NOW, THEREFORE, BE IT ORDAINED by the Council of the City of
Dublin, state of Ohio, 7 of the elected members
concurring:
section 1. That the following described real estate (see
attached map marked Exhibit "A") situated in the City of
Dublin, state of Ohio, is hereby rezoned to SO, Suburban
Office and Institutional District and shall be subject to
regulations and procedures contained in Ordinance No. 21-70
(Chapter Eleven of the Codified Ordinances) the city of Dublin
Zoning Code and amendments thereto.
section 2. That application, Exhibit "B", including the list
of contiguous and affected property owners, and the
recommendations of the Planning and Zoning Commission, Exhibit
"C", are all incorporated into and made an official part of
this Ordinance and made an official part of this Ordinance and
said real estate shall be developed and used in accordance

Two (2) copies of map accurately drawn to an appropriate scale (to fill a sheet of
not less than 8\ x 11 inches and not more than 16 x 20 inches). The map shall be
identified and submitted in addition to the General Description of Land. The map

This is down zoning from the present restricted industrial district
covering Dublin Commerce Park. The current uses in the park are light
manufacturing, wholesaling and research developing and testing laboratory.
The requested SO/I use will provide a suitable buffer to Heather Glen which
is immediately to the south of the land to be reclassified.

The Planning and Zoning Commission took the following action in the application below at its
regular meeting:
5. Rezoning Application Z93-021 - Dublin Commerce Park
Location: 3.679 acres located on the north side of Innovation Drive (formerly Enterprise Drive)
between Enterprise Court and Wilcox Road.
Existing Zoning: RI, Restricted Industrial District.
Request: SO, Suburban Office and Institutional District.
Proposed Use: Office uses.
Applicant: DCP Associates, Ine, clo Luis G. Weil, President, PO Box 370, Dublin, OR
43017.
:MOTION: To approve this rezoning application with the following three conditions:
1) That all site plans conform to Code with respect to landscaping, signage, lot coverage, and
parking;
2) That the individual developments conform to the Dublin Lighting Guidelines; and
3) That the applicant install an eight-foot bikepath on the south side of Innovation Drive,
between Heather Glen Boulevard and the west property line of Heather Glen, when deemed
necessary by Staff.
The applicant agreed to the above conditions.
VOTE: 6-0.
RESULT: This rezoning application was approved with conditions.

CASE S: RezoniDg Application Z93-021 - Dublin Commerce Park
APPLICANT: DCP Associates, Inc., c/o Luis G. Weil, President, P.O. Box 370, Dublin, OH
43017.
REQUEST: To rezone 3.679 acres located on the north side of Innovation Drive (formerly
known as Enterprise Drive) between Wilcox Road and Enterprise Court, fro;::
RI, Restricted Industrial District to SO, Suburban Office and Institutional
. . District.
BACKGROUND:
The 94-acre Dublin Commerce Park was annexed to Dublin in 1987 and zoned RI in 1988. The
Southwest Area Plan designates this ~ite as industrial, however, an office zoning is a compatible
and preferable transitional land use. Dublin Commerce Park has been developed with Hidaka,
USA, Perio Products, M&P Products, BBC&M Engineering, and Applied Innovation (currently
under construction).
The preliminary plat for Dublin Commerce Park was approved by the Planning Commission
April 6, 1989 and by City Council on May 1, 1989. The final plat for 53 acres located along
the northwest portion of the industrial park, including the subject site, was approved by the
Commission November 9, 1989 and by Council December 4, 1989.
After recommendation by the Planning and Zoning Commission, the application will be referred
back to City Council where it will be scheduled for a public hearing (second reading) and later
for a final vote (third reading). A two-thirds vote by City Council will be required to override
the recommendation made here. If approved, the developer will be able to construct office and
institutional uses with no further public review. This area has already been reviewed and
approved under the platting procedures.
CONSIDERATIONS:
0 The site is relatively flat with little vegetation. To the north are the future sites of
Electronic Commodity' Corporation and Top 0' the Table, Inc., which are wholesaling
and manufacturing businesses. East of the site, across Enterprise Court, is the BBC&M
engineering office and farther east is the Applied Innovation site under construction. To
the south, across Innovation Drive, is the Heather Glen subdivision. West of the site,
across Wilcox Road, is undeveloped property zoned RI District.
0 The permitted uses within the RI District include manufacturing, wholesaling, and
research, development and testing laboratories.
0 The proposal is to downzone a small portion of the Dublin Commerce Park for offi:e ?,nd
institutional uses. The permitted uses within the SO chapter of the Code include
administrative and business, and professional offices, institutions, and organizations and
associations. Conditional uses include drive-in facilities, personal services, educational
and research, food and lodging, and exceptional uses (Le. animal hospitals). Conditional
uses are subject to separate review by the Planning and Zoning Commission.

0 The development standards for the SO zoning classification include intensity of use (no
more than 50 percent of lot for main and accessory buildings, and no more than 80
percent of the total lot area in total gross floor area); side yard when adjacent to a
residential zoning district or planned development district (not less than one-fourth the
sum of the height of the structure and the length of the wall most nearly parallel to side
lot line, and not less than 50 feet); and rear yard when adjacent to a residential or
planned district (not less than one-fourth the sum of the height of the structure and the
length of the wall most nearly parallel to rear lot line, and not less than 50 feet).
0 Deed restrictions for the Dublin Commerce Park located north of Innovation Drive

include a parking setback 30 feet from right-of-way and a building setback 40 feet from .~
right -of-way.

0 Innovation Drive will be extended farther to the east and will intersect with the Coffman .)

Road extension within the eastern third of the Dublin Commerce Park.
0 Dublin City Council granted a waiver of the requirement to install. sidewalks along
Enterprise Court on April 15, 1991. The applicant made a cash contribution for the
construction of a bike path along the north side of Innovation Drive. This is now under
construction on the south side of Innovation Drive (location changed with extension of
road). The applicant's contribution also included 350 feet of sidewalk along the east side
of Wilcox Road north of Innovation Drive. There is small area without bikepath between
Heather Glen Boulevard and the west property line of Heather Glen. Staff believes it is
reasonable to ask to applicant to construct the remaining link.
0 Drainage detention has not been met for the entire Dublin Commerce Park and needs to
comply with MORPC guidelines. The developer should provide ditch enclosure along
the east side of Wilcox Road, as required by the City Engineer.
0 Sanitary sewers are available for this site. No further modifications are required at this
time.
STAFF RECOMMENDATION:
Staff believes office zoning is extremely appropriate for this site. It is reasonable, even
preferable, and Staff recommends approval of the request with the following conditions: .
Conditions: ~
1) That all site plans conform to Code with r~~pe\;t to landscaping, signage, lot ..J
coverage, and parking;
2) That the individual developments conform to the Dublin Lighting Guidelines; and
3) That ditch on the east side of Wilcox Road be improved for traffic safety, to the
satisfaction of the City Engineer.
Bases:
1) The proposal provides an appropriate transitional land use for the surround:i~g
area.
2) The proposal is in compliance with the Southwest Area Plan.

6. Rezoning Application Z88-005 - DBS on Wilcox Road
Ms. Clarke stated that staff is in support of this application if it is amended
to RI, Restricted Industrial classification. The cul-de-sac road that is proposed
through the site, and the east-west road to be extended from Wilcox Road to this
new road make sense and provide good access.

Lou Weil, representing the owners of the land and is the developer of the land,
stated that the reason for applying for ~he LI, Limited Industrial zoning on j
the east side of the proposed road is because of the land use adjacent to this
property, particularly Columbus & Southern Uhio Electric. He feels:that this
property should be able to have a like use with outside storage. -Mr . '''eil has
talked with staff and feels that if he goes ,ahead with RI zoning on :.the whole
piece and applies for a conditional use variance, staff will probably look, favor-
ably on it based on good outdoor storage. On this basis, applicant is willing
to amend the plan to e1iminate~ the LI zoning and convert plan to RI-zoning.
Mr. Willis stated that the Cosgray Sanitary Sewer is anticipated to extend through
this piece of property and hopes that Mr. Weil will work with administration on
a commitment to have a right-of-way perhaps by transferring it or contributing it.
Mr. Weil stated that they would be more than happy to do this.
Mr. Berlin made a motion to approve the rezoning with the condition that the
property is zoned RI and that the engineering report is complied with. The
motion was seconded and the vote was as follows: Mr. Jezerinac, yes; Ms. Rausch,
yes; Hr. Reiner, yes; :--lr. Grace, yes; Mr. Geese, yes; Mr. Berlin, yes; Mr. Amorose,

;' 5. Revised Final Plat - Dublin Commerce Park
Ms. Clarke presented an aerial slide of the site along with information
contained in the Staff Report dated November 9, 1989.
-The site contains 53 acres located on the south side of Shier-Rings Road and
wrapping around two residential properties on the east side of Wilcox Road.
The land is zoned RI, Restricted Industrial, and the developer is proposing to
subdivide the land for an industrial park.
-Due to the sale of a large parcel (Lot 1) on Shier-Rings Road to a single
company (Hidaka USA, Inc.), a:revision in the approved plats is required. The
applicant is proposing to eliminate Gateway Drive which was to run southward
from Shier-Rings Road as indicated on the approved Preliminary Plat.
Enterprise Drive will be constructed eastward from Wilcox Road and will
eventually make connection with the Coffman Road extension. As'this is a
staged project, the applicant has filed the Final Plat for the first 1,000
feet of roadway. The road will be extended to the west incompliance with the
revised Preliminary Plat, also being submitted here.
-Heather Glen is located on the south'side of Enterprise Drive, so.the.deed
restrictions previously discussed will apply to Lot 40f this plat.
-Staff recommended approval of the Revised Final Plat with seven conditioqs,
several of which have been complied with already. ~
Mr. Mack noted the absence of a unified approach to storm water detention, water
and sewer service, right-of-ways and possible Shier-Rings Road ditch enclosure.
He stated that each portion of this plat will need to address these items.
Mr. Luis Weil, property owner and applicant, stated his agreement to the
conditions listed in the Staff Report.
Mr. Campbell asked why this revision in the plat is necessary. Mr. Weil
explained that the original plan was to subdivide this parcel into smaller
parcels ranging from two to seven acres. With the sale of a 22-acre parcel to
Hidaka USA, Inc. on Shier-Rings Road, there was no way to.createthe
north/south road called Gateway Drive.
Mr. Campbell referred to Condition #7 regarding the regrading and piping of
the ditch and shoulder along Shier-Rings and Wilcox Roads. 'He,asked Mr. Weil
if he would be installing piping where the ditch is sufficient to do so, and
if the regrading-only approach will be ta~en in those areas too shallow for
piping. Mr. Weil agreed.
Mr. !morose questioned the possible future need for an additional lane on
Shier-Rings Road. Ms. Clarke stated that the Community Plan sets forth the
thoroughfare requirements, and it shows Shier-Rings Road with a 60-foot
right-of-way. Mr. Leffler asked if the proposed 60-foot right-of-way for
Enterprise Drive will be adequate to handle industrial-type truck traffic.
Mr. Willis felt that a 36-foot pavement would allow an adequate turning radius
in and out of driveways.
Mr. Leffler moved for approval of the Revised Final Plat for Dublin Commerce
Park with the following conditions:
1) Continued commitment to coordinate the alignment/configuration of Gateway
\. Drive to complement the Coffman Road Extension;
2) Submission of landscaping/moundin~ plans for the areas of Lots 2, 3 and 4

Ms. Clarke presented slid the site and surrounding area 'along with the
following information: 4
-This application i olves Lot #2 of Dublin Commerce Park. The 2.5 acre'site
is zonedRI, Res icted Industrial District, and is located on.the south side
of Shier-Rin Road approximately 320 feet east of Wilcox Road. A Conditional
Use Permi as approved for Hidaka USA, Inc. on the 22 acre site immediately
to the ast, and to the north across Shier-Rings Road is vacant land zoned .

dealership 'under cons.ideration for Perimet Center. ' Thesiteplan.submitted

plan including an elevation of t building. This revised plan does ~
accommodate the parking requ' d by Code. 'The applicant .is'proposing an ...J

landscaping.
-Staff supports a vorable recommendation by-the Commission to the Board of

Mr. ck stated that right-of-way, details of proposed service drives,
ea ements, storm water detention and utilities require approval by the
Engineering Staff prior to issuance of a building permit.
Mr. Lou Weil, the applicant, stated that the drawings which h to
Commission members at the meeting were revised to correc e issues raised by

-Mr. Weil presented a perspective elevation drawi of the building. The
building material will be grey split-face con te block with a blue metal
accent screen along two sides around the u er portion which hides the glass
windows behind it. The west elevation cludes a glass greenhouse entrance
and small lobby area.

5. Rezoning Application Z93-021 - Dublin Commerce Park
This case and slides were presented by Lisa Fierce. This property was zoned Restricted
Industrial in 1988, and to date, has been developed with several light industrial uses, the latest
being Applied Innovation. This is a down-zoning from the Restricted Industrial zoning to SO,
Suburban Office and Institutional District. Conditional uses require separate review by this
Commission and include drive-in facilities, personal services, educational and research uses,
food and lodging, and exceptional uses (animal hospitals). There are some deed restrictions that
are in place for the Dublin Commerce Park, and they still apply here. There is a 30- foot
parking setback from right-of-way, as well as a 40-foot building setback from right-of-way. In
1991, Council approved a sidewalk waiver for Dublin Commerce Park and the applicant made
a cash contribution for the construction of a bikepath along the north side of Innovation Drive.
Since the bikepath along Innovation Drive has been extended to the east, the bikepath was
relocated to the south side of the road. In addition, the applicant made a contribution to a
sidewalk improvement along the east side of Wilcox Road north of Innovation Drive. There is
a small section of the bikepath along the south side of Innovation Drive that was not installed.
Th~t section is between the Heather Glen Boulevard which starts at the entrance to the
subdivision and goes to the west property line of Heather Glen. Aside from those issues, Staff

recommends approval and believes this is a preferred zoning classification for this area,
providing 'transitional zoning in the area for the residential portion to the south of Innovation
Drive and transitioning into the industrial development to the north. Staff is recommending
approval of the request with the three conditions listed in the Staff report as follows:
1) That all site plans conform to Code with respect to landscaping, signage, lot coverage,
and parking;
2) That the individual developments within this area conform to the Dublin lighting
guidelines; and
3) That the ditch which is located along the east side of Wilcox Road be improved for .~
traffic safety to the satisfaction of the Engineer. 1. ~

Luis Weil, one of the owners of Dublin Commerce Park, stated they agree to all the conditions
as listed in the Staff report. He met with Mr. Kindra and they came to an agreement with
respect to the ditch. Mr. Kindra stated that condition #3 could be removed because the ditch
is already closed in front of this property.
Ms. Stillwell moved to approve thIS request with the following conditions:
1) That all site plans conform to Code with respect to landscaping, signage, lot coverage,
and parking;
2) That the individual developments within this area conform to the Dublin lighting
guidelines; and
3) That the remaining link of the bikepath between Heather Glen Boulevard and the west
property line of Heather Glen will be constructed at the appropriate time as agreed to by ,
Staff.
