NOW, THEREFORE, BE IT ORDAIN~bY the Council of the City of
DUblin, state of Ohio, of the elected members
concurring:
section 1. That the following described real estate (see
attached map marked Exhibit "A") situated in the City of
Dublin, State of Ohio, is hereby rezoned to PLR, Planned Low
Density Residential District and shall be subject to
regulations and procedures contained in Ordinance No. 21-70
(Chapter Eleven of the Codified Ordinances) the City of Dublin
Zoning Code and amendments thereto.
Section 2. That application, Exhibit "B", including the list
of contiguous and affected property owners, and the
recommendations of the Planning and Zoning Commission, Exhibit
/'/l1li" "C", are all incorporated into and made an official part of

The planning and Zoning Commission took the following action in the application below at its
regularly scheduled meeting:
CASE 1: Rezoning Application Z94-002 - The Lakes at Dunmere
Location: 15.8 acres located at the southeast corner of Brand Road and
Muirfield Boulevard.
Existing Zoning: R-l, Restricted Suburban Residential District.
Request: PLR, Planned Low Density Residential District.
Proposed Use: Development of 68 condominium uIlits.
Applicant: Borror Corporation, c/o Robert A. Meyer, Jr., 5501 Frantz Road,
Dublin, OH 43017.
MOTION: To approve this rezoning application because the plan provides for a housing
variety in the area, it is well adapted for the existing neighborhood, that the
density is easily intermixed with a single-family area, and the development will
be asthetical1y pleasing from Muirfield Drive and Avery Road with the following
nine conditions:
1) That the design be altered to provide for a connection with Richens Drive and elimination
of the access to Brand Road, or as otherwise approved by the City Engineer;
2) That the access point onto Muirfield Drive be aligned with the entrance to Hawk's Nest
and provide for a left turn stacking lane and street lighting as approved by the City

3) That a final plat be provided for recording the dedicates and establishes street right-of-
..... way, utility easements, storm water, private street and utility maintenance responsibility;
4) That the plat provide for access restrictions along the public streets and proper dedication

REQUEST: Review by the Commission of a request to rezone 15.8 acres located at the
southeast corner of Brand Road and Muirfield Drive from R-1, Restricted
Suburban Residential District to PLR, Planned Low Density Residential District
for a condominium development of 68 units.
BACKGROUND:
The property has been zoned R-1, Restricted Suburban Residential District, since its annexation
in 1973. The site was included in the 1989 "Dunmere" Concept Plan. It included 263 total
acres of what is now Dublinshire 4, 5, 6, Hawk's Nest and Muirfield Drive. The Dunmere plan
did not proceed beyond the PUD Concept Plan stage. This 15.8 acres wraps around the
Washington Township fire station on Brand Road. Except for the proposed Hawk's Nest site
which is located immediately to the west of Muirfield Drive, this is the last sizeable parcel in
the area which still carries R-1 zoning.
The request to develop a condominium project on this site was reviewed informally on May 19,
1994. That proposal was for 76 units encircling an interior lake. The applicant has redesigned
the proposal by making the lake a "drive-by" feature along Muirfield Drive and by decreasing
the number of units through the elimination of two four-unit buildings. This proposal is to
rezone the property to the PLR, Planned Low Density Residential District. This district requires
r the submission of a plan, and the plan generally outlines the proposed land use, the density, the
provision of needed utilities, any road improvements proposed, the applicable setbacks both
internal to the site and at the periphery, building height, housing type and style, genera1layout,
points of access, circulation, buffering, and any other pertinent issues regarding the
development.
The Planning and Zoning Commission is to make its recommendation on the rezoning requested
and then return the application to City Council where a public hearing will be conducted (second
reading). Following that, City Council will vote on the ordinance. A two-thirds vote of Council
is required in order to override the recommendation of the Commission. If approved, the
'I proposal will be reviewed under the preliminary and final platting procedures.

Sutphen was concerned about Brand Road between :Earlington Parkway and Ron Geese's home.
Mr. Riat suggested that a bikepathlsidewalk easement be left so that a decision could be made
at a later date by the City, when the homes were constructed.
Mr. Kranstuber liked the idea of waiting.
Mr. Sutphen wanted Richens Drive to connect through for safety reasons. He would not support
-, the plan without it.
Mr. Randy Bowman said a curb cut on Muirfield Drive and a connection to Richens Drive this
close was not ideal but the best available. A street connection in Dublinshire Section 3 would
have been better if previously planned. Staff will not support two curb cuts onto Muirfield
Drive.
Mr. Riat asked for leeway as to how Richens Drive would connect. ..He said the buildings were
already closer than they desired. Mr. Riat said however, he would make it work.
Mr. Sutphen said the density was still too high. Mr. Fishman agreed.
Mr. Riat said it would be impossible to lower the density because of the cost of the site.
Mr. Fishman asked about the materials to be used. He wanted the development to retain the
character of Muirfield Village, with more brick and less vinyl. Mr. Kranstuber agreed.
Mr. Riat said the look they had was nicer than that of Muirfield Village, more up to date. He
had no problem coming back with a palette approval. Mr. Ferrara suggested this as a condition.
Mr. Kranstuber agreed with Mr. Fishman. He said this was an attractive project.
f!!/f""-- Michael Keets, of 6205 Brand Road, was opposed to the bikepath being continued and letting
it dead end at the fire station. Without a comprehensive plan continuing the bikepath all the
way, he felt it should not be constructed.
Mr. Sutphen made the motion to approve this rezoning application because the plan provides for
a mix of housing varieties in the area, has a density that is appropriate for the neighborhood in
which it is situated, and will provide for a very attractive exterior view,
with the following nine conditions:
1) That the design be altered to provide for a connection with Richens Drive and elimination
of the access to Brand Road, or as otherwise approved by the City Engineer;
2) That the access point onto Muirfield Drive be aligned with the entrance to Hawk's Nest
and provide for a left turn stacking lane' and street lighting as approved by the City
Engineer;
3) That a final plat be provided for recording that dedicates and establishes street right-of-

The property is located at the southeast corner of Brand and Muirfield Drive. The
site is 15.8 acres. The proposed plan contains 68 condominium units located
around a proposed lake. The overall density for the proposed project is 4.3 dwelling
units per acre. Each building contains 4 units with ranches on the ends and
townhouses in the middle. Each unit contains a two car attached garage. See site
plan (exhibit A) and elevations.

A 200' to 320' building set back is located off Brand Road, and a 110' building set
back is located along Muirfield Drive, containing i 3.92 acres. An entry feature
containing a lake will be located at the entry off Muirfield Drive. All open space
shall be owned and maintained by the Owners Association. Park/open space
required per section 1109.021 is 3.95 acres. Due to the small size of the site being
proposed, the park requirement will be met by the following:

The proposed street system will be private and contain a loop system with one
entrance point off Muirfield Drive. The entrance will be aligned with the proposed
single family development on the west site of Muirfield Drive (Hawk's Nest.) We
are requesting a median cut at that point which shall serve both developments.
There is an existing bike path that runs along the site's frontage on Muirfield Drive.

All units will have a two car attached garage with additional stacking space behind.

E. The orooosed schedule of site develooment. construction of structures and

If approved, the proposed project will begin construction the Fall of '94/Spring of
'" '95. Phase one is anticipated to contain 4-6 buildings or 16 - 24 units. The entire
project should develop over a 2-3 year time period.
See attached elevations and sketches for architectural character. Extensive
landscape will occur throughout the project. Special attention will be given to the
development of a landscape frontage treatment along Muirfield and Brand Roads.
This landscape treatment will be designed in concert with the residential
development on the west side of Muirfield to provide a unified treatment along
MuirfieJd and Brand Road.
The existing drainage ditch which bisects the site will be integrated into the internal
lake system.
F. The relationshio of the orooosed develooment to existina and future land use in the
surroundina area. the street svstem. communitv facilities. services and other oublic
imorovements.
This property if one of the last pieces to be platted along the new Muirfield corridor.
To the North across Brand is multi-family and cluster development associated with
Muirfield. To the East is an existing fire station and park ground. To the South is
Dublinshire section 3 existing platted single family @ 70' lot frontages. To the
West across Muirfield is vacant ground being proposed for the development of
single family lots (Hawk's Nest.) We believe the proposed development conforms
with the community plan.
G. Evidence that the aoolicant has sufficient control over the land to effectuate the
orooosed develooment olan. Evidence of control includes orooertv riahts and the
enaineerina feasibility data which may be necessary.
The applicant has received sufficient control and ownership of the proposed
property from Ohio Holding Company.

The Lakes at Dunmere i. a condominium project to be located on approximately 15.8 Fu 614,43U81a
acres at the southeast comer ofMuirDeld Drive a.11d Brand Road on land presently
owned by the Ohio Holding Company and the Holdins Corporation of Ohio.
Dublinahire Sections 3 and 7 border the site on the lOuth. The site is located within
the Dublin corporate limits and is well served by utilities.
Sanitary sewer service will be provided by the extension of a 24" through Dublinshire
Section 7 which emm this site approximately 400 feet east ofMuirlield Drive and
then parallels the south property line until the sewer crosses under Muirfie1d Drive.
This project, known !IS "Sazdtary Sewer Improvements tor Muirfle1d Drive and Bra:ld
Road, Phase I" is now in the bidding process and should be under construction in the
near future. The subject site is within the design tributary area of the sewer and the
sewer is more than deep enough to physically serve the site. AB lona u the local
sewers within the development are properly designed, there should be no problem
with sanitazy sewer semce.
Water service is available to the lite from 12" water Iia.. in Brand Road and Muirfield
Drive and from an 8" line to be installed alons Richens Drive in Dublinshire Section
7. If the internal wata'diltribution system is connected to at leut two of these three
lines, adequate 'water flow and prcssure will be available ror the proposed
condominium development.

into the storm sewer system installed in Dublinshirc Section Three, which wu

proper deaign conaid<<ationa with regard to size and capacity, the proposed drainage
system appears feuible.

will need to be considered in the design of the Lakes at Dublinshire project.

area ot'the proposed project. We would not expect any unusual difficulty in obtaining

'* 4. Informal Review - Rezoning Application Z94-002 - The Lakes at Dunmere
Bobbie Clarke presented this informal request for feedback. This is an application to rezone
15.8 acres located on the southeast corner of Brand Road and Muirfield Drive from R-l, to
PLR, Planned Low Density Residential District. The specific plan is for a condominium
development of 76 units. This is not a unique development, it has been done at Mill Run. The
, buildings are all four family, with the end units being one-story and two-story units at the center.
Each unit has a two-car garage attached.
"'..... Any plats need to be processed separately. The density for this project is 4.8 du/ac. The
density of the surrounding area range from 2.2 dulac to 3.28 dulac (Earlington Village including
Asherton Apartments). Dublin's policy has been to include multi-family projects within large
PUDs. While this is not a big PUD, it may provide properly integrated multi-family housing
within that area.
Mr. Sutphen said Earlington Village was different because it was undeveloped. This project is
already surrounded by single-family homes. Ms. Clarke said it was not part of the same zoning
plan, but the Asherton density is between 5 and 6 du/ac. It fits into a neighborhood with a
density of 2.2 du/ac. Mr. Sutphen believed this application for rezoning was spot zoning.
Mr. Fishman asked what the present zoning allowed. Ms. Clarke said it was R-l, allowing one
dwelling unit per acre. Mr. Fishman expected that lots would become larger closer to Muirfield
and this was across from it. Mr. Fishman said the aesthetics were in the center.
Ms. Clarke said the Staff believed the site plan needed much modification.
Bill Riat, Vice President, Borror Corporation, said no vote was requested at this time. He asked
if Staff believed the use to be proper for the site. Ms. Clarke said with the site plan modified,
yes. A single-family project would have difficultly with the setback along Muirfield Drive and
Brand Road and the interface with the Washington Township Fire Department.

Mr. Sutphen was concerned with the residents to the south because they purchased their homes
believing the property would be single-family.
Mr. Riat said they will meet with the residents. It will be marketed by Traditional Homes.
There will be a better look from Brand Road and Muirfield Drive than if it were single-family.
Jim Houk, of Bird and Houk, presented plan renderings. There are only nine buildable acres
due to a two-acre open drainage ditch running through the parcel. The fronts of the units will
face the corner of Muirfield and Brand Roads. Buffering will be addressed later. He said it will
have major landscaping treatment toward Brand Road and Muirfield Drive. Mr. Houk said it
was not a spot zoning; that Muirfield Greene was 5.24 du/ac; Glenbarr was 5.54 du/ac; Dublin
Village was 9.1 dulac; and Asherton Apartments was 6.2 dulac.
