AN ORDINANCE TO APPROPRIATE A FEE SIMPLE INTEREST CONSISTING OF 0.219 ACRES, MORE OR LESS, AND A UTILITY EASEMENT CONSISTING OF 0.091 ACRES, MORE OR LESS, FROM DONN W. GRIFFITH, IN PROPERTY LOCATED ON THE SOUTH SIDE OF W. DUBLIN-GRANVILLE ROAD, IN ...... TOWNSHIP OF PERRY, COUNTY OF FRANKLIN, STATE OF OHIO. WHEREAS, the City of Dublin is preparing to complete the Marcy Lane access drive and improve - related traffic circulation; and WHEREAS, said improvement will require the City of Dublin to obtain a fee simple interest and utility easement in and to the premises described in the attached Exhibits "A" and "B" located in the City of Dublin, Franklin County, Ohio. WHEREAS, it is necessary to amend the annual appropriations ordinance to provide funding for this acquisition. N&W, THEREFORE, BE IT ORDAINED by the Council, of the City of Dublin, State of Ohio, of the elected members concurring that: Section 1. A fee simple interest and utility easement in and to the premises located in the City of Dublin, Franklin County, State of Ohio, and more fully described in the legal descriptions attached hereto as Exhibits "A" and "B" is hereby appropriated for the public purpose of completing the Marcy Lane access drive, pursuant to Ohio Revised Code Chapter 163 and the Constitution of the State of Ohio. Section 2. Council hereby fixes the value of the interests appropriated at Thirty Six Thousand Two Hundred Sixty Three Dollars and 00/100 Cents ($36,263.00) which sum shall be deposited with the Franklin County Common Pleas Court for the use and benefit of the owner of the property ,......~ appropriated as his interest may appear. Upon such deposit, the City of Dublin shall take possession of and enter upon the property pursuant to law. ........... Section 3. Council finds that the appropriation is necessary for the stated purpose, that the City has been unable to agree with the owner of the property as to appropriate compensation, and that the City intends to obtain immediate possession of the property. Section 4. The City Law Director is directed to file a petition for appropriation in the Franklin County Common Pleas Court, to have a jury impaneled to assess the compensation to be paid for the real estate herein described above. Section 5. There be appropriated from the Capital Improvements Tax Fund Thirty Six Thousand Two Hundred Sixty Three Dollars and 00/100 Cents ($36,263.00) to account 4010314- 780-2550 for the purpose of paying all costs incident to such acquisition. Section 6. This ordinance is hereby declared to be an emergency necessary for the immediate preservation of the public health, safety and welfare. The reason for such necessity is that the prompt completion of the Marcy Lane access drive is necessary to improvement traffic circulation and relieve traffic congestion for the citizens of Dublin. Date: September 20, 1999 Re: Ordinance #104-99 (Amended) Revising the Schedule of Fees and Service Charges For City of Dublin Services to be Effective on January 1, 2000 Initiated By: Marsha Grigsby, Director of Finance Melody Kennedy, Financial Analyst Please find attached Ordinance #104-99, the annual update to the Ordinance which amends Chapter 35 of the Codified Ordinance and revises the City's schedule of fees and service charges for City of Dublin services. The Ordinance has now been amended to reflect the changes approved by City Council during its September 7, 1999 meeting, as well as recommendations made by the Finance Committee during its September 13, 1999 meeting. Detailed recap worksheets with results from that meeting are attached for review. Following is a summary of changes made to the Ordinance pursuant to the Finance Committee's review: S-012 Seasonal Business Review (pe 4) ,,~ The renewal fee be increased from $40 to $50. S-154 Fence Permit (pe 5) The residential permit be increased to $40 and the commercial permit be increased to $100. S-167 Tree Removal Permit (pe 5) This permit was established pursuant to the approval of Ordinance #95-96 in October 1998. The Finance Committee recommended there be no fee associated with obtaining this permit. S-043 Buildin2: Inspection - Residential (pe 5) Separate remodels and basement finishes, and recommend a flat fee of $50. S-146 Adult Diversion (p~ 7) The fee for this program be decreased to $160. S-105 Park Reservation Service (p~ 7) The fee for shelter rental for City residents or Dublin businesses be decreased to $15/day, and increased for non-residents to $50/day. The Coffman Park Pavilion fees be decreased for City residents or Dublin businesses to $40/half day and $75/fuIl day. The Finance Committee recommended a $25 refundable deposit for shelter rentals, and a $100 refundable deposit for the rental of the Pavilion. ,. ~~~~'-._.',- . Members of City Council September 20, 1999 S-160 CRC Rental Rates (pe 8) The Finance Committee requested language to be added for fee waivers for youth organizations and .... schools, both public and private, serving the Dublin community. The Committee also recommended a $10 increase for non-residents renting the gymnasium or classrooms to attempt to improve ~I"" availability of these areas for City residents and give them a better rental rate. In the process of amending this Ordinance to incorporate these rental fee changes, we felt the remaining rental rates that were established in Ordinance #65-96, should also be included in Ordinance #104-99. Aside from the increase in non-residents fees for the gymnasium rental and classroom rentals. none of the fees have been changed. (See Appendix A-I of the Ordinance.) We have included a copy of Ordinance #65-96 for reference. S-143 Block Party Permit (pg 8) The Finance Committee directed Staff to complete an analysis of the cost of providing the new "block party package" to recognized Dublin Civic Associations and recommend a "nominal" fee for its use when requested a second time during a calendar year period (the first use being "free of charge" for the Civic Associations.) Staff has completed that analysis and it is attached to the back of the recap worksheet for the City Manager's Office. Staff has recommended a 45% recovery of costs, or a fee of$150.
