Although the Planning and Zoning Commission approved the request as being consistent with the area development plan, the recommended conditions for the rezoning leave something to be desired. Essentially, the rezoning conditions were: that a sidewalk be built on the Crown dealership's side of the new zoning; and further, on the existing Mercedes and Chrysler dealerships, if there was a disturbance of any mounding, (except for a proposed new driveway), sidewalks should be built there also. For two primary reasons, Crown submits that condition does not make any sense and proposes a far more attractive alternative. In the first instance, approximately ten years ago when the original site was developed, street #rees were planted. A requirement for installing sidewalks would involve the removal and replacement of those mature trees. Given City Council's present stated views concerning the tree ordinance, that seems to be contraindicated. Second, the sidewalk will connect to nothing. All of the areas north of Crown have been built in the past without sidewalks. The requirement of additional sidewalks in this tract will mandate that a sidewalk be built which goes "nowhere" and serves "no one." ~ar Having stated the above objections, as an altemative, Crown proposes that the sidewalk on the east side of Perimeter Loop Drive (next to MAG) be extended by Crown around the south end of their property, continuing on as that drive turns back to the north on the west side through the balance of "Reserve B." Although that sidewalk at its northwest end will not connect to anything, at least it will connect to the sidewalks that have been built lay MEG on the east side and extending east from Perimeter Road. This site is established as part "' of Subarea I in the Perimeter Center Subarea Standards and serves as the home for the Crown Motor Company complex, consisting of both the Crown Chrysler dealership and Crown Mercedes dealership. The site is proposed for construction of a 15,786 square foot office and nineteen bay service addition to the existing Mercedes- Benz dealership. This facility will serve as the future home of the Crown Chrysler dealership. The Mercedes-Benz dealership will relocate to the original structure. The vacant, undeveloped parcel of this site is also proposed for construction of a new 5,072 square foot office and six bay service facility for used car sales. All provisions regarding density, setback, height, parking, circulation, waste/refuse, and landscaping applicable to Subarea I of the PCD Text are addressed below in the item-by-item response to the requirements of Dublin City Code 153.058. A. Setback: The attached site plan provides for a 50'-0" building and a 25'-0" pavement setbacks along Perimeter Loop Drive and Mercedes Drive. All setbacks have been identified and indicated on the site/landscape plan. Total lot coverage for this site is less than 75% of the total area. B. Height: Subarea I provisions limit the height of building to a maximum of 65'-0" The proposed addition for the new Chrysler facility is a two story structure with a maximum height of 26'-0" from finish floor to top of the roof parapet. The new used car sales facility is a one story structure with a maximum height of 24' -0" from f finish f loor to top of the roof parapet. C. Parking and Loading: Parking and loading are provided based upon the total square footage of the complex. 1/300 SF = 139.19 for business areas, inclusive of addition and new sales facility; and, 1/100 SF = 289.81 for service area, inclusive of addition and new sales facility; and, Page 2 1/1000 SF = 7.18 for vehicle display area based on 42 vehicles = 7,182 SF display area. Because of specific high quality retail use fulfilling this purpose, the original concept for Perimeter Center was altered to allow creation of Subarea I permitting automobile dealerships "`~` under strict development standards, in addition to the standards set out for Subarea D. _ Subarea I will additionally serve as an•architeetural •transiEioq• incorporating elements of the Perimeter Mall, while at the same time.easing~~into the ~higheracale-uses~ of Subarea D, where common~architectural themes are not contemplated. Tnten'elationships of Rezoning and Development Plan: To create the new Subarea I, a rezoning was necessary. This rezoning is agreed by the initial end user of Subarea I (the Mercedes automobile dealership), the City, and the developer of Perimeter Mall to be specifically conditioned on the development plan presented for the pazcel and the rezoning and development plan are presented concurrently. It is further agreed that a s'unple rezoning to a retail use for this parcel would.be inappropriate. In effect, the rezoning amounts to ~a variance; the development plan, the architecture, building materials, and development standards of the specific rezoning and development plan proposal presented are integral parts of the rezoning. Taking all of these matters together, the particular retail use presented at the time of the rezoning of Subarea I is appropriate for this site. However, it does not follow that any other use deviating in any respect from the development plan presented would be appropriate for the site. It is a condition of the rezoning of Subarea I that any future use of Subarea I must meet the requirements set out in this text.
