syar II,
Rita Diane Syar, Northwest Assembly of God, Albert Lee Schoby, Florence Schoby,
GLK Properties, LTD., BJL Limited Partnership, and Post Hylands Co.; and
WHEREAS, Council is of the opinion that this territory should be annexed to the City
of Dublin.
NOW, THF,ItEFORE BE IT ORDAINED by the Council of the City of Dublin, State
of Ohio, ~~ of the elected members concurring:
Section 1. That the petition for the annexation of 106+/- acres (see attached legal
description, Exhibit "A") to the City of Dublin, Ohio is hereby accepted.
Section 2. That this Ordinance shall take effect and be in force from and after the
earliest date allowed by law.

Situate in the State of Ohio, County of Union, Jerome Township and lying in Virginia
Military Survey Number 3452 being all of the 51.851 acre tract owned by Albert Lee and
Florence Schoby (Map Number 147-00-00-012.000, Parcel Number 17-00-29016.000), all of the
46.833, 3.957 and 1.048 acre tracts owned by Northwest Assemby of God (Map Numbers 147-
00-00-014.000, 147-00-00-014.001 and 147-00-00-015.000, Parcel Numbers 17-00-29017.000,
17-00-29017.200 and 17-00-29018.000) and all of the 1.06 acre tract owned by William R. II and
Rita Diane Syar (Map Number 147-00-00-013.000, Parcel Number 17-00-29017.100) and the

Thence SOUTHERLY, a distance of 4400 feet, more or less, with said Corporation Line
being a line common with the easterly line of said 46.833, 3.957 and 1.048 acre tracts and the
westerly lines of a 15.704 owned by M.I. Schottenstein Homes, a 1.550 acre tract owned by City
of Dublin and a 2.627 acre tract owned by Cast Post Limited crossing Post Road (60 feet in
width) to a point in the southerly right-of--way line of said road, said point being an angle point in

PUBLIC NOTICE OF ANNEXATION HEARING
On the 17th day of February, 1999, a petition to annex 106 acres of land, more or
less, to the City of Dublin, Ohio from Jerome Township, Union County, Ohio, was filed
with the County Commissioners of Union County, Ohio. The filing also included a map
of said territory proposed for annexation. A full legal description of said premises
follows at the end of this notice. Christopher T. Cline was appointed agent for petitioners
and duly gives this public notice in accordance with law, said notice to be published once
per week for four consecutive weeks in a newspaper of general circulation in Union
County.
The matters contained in the annexation petition will come on for hearing before
the Board of County Commissioners of Union County, Ohio the 3rd day of May, 1999 at
10:00 A.M. in the office of the Board of County Commissioners, 233 West Sixth Street,
Marysville, Ohio

OHIO -CHRISTOPHER CLINE -AGENT FOR PETITIONERS
A motion was made by Jim Mitchell and seconded by Tom McCarthy to approve the
following resolution:
WHEREAS, a petition for annexation was filed on February 17, 1999, naming
Christopher T. Cline, Agent for the Petitioners, and praying for annexation to the City of Dublin,
Jerome Township, Union County, Ohio;
AND WHEREAS, said petition represents real estate situated in Jerome Township,
Union County, Ohio being a total of 106 acres, more or less, and being contiguous and adjacent to
the City of Dublin. There are eight (8) owners of real estate in the territory sought to be annexed
to the City of Dublin, Ohio.
THEREFORE, BE IT RESOLVED, that said petition for annexation be and is hereby
received pursuant to Section 709.02 of the Ohio Revised Code, and shall be advertised by
publication as required by law, and the public hearing on said petition shall be held in the office
of the Board of Union County Commissioners, 233 West Sixth Street, Marysville, Ohio, at 10:00
a.m. on Monday, May 3, 1999.

CLINE -AGENT FOR PETITIONERS
A public hearing was held at 10:00 a.m. in the office of the Union County
Commissioners for the purpose of considering a Petition for Annexation of 106 acres, more or
less, in Jerome Township, Union County, Ohio to the City of Dublin filed on February 17, 1999
by Christopher Cline, Agent for the Petitioners.
Commissioner Fraser indicated the statutory requirements regarding the filing of the
petition had been met.
Mr. Cline, agent for the petitioners, stated that there are 8 property owners and that 7
have signed the petition and the last one is not opposed to the annexation. Mr. Cline gave a brief
presentation of the documents of the petition.
In attendance at the hearing, presided over by Commissioner Don Fraser were:
Commissioners McCarthy, Fraser and Mitchell and Commissioners For A Day, Jason
Tom and Alicia Augustin; Commissioners Clerk, Rebecca Roush; Christopher Cline, Agent for
the Petitioners; Mr. & Mrs. Warren Gorden, interested citizens; Court reporter, Charles Potts; and
Marysville Journal Tribune reporter, Cindy Brake.
No opposition to the annexation was given at the hearing.
The hearing was adjourned at 10:25 a.m. Resolution to follow.

A motion was made by Don Fraser and seconded by Jim Mitchell to approve the
following resolution:
DECISION
The present annexation proceeding before us today was brought about by the application
of the owners of real estate adjacent to a municipal corporation. As such, it is governed by the
procedures set forth in Ohio Revised Code Sections 709.02-.12. This kind of annexation is
initiated by the filing of a petition with the board of county commissioners of the county in which
the territory is located. The petition must be signed by a majority of landowners in the territory
adjacent to the municipal corporation. In addition the petition must contain a full legal
description and accurate map or plat of the territory to be annexed, a statement of the number of
real estate owners in the territory, and the name of the person or persons acting as agent for the
petitioners. The board of county commissioners conducts a public hearing on the petition,
accepting evidence and hearing testimony in support of and against the proposed annexation.
The statute mandates that the board of county commissioners shall enter an order
upon its journal allowing the annexation if it finds that: (1) the petition contains all matter
required in section 709.02 of the Revised Code; (2) notice has been published as required by
section 709.031 of the Revised Code; (3) the persons whose names are subscribed to the petition
are owners of real estate located in the territory in the petition, and as of the time the petition was
filed with the board of county commissioners the number of valid signatures on the petition
constituted a majority of the owners of real estate in the territory proposed to be annexed; (4) the
municipal corporation to which the territory is proposed to be annexed has compiled with
division (B) of section 709.031 of the Revised Code; (5) the territory included in the annexation
petition is not unreasonably large; (6) the map or plat is accurate; and (7) the general good of the
territory sought to be annexed will be served if the annexation petition is granted. The legislative
authority of the municipal corporation (city council) then must accept the application for
annexation by resolution or ordinance. The annexation takes effect and the territory becomes part
of the municipality thirty days after passage of the resolution or ordinance.

Findings of Fact
There is no question and there was no dispute that the evidence established by a
preponderance that:
(1) the petition contains all matter required in section 709.02 of the Revised Code;
(2) notice was published as required by section 709.031 of the Revised Code;
(3) the persons whose names are subscribed to the petition were, at the time of the filing
of the petition, the owners of real estate located in the territory in the petition, as as of
the time the petition was filed with the Board of County Commissioners, the number
of valid signatures on the petition constituted a majority of the owners of real estate
in the territory proposed to be annexed;
(4) the municipal corporation to which the territory is proposed to be annexed (City of
Dublin) has complied with division (B) of section 709.031 of the Revised Code; and
(5) the map or plat, as amended, is accurate;
(6) the territory included in the annexation petition is not unreasonably large;
(7) the general good of the territory sought to be annexed will be served if the annexation
petition is granted.
Having concluded that there is a preponderance of reliable, probative and substantial evidence to
support the seven criteria which must be found in order to grant an annexation petition, we cast
our vote for the annexation.

WHEREAS, a public hearing has been scheduled before the Union County Commissioners
on Monday, May 3, 1999 at 10:00 a.m.; and
WHEREAS, Section 709.031 of the Ohio Revised Code requires that, prior to the hearing
of the annexation petition, the Municipal Authority shall adopt a statement indicating what
services, if any, the Municipal Corporation will provide to the territory proposed for
annexation; and
WHEREAS, the area proposed for annexation lies within Dublin's'exclustve water aril
sewer service extension area, as provided under the agreements with the City of Columbus;
and
WHEREAS, the proposed annexation is in conformance with the annexation strategy
contained in the Dublin Community Plan, adopted by Council on November 17, 1997.
NOW, TH BEFORE, BE IT RESOLVED, by the Council of the City. of Dublin, State of
Ohio, of the members concurring that:
Section l The City of Dublin will provide the following municipal services for the 106+/-
acres in Jerome Township, Union County upon the annexation of the area to the City of
Dublin, Ohio:
Po1i~. The City provides Police and Communications service on a full twenty-four
hour basis and also has mutual aid agreements with other municipalities. Tl~e
annexation area lies approximately one mile west of Dublin Police Division
headquarters. Dublin operates with a minimum of four cruisers on duty. A response
time of approximately eve minutes for an emergency situation should be expected
for this area.
Firs. Fire. and emergency medical services protection is currently r~,rovided by well-
staffed departments in Jerome and Washington townships. T'-,;;.y, too, have mutual
aid agreements with other municipalities.. 'l his annexation ~ vould not change fire
department jurisdictional -boundaries, and therefore response ~~mes for fire and
emergency medical services will not be affected. The Jerome Township Fire Station
is approximately six miles from the annexation area, and nornial response times
should be approximately eight minutes. However, due to an existing automatic
response agreement, the area is also served by the Washington Townsh~r~ Fire Station
93 which is located approximately one mile away, and normal response° time would
be approximately three minutes.
Sani atiQn. Residential refuse collection services are contracted by the City and are
currently provided at no additional charge.

excellent service in the area of street and road maintenance.

Columbus, and the subject property is within the service areas. Conditioned on the ability
of the City of Columbus to provide WATER, and to provide sufficient SEWERAGE d}sposal
capacity, the City of Dublin will have the ability to service the area.
Section 3 This resolution shall be in force and effect immediately upon its passage as
provided under Section 4.04(a) of the Revised Charter.
