DUblin, State of Ohio, is hereby rezoned to PLR, Planned Low
Density Residential District and shall be subject to
regulations and procedures contained in Ordinance No. 21-70
(Chapter Eleven of the Codified Ordinances) the City of Dublin
Zoning Code and amendments thereto.

of contiguous and affected property owners, and the

"C", are all incorporated into and made an official part of

Two (2) copies of map accurately drawn to an appropriate scale (to fill a sheet of
not less than 8~ x 11 inches and not more than 16 x 20 inches). The map shall be

The applicant is dedicating Lots 32, 33, 34 and Reserve "C", of the Wyndham Village
subdivision to the east to the Dublin City School site. Those 3 lot areas are to be counted as
a portion of the park's requirement for the Gorden subdivision as a part of its 5.6:t acres of
park land. Additionally the applicant will provide a 60' right-of-way directly east of the
proposed westerly collector to Hyland-Croy Road. The right-of-way is to be used as
vehicular access to the ballpark areas located on the school site. The access is not to be a
direct access to the school itself, rather an access to the ball fields to be developed west of
the school building site. If the school is not developed

on its proposed site the access can be used as a direct vehicular access to that area. Further,
the ball fields planned on the school site will not be lighted for any night time activities.
Location: See attached preliminary site plan. The park location shown on the
preliminary site plan is schematic and maybe adjusted to accommodate final development.
C. The proposed provision of water, sanitary sewer and surface drainage facilities, including
engineering feasibility studies or other evidence of reasonableness:
Sanitary sewer and water shall be extended to the site from the current termini adjacent to ~.
the proposed development area. Surface drainage shall be handled in conjunction with a lake ~
in Red Trabue Park which will be constructed by the applicant with assistance from the City
of Dublin. The surface drainage shall comply with all applicable requirements.
D. The proposed traffic circulation patterns, including public and private streets, parking areas,
walks and other accessways, indicating their relationship to topography, existing streets or
showing other evidence of reasonableness:
See the attached preliminary site plan which show the developer's attempt to tie this proposal
into the development to the east and to areas west at Hyland Croy Road. The collector will
have a right-of-way of 50' and pavement width of 36' and the minor road and cul-de-sacs
will have a right-of-way of 50' and a pavement width of 28'. A stub street collector with a
right-of-way width of 60' and a pavement width of 36' shall be built for extension west
toward Hyland-Croy Road.
E. The proposed schedule of site development; construction of structures and associated
facilities, including sketches and other materials indicating design principles and concepts
to be followed in site development, construction, landscaping and other features. Such
schedule shall include the proposed use of reuse of existing features such as topography,
structures, streets and easements: ~
Upon completion of the zoning and obtaining of all plat approvals, utilities will be extended -J
to the site. Construction on Parcel A shall commence thereafter.
F. The relationship of the proposed development to existing and future land use in the
surrounding area, the street system, community facilities, services and other public
improvements.
The development is adjacent on the west side to Red Trabue Nature Preserve. In this 46.0i:
acre tract the road system is a continuation of the street pattern from the existing
development to the east. The elementary school site is located adjacent to the existing
middle school site on Tullymore Drive and will be accessed from Tullymore. A 20' wide
easement for a bike & walk way will be provided from the extension of Tullymore into the
western area of the elementary school site for pedestrian and bike access.

Franklin/Union County line, approximately 1,800 feet north of Post Road, from
R -1, Restricted Suburban Residential District and U -1, Agriculture/Residential ~

UPDATE:
This application has been amended since originally submitted with a reduction in the overall area
from 67 acres to 47 acres. The area between Post Road and the Tri-County Ditch, opposite the
proposed Dublin Place regional mall site, has been deleted from current consideration.
BACKGROUND:
This site is part of an overall +68-acre fann which straddles the Franklin/Union County line.
It is located within the recently negotiated Dublin sewer and water service area. The Franklin
County portion of the fann (47.602 acres) was annexed in the 1970s, and the City annexed the
remaining 20.22 acres within Union County on May 18, 1994. The land was annexed so that
the entire parcel would be located within one jurisdiction to simplify issues of development
control, permitting, service delivery, etc. This is consistent with the City's interim annexation
policy. (Refer to attached excerpt from the Interim Development Policy.)
The 1988 Community Plan provides no land use, traffic, or utility recommendations for land in
Union County. When the plan was adopted, the county line was the furthest boundary of the
sewer and water service area, and expansion beyond was not unexpected. Dublin has retained
an independent traffic consultant to assist Staff in preparing an adequate plan for the circulation ~
system in the area bounded by Avery, Brand, Hyland-Croy, and Post Roads.

This request is to rezone the property from the R-I, Restricted Suburban Residential and the
U-l, Agriculture/Residential District (Jerome Township zoning classification), to the PLR,
Planned Low Density Residential District. The required development plan of the PLR District
sets forth the general layout, lot size, access, park area, utility service, and development
standards. The Planning and Zoning Commission shall make its recommendation on the
rezoning requested and then return the application to City Council for public hearing. Council
will vote on the rezoning ordinance at the third reading. A two-thirds vote of Council is
required in order to override the recommendation of the Commission. A rezoning ordinance
becomes effective 30 days following passage. If approved, the proposal will be reviewed under
the preliminary and final platting procedures as well.
CONSIDERA nONS:
0 The site is approximately 46 acres, part of a larger 68-acre, single-owner parcel. The
larger parcel has about 580 feet of frontage on Post Road and is 4,350 feet in depth.

The site is flag-shaped and widens to 760 feet at the northernmost point. The site has
been divided into two parcels for rezoning purposes. The subject site is the northern 46
acres and located to the north of the Tri-County Ditch. The southern portion of the site
includes 21.642 acres fronting on Post Road.
0 To the east is the Wyndham Village subdivision zoned PLR (239 single-family lots and
a 28-acre middle school) and Lowell Trace subdivision zoned PUD, Planned Unit
Development District. The M.L. Red Trabue Nature Preserve (passive City park within
the Lowell Trace subdivision) is located to the east of the site within Lowell Trace, with
- vehicular access from Post Road to be constructed by summer of 1995. The Indian Run
Retirement Center is south of Lowell Trace with frontage on Post Road. West of the site
~I is additional farm land zoned U-1, within Jerome Township. To the south, across Post
Road, is undeveloped land zoned R, Rural District with a pending rezoning to PCD,
Planned Commerce District for a regional mall. North of the site is undeveloped land
zoned R-1, Restricted Suburban Residential District.
0 The Tri-County Ditch runs west to east at the southern property line of this site. There
are fence rows along the north, west, and east property lines of the site.
0 The density specified in the 1988 Community Plan for the area between Avery Road and
the Franklin/Union County line is 1.0 to 2.0 dwelling units per acre. This has been
calculated on a gross acreage basis. Beyond the county line, no projections have been
made regarding density. recommendations. It should be noted that for areas beyond the
county line, the density recommendation may be lower than for areas nearer the center
of the City.
0 The proposal includes 84 single-family lots, a lOA-acre elementary school site, and 5.6
acres of park land. This parcel has currently has no street frontage currently, but a
connection with future Wynwright Drive within Wyndham Village is expected this year.
This proposed school site abuts the west edge of the Wyndham Village middle school
site. The proposed density is 1.78 dwelling units per acre as computed including the
lOA-acre school site, or 2.29 units per acre without the school acreage.
0 The development standards include a minimum lot size of 80 feet by 130 feet with a
....' 10,000 square foot minimum lot size. Eight-foot minimum side yards are proposed with

an 18-foot total combined side yard. The rear yard proposed is 25 percent of the lot
depth, but not more than 50 feet. The front setback will vary from 30 feet to 50 feet.
A no-build zone of 20 feet is proposed along the proposed park area. All development
standards are consistent with the Wyndham Village subdivision. Additional no-build
zones should be included along lots which abut the existing tree rows. The text should
include tree preservation language for these tree rows.
0 The proposed connector and other minor roads will have a 50-foot right-of-way. The
stub collector street to the west will have a 6O-foot right-of-way.
0 The Dublin City School District is interested in purchasing lOA acres of land at the
northeast end of this site, abutting the middle school site. A 6O-foot stub street will
provide minor vehicular access on the west side new school site. The major entrance
will be along Tullymore Drive. The layout for the schools has not been determined.
0 The required parkland dedication for the site is 5.6 acres. The proposal includes 1.43
acres of park/open space located to the west of the Nature Preserve and east of the
single-family lots. A 3.27-acre tract of park/open space is proposed along the Tri-
County Ditch area, adjacent to the Nature Preserve. The remaining 0.9 acres will be

from the Wyndham Village subdivision. The text states that the applicant will dedicate
Lots #32-34 and Reserve tIC" of Wyndham Village, which are located on the west side
of Tullymore Drive. The wider frontage will facilitate the construction and circulation
of a two-school campus. Pedestrian access to the park is located at the southern terminus
of the cul-de-sac between two lots. The floodplain/floodway limits are needed to assess
the usability of the parcels.
0 A storm water detention basin is proposed within the park area, in combination with the
basin proposed for the Nature Preserve to the east.
0 The City strongly favors expansion of the Nature Preserve for passive natural open ~
space. The schools will benefit from the proximity to the Nature Preserve for use as
laboratory and outdoor educational facility . The Parks Director is working with a land '~,
planning consultant to determine the limit of acquisition to assure that the nature area
remains viable.
0 The telephone utility provider for this site is GTE and not Ameritech as is the case for
most of the balance of Dublin and Franklin County.
STAFF RECOM:MENDATION:
As a matter of general policy, the City has tried to encourage assembling parcels of property for
rezoning a proposed development due to the increased flexibility and potentially higher quality
of larger scale development plans. The plan as proposed, however, provides for future access
to the west and north. Staff recommends approval of the request subject to the following
conditions:

1) That all flood way , floodplain, and floodway plus 20 feet information be
indicated on plans, and lots redrawn if needed at the time of preliminary plat
submission in accordance with FEMA regulations;
2) That all park land be dedicated to the City by warranty deed with the recording
the final plat. Recording fees are to be paid by the developer; ~
3) That all pavement, rights-of-way, utilities, storm sewer management, cul-de-
sacs, vertical alignments and street geometries be designed to the satisfaction ,.,;
of the City Engineer;
4) That an accurate legal description be provided to the satisfaction of Staff,
before this application is reviewed by City Council; and
5) That the text be clarified with language regarding tree preservation including
snow fencing for tree protection during all phases of construction, and 20-foot
no-build zones be located along the rear of all lots which abut a tree row, to the
satisfaction of Staff.
Bases:
1) The density falls within the maximum density proposed by the 1988 Community
Plan.
2) The parkland being dedicated affords expansion of the A very Park woods and
conforms to longstanding park acquisition goals.
3) The plan as modified above will provide for preservation of the wooded
environment.

2. Rezoning Application Z94-00S - Gorden Property
Mr. Peplow made the motion to remove this application from the table; Ms. Chinnici-Zuercher
seconded. All voted in favor. (Removed from Table 7-0)
Lisa Fierce presented this case. The application had been tabled in September without
discussion. The subject site has been reduced from 67 to 47 acres. To the east of the site are
Lowell Trace subdivision, the Red Trabue Nature Preserve, and the Wyndham Village
subdivision. (The Tri-County ditch serves as the southern boundary line of the proposal.)
Ms. Fierce said the proposal is for 84 single-family lots and a lOA acre elementary school site
which would back up to a middle school site currently owned by the Dublin City Schools. It
includes 5.6 acres of parkland. The density proposed is 1. 78 du/ac which is consistent with the
overall area. The development standards within the subdivision are consistent with that of
Wyndham Village: 80-foot lots and minimum 10,000 square feet in lot area. A no-build zone
is being proposed along the lots which abut the parkland. Staff recommends that additional no-
build zones be indicated for lots containing significant tree rows, especially along the west and
north property lines. The street system connects from Wyndham Village. A stub street is
,,, shown to the west which will eventually provide a collector out to Hyland-Croy Road.
Additionally, a stub street is located to the north.
Ms. Fierce said the parkland requirement of 5.6 acres includes a 4.7 acre addition to the existing
nature preserve and a 0.9 addition to the school site (off-site) along Tullymore Drive. She said
public street access would be provided to the west end of the school site. A detention basin is
proposed for the site within the park area in combination with a basin proposed for the nature
preserve within the Lowell Trace subdivision.
Staff believes density, utilities, parkland, circulation, and overall development standards have
been resolved as a result of the close work with the developer during the past few months.
Staff recommends approval of this application with the following seven conditions:
1) That all flood way , floodplain, and floodway plus 20 feet information be indicated on

Mr. Ferrara asked about access in and out of the school property.
Ms. Fierce said the Wyndham Village zoning included a +27-acre middle school site. The
school layout options have not been completed. In terms of parkland, this proposal is to
dedicate a certain portion of the requirement in combination with the existing Red Trabue Nature
Preserve, and the remaining acreage would be provided as an addition to the school site's
frontage along Tullymore Drive. She said the western access point was to provide access to
potential recreational fields for either school or to additional single-family lots if a school is not
developed.
Mr. Ferrara asked if a condition should be made that if the schools need the parkland, it can be
used for the driveway between the schools. Mr. Hale said if anything other than school use was
proposed, it would have to be rezoned. Mr. Hale said the schools may use a portion of the
parkland for a circular drive and any non-school use will require rezoning.
Mr. Ferrara felt this use of parkland fell outside the "parkland" definition. Ms. Clarke said the .~
parkland ordinance was revised in 1986 to increase the amount to be dedicated. The language
in the Code mentions the Dublin City Schools. She read the final plat code section which ...."
mentions various school facilities including the school building and premises themselves. She
felt this language promoted adequate sites in appropriate locations where parks and schools could
commonly exist. Staff feels two schools will require the drive to be widened. Examples given
were Wyandot Elementary/Municipal Pool complex and Scottish Corners Elementary.
Mr. Hale agreed to the conditions.
Mr. Sutphen was concerned that the length of the cuI de sac (1,800 feet or longer) was beyond
that allowed. Randy Bowman said the length of the cuI de sac was measured from the last street
intersection to the center of the circular turnaround. He said the stub streets should be
constructed along with everything else. Mr. Hale agreed.

Mr. Sutphen appreciated the Interim Annexation Policy being provided because it clarified the
telephone service. He said it would be United Telephone and Union Rural Electric Company.
Mr. Hale disagreed. Mr. Sutphen said that City Council should require a unified level of frre
protection and emergency services for all Dublin residents. He was concerned that the policy
stated that "The Council would likely recommend upon annexation thereof that the City take
action to include the growth area within Washington Township." He did not like the word

Commission strongly urge Council to take the necessary steps to insure that those township
,- boundary limits proceed to be done. It is an issue beyond this applicant's contro1.
Mr. Sutphen said the City had always had a problem with county lines and utility lines and
future residents. He suggested that the property lines in the northern part of the parcel should
be modified to follow the county line. Mr. Hale agreed. Mr. Sutphen said that in the southern
section of the site the county line falls in the middle of the future houses. He felt the house
locations should be either moved in the front or the back of those five lots. Ms. Clarke said the
applicant and Staff had agreed that issue would be dealt with at the time of the preliminary plat.
Mr. Sutphen wanted it to be required that the property owners of those lots be informed of
which electric and telephone company they would have. Mr. Hale said they would be notified.
Mr. Sutphen wanted the park access to run down the county line rather than splitting a lot. Ms.
Clarke said Staff would like to examine this at the time of the preliminary plat. Park access
must correlate with the flood way information. Mr. Sutphen said approximately twelve houses
would be affected. Ms. Fierce said Condition #7 addressed the access issues.
Mr. Sutphen suggested Condition #8: That between the northern loop road and the bottom of
the cuI de sac the house placement needed to be clearly determined before the preliminary plat
stage. Mr. Hale agreed to Condition #8.

the county line.
Mr. Sutphen asked how the request to Council regarding the Interim Annexation Policy should
be addressed. Mr. Zawaly said it should be a separate motion.
Mr. Sutphen made a motion to recommend approval of this rezoning application because its
density meets that proposed by the 1988 Community Plan, the parkland dedication affords
expansion of the Avery Park woods and conforms to longstanding park acquisition goals, and
the plan will provide preservation of the wooded environment, with the following nine
conditions:
1) That all flood way , floodplain, and flood way plus 20 feet information be indicated on
plans, and lots redrawn if needed at the time of preliminary plat submission in
accordance with FEMA regulations;

2) That all park land be dedicated to the City by warranty deed with the recording of the
final plat. Recording fees are to be paid by the developer;
3) That all pavement, rights-of-way, utilities, storm water management, cul-de-sacs, vertical
alignments and street geometries be designed to the satisfaction of the City Engineer;
4) That an accurate legal description be provided to the satisfaction of Staff, before this
application is reviewed by City Council;
5) That the text be clarified with language regarding tree preservation including snow
fencing for tree protection during all phases of construction, and 20-foot no-build zones
be located along the rear of all lots which abut a tree row, to the satisfaction of Staff; .~
6) That the applicant submit reduced sized plans (11" x 17") to Staff before the submission i
to Council; -,
7) That pedestrian access/bikepath issues be resolved at the time of preliminary plat
submission;
8) That house placement on the southern half of the site be clearly determined prior to the
submission of the preliminary plat; and
9) That lot lines be reconfigured to follow the county line along the northern half of the
site.
Mr. Zawaly seconded the motion and the vote was as follows: Mr. Ferrara, yes; Mr. Peplow,
yes; Mr. Sutphen, yes; Ms. Chinnici-Zuercher, yes; Mr. Rauh, yes; Mr. Fishman, yes; and Mr.

Interim Annexation Policy
Mr. Sutphen made a motion that a letter to Council from the Commission be drafted by Staff
to urge Council to provide unified fire protection services for the Jerome Township area and that
the language in the Interim Annexation Plan be strengthened to replace "highly likely" with
"decisive action by Council." [page 3, Interim Annexation Policy]
Mr. Zawaly said things often got buried in minutes and Council appreciated this type of strong ~
communication.
Mr. Peplow seconded the motion and the vote was as follows: Mr. Ferrara, yes; Mr. Peplow,
yes; Mr. Sutphen, yes; Mr. Zawaly, abstain; Ms. Chinnici-Zuercher, yes; Mr. Rauh, yes; and
Mr. Fishman, yes. (Approved 6-0-1)

As the process of rezoning begins for the Gordon property (copy of notice enclosed)
which includes a ~OA ac:re future school site and 10.63 acres of parklaLJ, I am
reminded of the Dublin City ordinances which address land set aside for parks
and/or school sites. Since a large portion of school sites is developed into such
facilities as running tracks, baseball and softball fields, gymnasiums and soccer
fields, which are used by the public during off school hours, it would seem that the
donation of school sites would service a public purpose in addition to the obvious
one. Donation of this IDA school site by the developer in lieu of parkland would
save Dublin City Schools in excess of $400,000.
I would appreciate your thoughts in this matter and t1'1e inclusion of our request in
this rezoning process at the appropriate time.

This letter 18 to cor1finn our understanding of the sale of 1M 10.6 acre alte for an elementary school site
as a part of our purchase of the Gorden tract We have attached a reduced version of the preliminary
development plan for 8 portion of the Gorden Tract (Parcel A) which iI to be presented for approval at a
public heamg before Dublin City Council on NO\l8mber 21. 1994. This plan rellects the location and
configuration of the 10.5 acre site and the proposed substitution of three (3) tots in Parcel A of the Gorden
property for lots numbered 32, 33 and 34 In Wexford Estates Section 1 in order to widen the -window' of
tie overal site to Tullymore Drive.
We are wiUing to honor the proposal that Ben Hale provided by the attached letter dated May 19, 1994 for
$392,;22 ewn though the site now has been increased from 10.4 to 10.6 acres. In addition, we have
agreed to trade fuly developed existing lots in WBXfordEstales lor 'paper" lots on the Gorden property and
10 allow vehicular access to the 10.6 acre site even thou~ we lost a ~t 110m 01.1' previous plan. We will
need to deed restrict the proposed vehicularaeeess to the site to athletic fields only, with no direct acc&s$
to the proposed schools.
N part of (U' future rezoning effort for Parcel B. of the Gorden property, we will cooperate in maximizing
the conveY8flC8 of park land in a manner 10 make the most efficient use of the park space for both the City
of Dublin and Dublin City Schools, assuming no loss of density of use.

The purpose of this letter is to better integrate the efforts of Planning Commission and City
Council. Several issues have been raised regarding additional development westward to, and
now beyond, the Franklin County line.
At the October 6th Planning and Zoning Commission meeting, the rezoning application for the
Gorden property (Ord# 52-94) was reviewed. The site is the northern 45 acres of an overail68-
acre farm which straddles the Franklin/Union County line north of Post Road. Earlier this year
the City annexed the +20-acre Union County portion of the site so that the entire parcel would ~
be located within one jurisdiction. About 16 of the 20 acres recently annexed is part of the
subject rezoning request. .J
The Commission unanimously recommended approval of the rezoning application to PLR,
Planned Low Density Residential District for 84 single-family lots, a lOA-acre elementary
school site, and 5.6 acres of parkland. The county line bisects a large number of the proposed
lots. To avoid future service, taxation, or jurisdictional issues, conditions of approval of the
rezoning request included a requirement that the lots lines be reconfigured, and that the
placement of the houses be specified. It must be absolutely clear in which county each home
will be built, and split jurisdiction should be minimized. Please refer to the .attached Record of
Action for the case.
Along the same lines, the Commission expressed great concern about the provision of unified
fire protection services for the newly annexed Jerome Township area. The Commission passed
a motion, urging Council to strengthen the language within the Interim Annexation Policy from
