NOW, TREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring: Section 1. That the following described real estate (see attached map marked Exhibit "A") situated in the City of Dublin, State of Ohio, is hereby rezoned PCD, PlannedCommmerce District, and shall be subject to regulations and procedures contained in Ordinance No. 21- 70 (Chapter 153 of the Codified Ordinances) the City of Dublin Zoning Code and amendments thereto. Section 2. That application, Exhibit "B", including the list of contiguous and affected property owners, and the recommendations of the Planning and Zoning Commission, Exhibit "C", are all incorporated into and made an official part of this Ordinance and said real estate shall be developed and used in accordance therewith. This site, as more fully described in Exhibit A, is located in Shamrock Industrial Park, 6365 Shier-Rings Road, Dublin, Ohio_ The property is currently owned by Applicant, Tara Group, Ltd. (Exhibit B), and is zoned as a Restricted Industrial District pursuant to Dublin Codified Ordinance ("DCO") §153.031 _ The maps and diagrams attached as Exhibit C show the location of the existing structure which currently houses Performance Warehouse, Inc., both owned Films, Inc. and a business known as Bike, by Applicant. A Site Plan is attached hereto as Exhibit D. Drawings of the existing structure are attached as Exhibit E. Due to the common ownership and existing use of the property by Applicant and its employees, Applicant proposes to continue to use this site for warehousing distribution and associated office use as permitted by DCO §153.031 and in addition, seeks to use a limited portion of the property for a small amount of retail sales and other office use. REQUEST: Review and approval under the provisions of Section 153.058 of a revised composite plan and development text to allow a 4,000 square foot expansion to an existing 12,000 square foot building. The site is 2.1 acres located on the southwest corner of Shier-Rings Road and Scherer Place, approximately 350 feet east of Avery Road. STAFF CONTACT: Chad Gibson, Planner. BACKGROUND: The site was rezoned from RI, Restricted Industrial District to PCD, Planned Commerce District in 1997 to permit limited industrial, retail, and general office uses. The proposed building expansion cannot meet the standards adopted in the rezoning (composite plan). The proposal is to revise the existing text to reduce the minimum required side yard from 50 feet to 25 feet. This application was filed a number of months ago. However, it could not be processed due to the rezoning moratorium imposed on the Southwest Area. On October 18, 1999, Dublin Ciry Council granted a waiver to this site from the current moratorium. The Planning and Zoning Commission is to make its recommendation on the proposed text revision (composite plan) and then forward this application to City Council. It will be scheduled for a public hearing and vote by City Council. Atwo-thirds vote of Council will be required to override a negative recommendation from the Commission, and otherwise the outcome will be determined by a simple majority vote. If approved, the rezoning will take effect in 30 days. The Planning Commission also has discretion over the development plan, which is expected on a subsequent agenda. CONSIDERATIONS: Site Characteristics: • The site is a 2.1-acre, rectangular lot located on the south side of Shier-Rings Road, in the Shamrock Industrial Park. The site is developed with a 12,000 square foot metal and concrete block building. This building currently houses Performance Films, Inc. and Bike Warehouse, Inc. The subject site is Lot 9 of the Shamrock Industrial Park and is zoned PCD, Planned Commerce District. Performance Films, a window tinting business, occupies one half of the 12,000-square-foot building. The site is landscaped and has one driveway from Shier-Rings Road and a second from Scherer Place that provides access to the loading areas behind the building. Scherer Place is a cul-de-sac that runs along the eastern boundary of the site and serves established businesses to the south. An eight-foot, paved bikepath is developed along the south side of Shier-Rings Road, which fronts the site. • The existing building is rectangular (120' x 100'), industrial in design, and is finished with brown metal panels, EIFS, and split-face concrete block.
