AN ORDINANCE ESTABLISHING SECTION 150.160 AND
AMENDING SECTION 153.076 OF THE DUBLIN CODIFIED
ORDINANCES PROVIDING FOR RESTRICTIONS ON
,- CONSTRUCTION NOISE AND SETTING TIME PARAMETERS
WITHIN WHICH CONSTRUCTION OPERATIONS ARE
.... PERMITTED.
WHEREAS, periodic amendments to the Codified Ordinances of the City of Dublin
are necessary to accommodate the needs and desires ofthe community and to protect
the health, safety and welfare of the residents; and
WHEREAS, excessively loud sound disrupts the peaceful environment of the City
and disturbs its residents from the peaceful enjoyment oftheir homes.
NOW, THERE~ORE, BE IT ORDAINED by the Council oflbe City of Dublin,
State of Ohio, of the elected members concurring:
SECTION 1. That the following be adopted establishing section 150.160 and
amending Section 153.076 of the Dublin Codified Ordinances:

LIMITATION UPON CONSTRUCTION NOISE

~ A. Construction operations may only occur between the hours of 7 :00 a.m. and
...... 9:00 p.m. All equipment must be operated in accordance with the
manufacturer's specifications and with all standard manufacturer's mufflers
and/or noise-reducing equipment in use and in proper operating order.
B. Upon written request by the applicant, the City Manager, or the City
Manager's designee, shall have the authority to extend the hours under which
construction may occur, if the City Manager or hislher designee determines
such an extension to be reasonable.
C. Whoever violates this section is guilty of failing to contain construction
noise, a minor misdemeanor. Each day such offense is committed or
continued shall constitute a separate offense and shall be punishable as such.
Citations shall be issued to a person, firm, or corporation and/or individual
present at the time of the alleged offense.
SECTION 2. That this ordinance shall take effect and be in force from and after the
earliest date allowed by law.
