WHEREAS, the City of Dublin (Dublin) has been working with the Village of Shawnee Hills (Shawnee Hills) and the City of Columbus (Columbus) to allow - Shawnee Hills to have access to the Columbus sewerage system through Dublin's collection system; and WHEREAS, the Shawnee Hills residents will be required to pay the Dublin and Columbus capacity charge fees to "tap-in" to the system; and WHEREAS, Shawnee Hills has requested Dublin to consider a reduction in the Dublin capacity charge fee for current residents because of financial need; and WHEREAS, Dublin City Council directed the Administration to develop a financial assistance program for current Shawnee Hills residents based on their ability to pay; and WHEREAS, the Administration has developed a program offering financial assistance to property owners based on income levels and property values. NOW, THEREFORE~ IT ORDAINED by the Council of the City of I Dublin, State of Ohio, of the elected members concurring that: Section 1. The Dublin fees charged for Shawnee Hills residents to connect to the ...... sewerage system will be the capacity charge fee in effect at the time a sewer permit is requested. .... Section 2. Financial assistance will be available to residents living in Shawnee Hills as of June 7, 1999 based on documented need, as determined by income levels and property values. Section 3. Eligibility for financial assistance will be determined using the Income I Guidelines for Franklin County Housing Programs in effect at the time the sewer permit is requested. The financial assistance available will be as follows: - 80% level- capacity charge fee may be paid over a period ofthree years. - 65% level- capacity charge fee may be paid over a period of five years. - 60% level - capacity charge fee will be discounted by 10% and the discounted fee may be paid over a period of five years. - 50% level - capacity charge fee will be discounted by 30% and the discounted fee may be paid over a period of five years. ..... - Under 50% level - capacity charge fee will be discounted by 50% and the discounted fee may be paid over a period of five years. ...... Section 4. Eligibility for financial assistance will also be limited to owner occupied property with a total market value of the property, as determined by the Delaware County Auditor, ofless than $75,000. Section 5. Fees paid over time will be assessed on the property owner's real estate tax bills through the Delaware County Auditor's office. Payment of any outstanding balance must be made in full if the property is sold. In addition to ",.,. paying any unpaid assessment, any discount received must be remitted to the City. - Section 7. The City Council of Shawnee Hills may appeal a denial of eligibility, if the denial is based on the total market value of the property exceeding $75,000. The appeal shall be made to the City Manager and shall be limited to property owners at or below the 60% level of the Income Guidelines for Franklin County Housing Programs. The appeal will be reviewed by a committee that will be established by Administrative Order. Section 8. Grigsby, Director of Finance ~ As you will recall, at the June 7, 1999 Council meeting, City Council directed the Administration to work with representatives from Shawnee Hills to design a program providing for some type of financial assistance to current Shawnee Hills residents with regard to the capacity charge fee residents will be required to pay when they "tap-in" to our system. The Administration's proposed program is attached for your review. Representatives from Shawnee Hills, including Council Member Jack Frambes, have reviewed the proposed program. The only concern expressed has been the possibility of a few residents not being eligible because ofthe value oftheir property, but needing assistance because oflow income - levels. Grigsby, Director of Finance ~ From: - Date: July 12, 1999 Re: Capacity Charges for Shawnee Hills As you are aware, the Village of Shawnee Hills is requesting relief from the City of Dublin for sewer capacity charges that the residents of Shawnee Hills will be charged when they tap-in to our system. At the June 7, 1999 City Council meeting, Shawnee Hills Council Member Jack Frambes requested that Dublin City Council consider authorizing a reduction in the capacity charge fee for current residents of Shawnee Hills because of their income levels. He further requested that some type of payment plan be developed in hardship cases. After discussion, City Council, by motion, directed staff to develop a program allowing the residents of Shawnee Hills to pay the City's capacity charge fee over a period of time. A second motion was adopted giving further direction to develop the program based on the ability to pay and further defining that the program is to apply to current residents only. I have talked with Rob Shoaf, an engineer with URS Greiner who is the Project Manager for the Shawnee Hills sanitary sewer project, to determine ifhe has been involved with similar projects and any guidelines he might be aware of in developing a fee reduction program and/or payment plan, or if he had information on any federal programs that offer assistance based on need. We discussed the issue of income levels and how they could be used to determine hardship cases. He forwarded HUD's Section - 8 Income Limits for Delaware County. The income levels are based on family size and identify what is considered to be low-to-moderate income. The schedule is attached. .h....d I also talked with several people from MORPC to learn what criteria they use in administering Franklin County's various Community Development Block Grant (CDBG) programs, specifically housing programs. They use income levels to determine eligibility for participation in the CDBG programs, but they have a lot of flexibility in providing assistance once eligibility is determined. One ofthe programs they offer is assistance for sanitary sewer "tap-ins". Eligibility is typically the 80% level of the Income Guidelines for Franklin County Housing Programs. The 80% level is the same as HUD's Section 8 Income Limits. Delaware County is included in the Columbus Metropolitan Statistical Area and therefore their income guidelines would be the same as Franklin County. Those guidelines are attached. I contacted Delaware County to determine if they had any similar CDBG housing programs. They do not have similar programs because they are not considered an "urban county". Based on our visit to Shawnee Hills and the higher than expected quality of homes we found, I felt we should also obtain information on property values in Shawnee Hills as determined by the Delaware County Auditor. I also recommend the following restrictions and guidelines be included in the program: . Available only to the residents living in Shawnee Hills as of June 7, 1999. . Eligible only if the home is owner occupied. . Eligible if the total market value of the property per the Delaware County Auditor's tax duplicate is less than $75,000. . Income would be defined as total Medicare wages plus other income reported on the property owner's federal tax return. . Fees paid over time will be assessed on the property owner's real estate tax bills through the Delaware County Auditor's office. If the property is sold payment must be made in full. I feel this program needs to be limited and I am hopeful the above guidelines would identify those property owners who truly can not afford the full rate for the capacity charges.
