AN ORDINANCE TO APPROPRIATE A FEE SIMPLE INTEREST
CONSISTING OF 0.947 ACRES, MORE OR LESS, FROM LORI A.
CROSS, IN PROPERTY LOCATED ON THE SOUTH SIDE OF
RINGS ROAD, CITY OF DUBLIN, COUNTY OF FRANKLIN,
STATE OF OHIO.
WHEREAS, a goal of the City of Dublin is to continue to acquire land for parkland and
recreation purposes; and
WHEREAS, the aforementioned objective will require the City of Dublin to obtain a fee
simple interest in and to the premises described in the attached Exhibit "A" located in the
City of Dublin, Franklin County, Ohio.
WHEREAS, it is necessary to amend the annual appropriations ordinance to provide
funding for this acquisition.
NOW, T~IEREFORE, BE IT ORDAINED by the Council, of the City of Dublin, State of
Ohio, ~ of the elected members concurring that:
Constitution of the State of Ohio.
Section 1. A fee simple interest in and to the premises located in the City of Dublin,
Franklin County, State of Ohio, and more fully described in the legal description attached
hereto as Exhibit "A" is hereby appropriated for the public purpose of acquiring land for
parkland and recreational purposes, pursuant to Ohio Revised Code Chapter 163 and the
Section 2. Council hereby fixes the value of the interest appropriated at One Hundred
Twenty Seven Thousand Eight Hundred Ninety Nine Dollars and 00/100 Cents
($127,899.00).
Section 3. Council finds that the appropriation is necessary for the stated purpose, that
the City has been unable to agree with the owner of the property as to appropriate
compensation.
Section 4. The City Law Director is directed to file a petition for appropriation in the
Franklin County Common Pleas Court, to have a jury impaneled to assess the compensation
to be paid for the real estate herein described above.
Section 5. There be appropriated from the Capital Improvements Tax Fund One
Hundred Twenty Seven Thousand Eight Hundred Ninety Nine Dollars ($127,899.00) to
Acct: 401-0314-780-2550for the purpose of paying all costs incident to such acquisition.
Section 6. This Ordinance shall take effect and be in force from and after the earliest
date permitted bylaw.

DESCRIPTION OF ADDITIONAL PARK AND RECREATIONAL LAND
Situated in the State of Ohio, County of Franklin, City of Dublin, located in Virginia Military Survey
No. 2419(4852) and being more particularly described as follows:
See attached copy of Exhibit "A" from O.R. 30138, Page E19
Being the intent of this document to convey the entire property, except as described below, owned by
Lori A. Cross by deed of record in Official Records Volume 30138, Page E18, Auditor's Parcel No.
273-5424, all references being to those in the Recorder's Office, Franklin County, Ohio. Bearings in
the referenced deed of record are based on instruments described therein.
There is excepted from this conveyance a portion of the one (1.000) acre property more particulazly
described as follows:
Commencing at a railroad spike found at the intersection of Rings Road and Paul G. Blazer Pazkway at
a point 21.50 feet right of proposed Rings Road centerline station 54+21.04; thence, N OS°19'56" W a
distance of 21.54 feet alor#g the centerline of Paul G. Blazer Pazkway to proposed Rings Road
centerline at station 54+22.36; thence along the proposed centerline N 84°38'49" E a distance of
533.50 feet to station 59+55.86; thence, S OS°21'11" E a distance of 21.50 feet to a point 21.50 feet
right of station 59+55.86 and the TRUE PLACE OF BEGINNING for the exception, said point being
the northwest corner of the said property;
thence, N 84°38'49" >/ along the north property line a distance of 56.72 feet to a point 21.50 feet right
of station 60+12.59, said point being the northeast property corner;
thence, S 6°29'14" E along the east property line a distance of 40.01 feet to a point 61.50 feet right of
station 60+13.38, passing the existing southerly right of way line for Rings Road at 30.01 feet;
thence, S 84°38'49" W a distance of 57.65 feet to a point 61.50 feet right of station 59+55.73 and on
the west property line;
thence, N 5°09'44" W along the said west property line a distance of 40.00 feet to the TRUE PLACE
OF BEGINNING for the exception, passing the existing southerly right of way line for Rings Road at
10.00 feet, containing 0.053 Acres, more or less, leaving a net take of 0.947 Acres, more or less.
For the description of the exception, the basis for bearing N 84°38'49" E is the Centerline Survey Plat
for Rings Road (Co. Road No. 33) from Wilcox Road to Frantz Road, prepared by and available from
the Franklin County Engineer's Office.
Description prepared in May, 1999 by Franklin D. Blair PS, No. 5676, based on the deed,of record
described above, an actual field survey and plans prepared by Barr Engineering, Inc., Columbus, Ohio.
