That the following described real estate (see attached map marked Exhibit "A") situated in the City of Dublin, State of Ohio, is hereby zoned CC, Community Commercial District, and shall be subject to regulations and procedures contained in Ordinance No. 21- 70 (Chapter 153 of the Codified Ordinances) the City of Dublin Zoning Code and amendments thereto. Section 2. That application, Exhibit "B", including the list of contiguous and affected property owners, and the recommendations of the Planning and Zoning Commission, Exhibit "C", are all incorporated into and made an official part of this Ordinance and said real estate shall be developed and used in accordance therewith. Section 3. That this Ordinance shall take effect and be in force from and after the earliest period allowed by law. REQUEST: Review of a rezoning and Corridor Development District application under the provisions of Section 153.115 and the Corridor Review Text. The site is a 0.698-acre expansion to the existing 3.9-acre Infiniti dealership. Anew 1,000 square foot sales building and automobile display area are to be located between I-270 and Tuller Road. A 0.698-acre parcel to the east of the dealership does not have zoning (formerly ODOT right-of--way), and the establishment of CC, Community Commercial District zoning is requested. STAFF CONTACT: Chad Gibson, Planner. UPDATE: This case was postponed from the June 17, 1999 Planning and Zoning Commission meeting due to the late hour. There was no vote taken or discussion. The staff report remains unchanged. BACKGROUND: The auto dealership located on Tuller Road was constructed in 1989, then as the David Hobbs BMW Dealership. The initial application for the site was approved by the Planning Commission in 1988 (CDD88-007). Two subsequent applications (CDD90-007 and CDD91- 006) were approved for several modifications to the site, including the purchase and development of an irregularly shaped 0.5-acre pazcel (never completed), the establishment of automobile display areas, and a change to the signage, landscaping, and lighting plans. In January and March of this year, the Commission heard this case on an informal basis (Case #98-135I), and minutes are attached. The site is located within the Corridor Development District boundaries. All non-residential proposals are subject to review and approval by the Planning and Zoning Commission in accordance with Section 153.115. The site is also subject to the provisions of the Corridor Review Text which was adopted by the Commission for Dublin Village Center and Dublin City Center commercial developments. A portion of the proposal is located on land that does not have an established zoning district. As a result, the applicant must wait until thirty days after Council approval to proceed with construction. City Council approved the first reading of this rezoning application on June 7, 1999. The City Council public hearing and final vote will be scheduled after the approval of the rezoning by the Commission. CONSIDERATIONS: • An undeveloped 0.698-acre tract is being combined with the existing 3.9-acre automobile dealership. The 0.698-acre tract was formerly I-270 right-of--way, and Dublin Planning and Zoning Commission Staff Report -July 1, 1999 Page 14 zoning for this tract has never been established. The CC, Community Commercial District is requested. The site is located between Tuller Road and I-270, approximately 200 feet west of Sawmill Road. To the north is the I-270 exit ramp for Sawmill Road. To the south of the site are BJ's Wholesale Club and Bob Evans restaurant, within Dublin Village Center. To the east of the site is the freeway interchange and to the west is the Hampton Inn. • The site is highly visible from the I-270 interchange ramps and portions of Sawmill Road. Asingle-point urban interchange (SPUD is currently under construction here as part of the I-270 widening project. • The existing dealership and surrounding properties are zoned CC, Community Commercial District. Limited-access right-of--way for I-270 is located to the north and east of the site. A 1,000 square foot satellite sales building with outdoor auto display area is to be constructed. • This site will be utilized to sell new and used vehicles. New vehicles will be displayed in more prominent locations. An automobile dealership is a permitted use within the CC District under Section 153.028(A)(1)(c). It permits a broad range of retail uses including restaurants, office, and hotels. • The proposal includes a 1,000 square foot building. It is generally rectangular in shape and measures 48' x 24' . The front entrance is shown along the north elevation. The building will be used as a satellite sales office, and there will be approximately three new employees. Building elevations demonstrate four-inch red brick veneer (Glengery X26 HB - "Flashed Mod") and stucco (Duron Sand Dollar) facades with aluminum and clear glass storefront to match the existing dealership. The building has a flat roof, and is 15 feet in height. Rooftop mechanicals are also shown which must be screened per Code. • Cross sections have been submitted which compare the elevation and distance of the proposed expansion with Sawmill Road and the future freeway ramps. The fmished floor elevation of the building is shown at 906 feet. The cross-sections show the Sawmill Road I-270 overpass at 915 feet and the new exit ramp at 910 feet. The I-270 through lanes are shown at 884 feet. The distance between the dealership pavement edge and the current I-270 ramp is 80 feet, which will expand to 200 feet after construction of the SPUI. The new ramp (909.5) will be five feet higher than the dealership edge of pavement (904.5). There will be 200 feet between the display area and Sawmill Road. Sawmill Road (908) will be three feet higher than the dealership pavement elevation (905). • The required building and parking setbacks along limited access freeways are 50 feet from the right-of--way line. These are being met by the submitted plan. Access to the site is a curb cut 70 feet north of the Bob Evans northernmost access. • The Dublin Landscape Code permits automobile dealerships to create auto display areas along surface streets. The allowable display area is 25 percent of the street frontage. The display area must have aone-foot high planting edge, and the remaining frontage must include the typical 3.5-foot screen. The 0.698-acre parcel has no frontage on Tuller Road. Athree-inch caliper tree per 30 feet is required along all frontage areas. Additionally, all vehicles are to be parked at grade. The proposal includes a display Dublin Planning and Zoning Commission Staff Report -July 1, 1999 Page 15 area to be located near the eastern edge of the site (along Sawmill Road). This area will have space for about five cars. Six-foot high, opaque screening is required along I- 270. An area 75 feet in length at the northeast corner of the site along I-270 is not screened. Staff recommends this screen be extended and taper down to the northeast corner of the site. • CDD applications were approved by the Planning Commission in 1990 and 1991 to permit outdoor automobile display (refer to Record of Action CDD90-007 and CDD91- 006) on the 3.9-acre site. A landscape inspection was completed for the existing dealership this winter, and a substantial amount of plant material was dead or missing. The applicant has met with staff on site, and the appropriate caliper trees have been installed. This installation was verified by a recent inspection. • One 42-square foot ground sign is included with the proposal. The sign consists of three-inch anodized bronze letters pin-mounted on a dry-laid limestone retaining wall. The existing triangular pylon sign oriented toward Sawmill Road is to be removed. Several sign variances have been granted for the site (V91-021, fora 51 square foot wall sign in combination with a ground sign; and V90-018, fora 12.8-foot monument sign with a 19.6 square foot logo). The proposed building will have no wall sign. There will be a total of three signs on the site (currently three) as proposed. This alteration requires additional variances from the Board of Zoning Appeals (BZA). • In the past, there have been a number of Code violations at the existing dealership. The most frequent were the parking of cars on landscaped areas and sale display practices that violated Code. To the best of staffs knowledge, these violations have been corrected. • A special permit for aground-mounted satellite dish (SP92-009) 5.8 feet in diameter and 6.8 feet in height, has also been granted for the site. • All new exterior lighting must conform to the Dublin Lighting Guidelines. • Public water and sanitary sewer are available from existing lines along Tuller Road, and are adequate to handle this development. No open cuts of Tuller Road pavement are permitted. Stormwater calculations have been submitted for review. They must be adequate to handle the proposal. The applicant should meet with Engineering staff prior to submittal of a building permit application. STAFF RECOMMENDATION: Rezoning Application 99-0612 Staff believes the expansion of the dealership is appropriate and fits the land-use character of the area. Staff recommends approval of this rezoning application. Bases: 1) The application establishes zoning for ODOT-acquired land. 2) The requested zoning is consistent with the adjacent, established district. Rezoning Application 99-061Z/Corridor Development District 99-057CDD -Infiniti - 3890 Tuller Road Chad Gibson presented this combined rezoning and Corridor Development District application fora 0.698-acre expansion of a 3.9-acre auto dealership. The 0.698 acres was recently acquired from ODOT, and this request is to establish the CC, Community Commercial District to match the rest of the dealership. He showed several slides. Mr. Gibson said the public land auction took place last week, and the applicant purchased the 0.698-acre tract from ODOT at that auction. The existing building is brick and stucco with a clear glass and aluminum storefront. The building is 1,000 square feet and will match the existing dealership. It is a satellite sales Planning and Zoning Commission Minutes -July 1, 1999 Page 14 office. Mr. Gibson said the applicant brought the site into landscape compliance. One new access is proposed east of the fire hydrant. He said Engineering usually requires 100 feet between curb cuts, but 85 feet was approved. Mr. Gibson said the six-foot fence screening from I-270 will stop about 75 feet from the east line so it will not block the ODOT catch basin. The current Sawmill/I-270 ramp will be moved to the north about 120 feet, and the exit onto Sawmill Road will be centered in between the east and west bound lanes of I-270. Mr. Gibson showed a slide of the existing wall sign approved by the BZA. If the sign package is altered, additional action by the BZA will be needed. One of the ground signs is to be replaced with a ground sign of 42 square feet. The proposed sign will be on top of a dry-laid stone wall at the site's east end. There were Code enforcement problems in the past with car display on the grass. The applicant was asked to show all vehicular display areas. It was agreed that used cars can not be parked on the center island, and it is shown in the site plan. Mr. Gibson showed a detail of the display area for five cars. He said all the spaces can be seen from Sawmill Road. The top of the I-270 exit ramp is about ten feet higher than this site, and visibility is good for about 75 feet along the northeast property line. Mr. Lecklider asked how this will be policed. Mr. Gibson said there could be a firm condition that only new vehicles be placed in the prominent locations. Mr. Eastep has concerns about visibility and display. He said Code compliance on weekends is not good with several dealerships. Mr. Gibson said the Code Enforcement Officer works two weekends per month. This site has been a problem in the past, but recently there have not been any violation reports. ~R Mr. Gibson said staff is recommending approval of the rezoning application because it establishes appropriate zoning on the newly-acquired parcel. Mr. Gibson said BZA approved a specific sign package, and changes will require re-examination by the Board. He said the three-sided pylon sign' was almost 13 feet tall with a 20 square foot logo and lettering underneath of less than five square feet. Mr. McCash said elevations show an unscreened rooftop mechanical. Mr. Gibson said screening is a recommended condition. Mr. McCash asked if moving the unit to the center of the building had been discussed. Mr. Gibson said no. Mr. McCash asked if there would only be one ground sign facing Sawmill Road and I-270 on this parcel. Mr. Gibson said yes. Mr. Gibson said the two parcels will be combined into one site before the issuance of building permits. Mr. McCash noted the existing wall sign facing I-270 was part of the original BZA approved sign package. He asked if the 25 square feet on this pylon sign is now changing to 42 square feet of ground sign. Mr. Gibson said yes. Mr. Sprague said his comfort level has dropped regarding the cars in the circle display area. He thought it was too tight and inappropriate for a high visibility area. He was also concerned A about line of sight and visibility. He would like striping of all parking. Mark Kline, Kinzelman Kline, agreed with the above ten conditions. He said there was discussion about drainage at the ODOT auction. He said ODOT had concerns that the mound would impede the overland stormwater flow. All the catch basins are pumped underground and go to the lower part of I-270. Mr. Lecklider asked if ODOT ruled out the extension of the mounding. Mr. Kline said they recommended that it not be extended and will write a letter. Mr. Gibson said the mound could be moved farther to the south so as not to impede the flow. Mr. McCash said since the basin was no longer on ODOT property, it did not matter if the mound was extended. Mr. Kline said ODOT owned the point. Mr. McCash asked, in lieu of a mound, if evergreens could be used. Mr. Kline said that was an option. Planning and Zoning Commission Minutes -July 1, 1999 Page 16 Mr. Kline said if the catch basin overflowed, it would go towards I-270. He said they had to create stormwater detention for this project. He said evergreen trees would be better than mounding for screening. Mr. Kline said they are proposing additional landscape screening around the "knuckle" and on the front edge of the car display. They were looking for a compromise on how far the screening was needed. They have added stone walls to provide a sense of an entry feature as asked. The plantings have been intensified with perennials. Mr. Harian asked what was the -r~ height of the two stone walls. Mr. Kline said 42 inches tall because of the detention basin at the bottom. Mr. McCash said tall landscaping is necessary to screen the site. Mr. Harian said the Dublin Code required asix-foot mound along all highways. He suggested plantings could provide the same affect. Mr. Sprague said car displays could be made very attractive. He liked the sign. Mr. Peplow asked if continuing the treatment would distract from the stone wall and entry feature proposed. Mr. Gibson thought the six-foot mound could be extended 15 feet. He suggested the six-foot hedge could be tapered down in height to two or three feet and it should be worked out between Mary Newcomb and the applicant. Mr. Kline said the farther the wall was moved, the closer it would be to the stormwater detention basin. He said their design for the wall was not exactly like the existing entry features. It used the same type of stone, height, and type of cap, but the plants now reinforce the walls as they turn back into the mound and end at the planting bed. He was concerned about the spacing of trees if the radius was extended. If a six-foot height was needed, shrubs should be used. He agreed to work with staff. „ Mr. Eastep said this was a gateway area, and an unscreened auto display was inappropriate. An unfortunate precedent was being set. The drainage issue should be worked out with ODOT so that the landscaping is increased to screen the display cars. He did not think Mr. Gibson's solution would solve the problem. He said the whole corner needs to be landscaped like other gateways with the mounding continued, and not held back at the wall to highlight the car display. Mr. Harian agreed. Mr. Kline said a___y wall height will seem reduced due to an optical illusion. Mr. Eastep said this site seemed perfect for car display. With some design creativity, it could become more of a gateway and less of a car display area. Mr. Kline said they are taking advantage of the existing topo to present the cars at that point, but the actual conditions made it logical. Mr. Harian said a wall sign on the new building should be eliminated. He also said screening was needed and if the mound did not work, it could be done with vegetation. He suggested rewording Condition 2 so that it does not necessarily refer to a mound. Planning and Zoning Commission Minutes -July 1, 1999 Page 17 Mr. McCash said additional screening and landscaping revisions are needed along I-270. He agreed that wall signs should be prohibited. From an architectural standpoint, he thought the building was unattractive and he could not support this application. Mr. Sprague said the plan, after tweaking, was good. Many of the Commission's concerns were addressed. This site presents a unique opportunity and challenge. He was satisfied with the line of sight questions. He wanted the applicant to work with staff on landscaping. This site has not been maintained well for several years, and this offers a chance to make a x~ significant improvement. He supports the rezoning. Mr. Peplow also supported this rezoning. He asked how much "additional screening" was needed the cars are screened I-270. Mr. McCash was concerned that because of the different elevations, the view will always be down into the entire parking area. He understood the 25 percent display area. Whatever screening is proposed, it is not enough. Taller evergreen trees are necessary along the I-270 side to screen it. Perhaps it could be open at the "knuckle" on the Sawmill Road side. Mr. Eastep thought there was an open 45-60 foot area in front of the detention area. If left unscreened, it would set a negative precedent. Without creative landscaping there, he cannot support this rezoning. It has not been resolved since the concept plan. Mr. Lecklider said he did not support this during the informal hearing. He said the detention area should be screened. He does not like the raised car display. Staff previously thought elevated display was inconsistent with the Landscape Code. There is an enforcement problem with cars displayed in the more prominent areas. The Community Plan describes this area as a gateway entry, and an auto dealership is inappropriate as a gateway. He also said there should be no wall sign on the new building. Mr. Kline said the mound and evergreen shrubs are six feet tall. Dublin's Code for freeways ` requires deciduous trees. They are following the letter of the Code. The parking area at the knuckle is not elevated. Mr. Kline said they could do a nice job of landscaping in a soft curvilinear pattern, while still achieving all screening requirements. Mr. McCash said the building architecture needed more work. From the landscaping standpoint on I-270, he thought a six to eight foot evergreen screen was needed. Dan Schmidt, owner, said they were recently informed of the need to rezone the land. They have combined the two lots. He guaranteed that they would highlight only three or four new cars on the knuckle. Mr. McCash noted his negative comments were regarding the drawings submitted in the Commission packet. Mr. Schmidt said they will incorporate the existing brick, stucco, and glass elements on the new building. Mr. Lecklider said the car display in the most prominent area was aCommission-wide concern. He was concerned about some successor dealership's display intentions. Planning and Zoning Commission Minutes -July 1, 1999 Page 18 Mr. Schmidt said they will use their best efforts to get ODOT involved to solve this. Mr. Sprague asked for a more definitive parking plan for Commission review. Mr. Schmidt agreed. Mr. McCash said four eight-foot evergreens added between the rockspray cotoneasters along I- 270, might screen sufficiently. Mr. Schmidt agreed to this. Mr. Eastep said that was still inadequate. He said the previous informal hearings were long and should have shortened this hearing, but the applicant has not satisfied the expressed desires. He thought it was time for a vote, and he wanted to see this area stay a gateway as the Community Plan indicated. To make this project acceptable, Mr. Eastep said the ODOT catch basin should be relocated. Then, this applicant can create a nice gateway for that quadrant. If ODOT will not agree, there is still 60 feet from the building to Sawmill Road off of the detention area for a gateway with a stone wall, perennials, and evergreens. Mr. Eastep made a motion to approve the rezoning portion of this application because it establishes zoning for ODOT-acquired land, and is consistent with the adjacent, established district. Mr. Harian seconded the motion, and the vote was as follows: Mr. Peplow, yes; Mr. Sprague, yes; Mr. Lecklider, yes; Mr., McCash, yes; Mr. Harian, yes; and Mr. Eastep, yes. (Rezoning approved 6-0.) He said the 1.2-acre expansion site is zoned CC, Community Commercial District, and the two parcels are to be combined. Building materials of the existing dealership are brick and stucco. Cross sections now show elevations and the position of the single-point urban interchange (SPIJI) under construction. Mr. Gibson said a 1,000 square foot building was proposed using building materials to match the existing dealership. Mr. Gibson said staff recommends extending the six-foot mound along I-270 to the comer of the site about 70 feet. Since the last submittal, the mound was extended an additiona1400 feet. The site has a ground sign, a wall sign oriented towards I-270, and a pylon sign. A variance was received for the sign package. This proposal removes the pylon sign. A 22 square foot sign with bronze two-foot letters on a limestone retaining wall is proposed at the eastern edge of the site. The existing ramp is about' 80 feet from the proposed pavement. The proposed SPIJI is about 200 feet away and a few feet higher. The site will be slightly depressed from that viewpoint. Mr. Eastep thought this should have been filed as a formal review instead of a second informal review. He said the policy of permitting a second informal review needed to be reconsidered. Mr. Eastep asked if the existing Code violations have been abated on the site. Mary Newcomb met with the applicant on the site and discussed what landscaping was needed to comply. A copy of their landscape order has been submitted, and the site will be replanted as soon as possible. Mr. Gibson said a special permit application for the satellite dish had been received. The applicant plans to paint the dish to blend with the building. Mr. lastep asked about the amount of frontage display area. Mr. Gibson said the frontage along Tuller Road is 900 feet, and 225 feet of display (25 percent) is permitted. He said I-270 is all ' limited access frontage, and asix-foot screen of some sort is required. A four-foot mound with two feet of landscaping is proposed. The thumb's projection is oriented towards Sawmill Road. Technically, 25 percent of that frontage is permitted, but it is questionable that it be considered frontage. Mr. I.ecklider noted that the staff report said there would be three signs on the site. This would alter the original sign package, and additional variances from the BZA will be needed. Mr. Gibson agreed. He said if the BZA denies them, the additional sign cannot be installed. Mr. Gibson said the plan is to remove the existing pylon sign. Mr. Lecklider said the number of signs was not being increased; the pylon sign was being eliminated. A 100-foot separation requires them to relocate the fire hydrant. Mr. Kline said a grade change was made to the ground sign. The height of the wall was lowered. Externally illuminated letters are now on the face of the wall. Perennials and ornamental grasses will be used with the limestone wall. The sign has been deleted from the building. Mr. Kline said if BZA does not approve the pylon sign relocation, it could remain where it is. Mr. Kline said the northern car display for utility-type vehicles was. astone-like flat pavement which will add texture and highlight the area. Mr. Kline said the elevations remain the same after the SPUI is completed. He said the six-foot mound along the limited access right-of-way will be effective. Extension of the landscaping is troublesome because their window of opportunity is at the tip of the parcel. Continuing the landscape screen would block the extensive landscaping proposed. He will submit a sample of the limestone with the CDD application. Mr. Peplow asked if the Infiniti sign on the wall required a guardrail. Mr. Kline said they checked Code and regraded it, which allowed them to lower the wall so that the height from the top meets the Building Code. Mr. Kline said the wall was 30 inches at the grade. Mr. McCash said BOCA Code has a limit of 15 inches; Mr. Eastep said the OBBC Code should be used. He said the proposal has improved since the last review. He said fall protection is measured from the average grade. He asked that Code be followed regarding the height of the wall guardrail. Mr. Eastep suggested that the display car be backed up slightly, creating another planting area between the car and the wall that reduces the hazard because.it is no longer.a walldng surfice Mr. Kline said that could be done. w Mr. Fishman said this was a wonderfiil effort. He supported extending the six-foot mound. Mr. Kline said if a six-foot mounding was required by Code along all limited access rights-of--way, it should have been extended to the first entrance drive in Dublin Village Center. Mr. Fishman guessed it was a mistake. He said they were trying to make Dublin better, instead of making it worse by repeating mistakes. He said there should be plenty of visibility from I-270, etc. Mr. Kline disagreed. Extending the mound would disrupt the drainage inlets below the exit ramps. Randy Bowman said the interchange at Sawmill Road was slated to be completed next year. Mr. Kline said they would like to begin this project in May or June. Mr. Fishman asked if the applicant would maintain all that grass area, even though it is owned by ODOT. Mr. Kline agreed to mow and maintain. Mr. McCash said the entire parking lot would be viewed from I-270. Mr. Kline said that was how grades existed now. They need to meet the grades of Bob Evans. Mr. McCash suggested that the 12-inch plantings be higher to minimize the view of the entire parking lot. Mr. Kline said it will not been seen because of the required six-foot mound. Mr. McCash asked about the size of trees along the I-270 ramp. Mr. Kline said three-inch caliper deciduous trees, 30 feet on center, per Code were planned. Mr. Lecklider said part of the year the screening effect would be lost. Mr. Kline said the screening was from the mounding. Mr. Lecklider asked if there was athree-foot artificial change of elevation at the eastern point. Mr. Kline said yes. Mr. Fishman preferred making the textured pavement display area a landscaped area of grass, to break up the asphalt. He said there is a vista of cars and asphalt from I-270. Mr. Kline said they would not object turning the majority of the island into a greenspace if it can still be used for auto display. Mr. Fishman did not think a car should be parked on the island. Mr. Schmidt said the island could be grassed. Mr. Fishman wanted a landscaped island instead of a display; the asphalt should not be seen. Mr. Schmidt said they could do that. Mr. Fishman said he wanted to see as much green and landscaping aspossible -and tall as possible. , Mary Newcomb pointed out that there was an interior landscaping requirement, and 5 percent of the paved surface will have to be landscaped. She did not think it was shown on the plan presented. Mr. Fishman wanted the island landscaped, in addition to the five percent. Mr. Lecklider wanted more landscaping than just the island. He asked why the "thumb" display should be permitted, particularly here, where the grade is being artificially altered. He was concerned about the MAG "finger" display of cars and did not want that repeated. He was concerned about a precedent. Mr. Lecklider said he understood why the applicant preferred not to extend dle landscaping mound to the east. Infiniti has exposure that no other dealership has with its wall sign on dic I-270. Mr. Lecklider's preference, however, was to see the six-foot mound and landscaping extended. Mr. Fishman agreed. He was also concerned about drainage with die mound extended. If flit mound cannot be extended, the site needs to be improved. If it was lower with screening, more of the cars would be seen. He was concerned with the amount of asphalt exposed. He suggested staggering river birch trees along I-270 to break it up visually. If the mound is broken to resolve the drainage, it defeats the purpose of the mound. He said the elevations at Sawmill and I-270 cannot be fixed. He believed the MAG dealership was not constructed as it was presented and approved. The impact of the asphalt needs to be minimized. He suggested using one tree every 20 feet instead of 30 feet to help break up the asphalt from the roadway. Mr. Sprague thought the plan looked good. He supported the landscaped island. He thought some of the concerns were out of proportion. He said the site will be less visible after the SPIJI is built. Compared to all the other dealerships in Dublin, this may be the best landscaped. He said it will only be seen when driving on Sawmill Road for a few seconds. Signage.is a BZA issue. He was in favor of this plan after a little tweaking. Mr. Peplow agreed and said he appreciated the applicant's effort to address the previous concerns He said with the additional landscaped island, he could support this plan. Mr. Eastep said he would like to see a dry laid stone wall along the property line with annual or perennial beds in front. It will make it more of a gateway. Immediately to the west is the Hampton Inn Hotel. -The parcel is zoned CC, Community Commercial, as is all of the abutting property; and this development is subject to the provisions of the Corridor Review Text adopted for Dublin Village Center. -The applicant wishes to construct a 25,000 square foot building, part of which is two stories high. -The application was scheduled to be heard during June, but the applicant asked that it be deferred until this meeting. Mr. Willis stated that the engineering issues have been addressed in the site plan. The only modification requested is the date of the Dublin Specifications which should read "1985" rather than "1986." Mr. Bill Adams, representing the applicant, stated they would to present information about the circulation, the landscaping treatment, and the ' architectural design of the building. Mr. Adams stated that the same materials will be used on this structure that have been used throughout the development; specifically the G1enGery '1-HB' brick, the supra-slate material on the canopy, and basically the•same sort of column details. Mr. Adams presented a rendering on the car dealership to the Commission. Mr. Buck Withers, architect representing the applicant, explained the details of the architecture and layout of the building. The service area will be located on the west end of the building against the property line which is shared with Hampton Inn. The showroom will be located on the east end of the building fronting Sawmill/I-270 and the entrance from Taller Road. The building will have a shared access with Hampton Inn and a new access point further east at the main entrance of the building. Mr. withers detailed the layout and uses of the building, and presented a materials palette for the structure. Mr. Jezerinac asked about the possibility of changing the elevation to move the overhead door. Mr. Withers explained the sequence of uses and the necessity of the service drive-thru at this location. Mr. Jezerinac suggested making an alcove and screening for the door location. The vehicles must be displayed at grade, and there must be a planting of 3 inch deciduous trees spaced thirty feet on center. The site has approxirnately 2,000 feet of frontage on both I 270 and Tiller Road. The permitted display area for the site is 527 feet. There is a more stringent siz-foot requirement along freeways. The applicant is permitted an additional 175 feet, and this proposed display area would add approximately 100 . ~ feet. Staff would like to see the proposed drive moved farther to.the north,.away.from the Bob Evans curb cut and also believes that.a five-foot sidewalk-:should.be.installed-:along:fiiller Road. Staff can support a proposal for auto display which is consistent with the landscape code and the permitted 25 percent. Staff believes that elevated display is not consistent with the intent of the landscape code and that the display area should include the one-foot height, vegetative plantings and trees spaced every thirty feet. Any deviation from this will require approval by the BZA. Mr. Ferrara asked if the exit ramp off I-270 would need additional land to make a cloverleaf in the future. Ms. Clarke said that Dublin Vllage Center had asked several years ago the State of Ohio for permission to place a wall on that right~f--way. A vacation of that right-of--way, or the right to occupy it, was requested and declined by the State of Ohio to reserve this property for any possible future construction. Mr. Peplow asked about the one-foot plantings. Ms. Newcomb said the one-foot plantings were designed to limit the car display area to behind the plantings and not on the grass area by the street. Ms. Chinnici-Zuercher asked if this display would be visible from Bob Evans Restaurant. Ms. Newcomb said yes. Mr. Rauh understood that Staff was not supportive of the elevated display. Mr. Sutphen felt a sidewalk from the existing entrance to the new drive was necessary. Mr. Peplow agreed. Mr. Zawaly agreed that the curb cut should be moved north. Mr. Kline said the other approved display is still going to be built unless they can get greater visibility from Sawmill Road. Mr. Zawaly did not like passive signage. He suggested that Infinity use the previously approved display area only, but he would not be opposed if the interchange area landscaping and maintenance was improved. Informal Review - 98-135I -Infiniti of Dublin Chad Gibson presented this informal request to expand the existing Infiniti dealership on Tuller Road. No vote is requested. A 717 square foot sales building and an auto display area are proposed. He showed several slides of the site. The site is zoned CC, Community Commercial and located in the Corridor Development District, and is subject to the Corridor Review Text. Theae is a pylon sign visible from I-270 and Sawmill Road which is to be removed. The ground sign received a variance for size. A wall sign is proposed on the new building. Another variance will be necessary for the wall/ground sign combination; the two lots may be combined. The site expansion results from the transfer of excess ODOT right-0f--way. Mr. Gibson said the additional parking along I-270 is.required to have asix-foot screen, and it does not comply as submitted. He said there have been Code Enforcement issues with the existing Infiniti dealership regarding signs and banners on weekends, an extra satellite dish, and parking in landscaped areas. The Code Enfonoement Officer has reported a lack ofcooperation, especially on weelends. He said the applicant has agreed.to correct these issues- Mr. Gibson said site expansion of 25 percent requires the full site to come into compliance with the Landscape Code. All service areas must be screened to full height. He said Code required a six-foot opaque screen along I-270. The site has missing and dying landscape materials. Mr. Gibson said the existing dealership is on 3.5 acres, and the existing pylon sign is on another. Zhe proposed addition is on another parcel. Ms. Clarke said the original two parcels should have been combined earlier. Absent the combination, the pylon sign is illegal. Mr. Fishman asked if the landscaping screening was in violation of the Landscape Code. Mr. Gibson said yes. Regarding the satellite dish, Ms. Clarke said dishes Less than three feet in diameter were exempt from the BZA Special Permit process. The exemption does not include dishes up to six feet across. Currently, it is subject to administrative review and requires a building permit. Mark Kline, R:inzelman and Kline, for Infiniti, said the dead landscaping had been removed. He said the dish, landscaping, transformer screening and trash enclosure will be brought into Code compliance. He did not understand how the overhead doors could be tastefully screened, but he will work with staff on this. He said visibility is a key to the economic success of this site. The owner desires more parking, sales area, and visibility to Sawmill Road. He wants to make the residual ODOT parcel more visually pleasant. He said a 3.5-foot screen is proposed along the pavement area, with only one small area having a 12-inch screen for "display." Mr. Kline said the drive aisle location was chosen due to an existing curb drop. If the driveway is required to be 100 feet from the Bob Evans' cut, a fire hydrant must be relocated. He said the plans being shown have a 1,000 square foot building, not 717 square feet. Mr. Sprague asked at what elevation the cats would be displayed.' Mr. Kline did not have that information yet. Mr. Sprague thought it odd that used cars would be displayed in the most prominent spot. Dan Schmidt, the applicant, said only new cars would be displayed there and agreed to such a condition. On the "thumb"display area, Mr. Schmidt said the sign will be internally illuminated. He said the parking lot lighting will match the existing, and display lighting had not been decided. Mr. Schmidt said the approximate height of the display area stone wall would be 3 inches om the lower base, and the lettering is 24 inches. Four signs are proposed. Mr. Kline expected the site would be brought into compliance in the .spring. Mr. Eastep aslaed about building a landscaped gateway feature. Mr. Kline said ODOT preferred that the landscaping did not extend beyond the proposal, but it might be considered along Sawmill Road. Mr. Eastep asked if the paver design could be integrated into the approach, even if it is on the right~f--way at the entryway. Mr. Kline said there may be an economical constraint. Mr. McC~ash asked if there were intentions to combine the parcels into one. Mr. Kline said they wanted to keep them as two separate parcels. Mr. Mc~ash said the proposal has three Infiniti signs seen along I-270 and three signs along Tiller Road. Mr: Kline said one would be directional saying "pre-owned cars". Mr. McCash said the complete signage package is needed. He did not want channel set letters with a plastic sign face on the platform sign. Mr. Kline said they would probably be an extruded chase that would sit on top of the wall like a cap. If the three-foot requires a guardrail, perhaps the letters could be incorporated as part of the rail. They may drop the height so the rail is not necessary and the letters will be placed on top of it. Mr. McCash wants the sign to be externally illuminated. Mr. McCa`ch referred to the mounding at the MAG site. He said cars were being parked on the back side, of it, and this may not reflect what was approved. It does not properly screen all the cars. He recalled that only a couple of cars at the top of the fingers were to be seen. He liked the ground-mounted lights. He was concerned about the 3.5-foot mound. Mr. McCash noticed the perimeter trees stopped, and he thought Code required them to do so. Ms. Newcomb agreed. It was stated that four or five additional trees are needed. A study of all the nuances of the Code have not been made by staff, however, the proposal along I-270 will require variances. Mr. Kline asked if both screening along the property line and shrubs along the display area were needed. Ms. Newcomb thought mounding at the property line would meet Code. There was a discussion of mound height and measuring. Ms. Newcomb said the grades need to be considered. Mr. McCash said the mounding will be reviewed in conjunction with the stormwater issues. . Mr. Lecklider asloed about screening the existing overhead doors. Mr. Kline said a ~ six-foot mound was on the rear. He said taller shrubs would cover the overhead doors. They cannot mound higher. Upright arborvitaes may work for screening. He was willing to meet with Ms. Newcomb to see how screening can be achieved. Ms. Newcomb said screening on existing dealership sites is not easy. Ms. Clarke said in regards to the screening, the Code says where there are two conflicting requirements along an area, the stricter would apply, which would be the six-foot high mound. Mr. Fishman said Dublin expects more than the Code minimums. This expansion will have to be nice. It is at a focal point, at Sawmill Road and I-270. Mr. Kline understood, but was concerned about costs. Mr. Lecklider aslaed Mr. Kline for his preference in handling the six-foot screening requirement, if necessary. Mr. Kline said grading, and he will look at the site plan to see what works best. Ms. Clarke said tonight's objective was to present a concept design and to get Commission feedback. Staff is aware that both the signage and landscaping may require variances. Mr. Fishman said he cannot vote for it if the parcels are not. combined. He is worried about, the future use of the parcels. He .was encouraged by .this applicant offering to.:clean up the corner which was all in weeds. Mr. Sprague agreed. Mr. Fishman wanted more than the .minimum standards to be met. The original parcel must be brought up to Code immediately. He thought the plan showed a lot of asphalt. He did not agree that the exposure of this site was bad. Mr. Sprague thought one of the signs should be eliminated. The vegetation and topography are unknown at this time. There is a Dublin gateway at SR 161 and Sawmill Road and a similar landscape sign might capture identification for Dublin on both sites. Mr. Peplow reiterated that he was not happy with the MAG "finger" display. He too, would like to see zoning compliance before any building permits are issued. He had a problem with not knowing the elevations of the "thumb".
