An Ordinance Amending The Annual Appropriations Ordinance For The
Fiscal Year Ending December 31, 1999 (Right-of--Way Acquisition for
Emerald Parkway -Shier Rings Road To Innovation Drive)

WHEREAS, Section 5705.40 of the Ohio Revised Code allows for supplemental
appropriations to be made to the annual appropriations ordinance provided
sufficient resources are available; and
WHEREAS, Ordinance No. 55-99 authorized the City Manager to execute an
agreement with American Electric Power (AEP) for the relocation of their electric
facilities located on Shier Rings Road and the acquisition of right-of--way and
easements necessary for the construction of Emerald Parkway from Shier Rings
Road to Innovation Drive; and
WHEREAS, it is necessary to amend the annual appropriations ordinance to
provide the authorized funding to acquire the necessary right-of--way and
easements for the project.
NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of
Dublin, State of Ohio, of the elected members concurring that:
Section 1. There be appropriated from the unappropriated balance in the Capital
Improvements Tax Fund the amount of $510,000 to account 401-0314-780-2550
for the acquisition of the right-of--way and easements for the extension of Emerald
Parkway from Shier Rings Road to Innovation Drive.
Section 2. The public hearing be waived to provide immediate funding for the
real estate closing.
Section 3. This Ordinance shall take effect and be in force in accordance with
Section 4.04(a) of the Dublin City Charter.

Re: Ordinance 112-99, An Ordinance Amending The Annual Appropriations
Initiated by: Marsha I. Grigsby, Director of Finance M~-
Ordinance No. 112-99 provides the necessary funding authorization to acquire the right-of--way and
easements needed from American Electric Power (AEP) for the extension of Emerald Parkway from
Shier Rings Road to Innovation Drive. As stated in the Ordinance, a previous ordinance was adopted
authorizing the City Manager to execute an agreement with AEP for the necessary acquisitions and
relocation of their electric facilities located on Shier Rings Road.
The funds for this project have been programmed in the City's Capital Improvements Program; however,
they have not been appropriated. This additional appropriation request along with those included in the
annual appropriations ordinance for projects that have been deferred unti12000 (i.e. Emerald Parkway-
Sawmill Road to Hard Road), will provide sufficient funding authorization to carry out the terms of the
agreement with AEP.
