AN ORDINANCE AUTHORIZING THE CITY
MANAGER TO ENTER INTO A COST-SHARING
AGREEMENT AND APPROPRIATING FUNDS

PROPOSED HARD ROAD EXTENSION
AND DECLARING AN EMERGENCY
WHEREAS, Sawmill Partners Investment Co., and Sawmill Partners Investment Co.
No. II (hereafter referred to as the "Developer") ha~ committed to build the extension
of Hard Road from Sawmill Road to Riverside Drive as part of Rezoning #Z89-009
approved by Dublin City Council in 1990; and,
WHEREAS, the Board of Education of the Dublin Local District (hereafter referred to
as "School Board") will be building a new high school along the north side of the
proposed Hard Road extension, which construction is planned to begin at the earliest
possible date; and,
WHEREAS, the City of Dublin has determined that it is desirable to have street lights
installed along the proposed Hard Road extension and a traffic signal installed at the
intersection of the high school's main entrance drive with Hard Road, and has further
determined that such improvements would be most economically and beneficially installed
as part of the initial construction of the Hard Road extension; and,
r- WHEREAS, the parties have agreed in concept to a cost-sharing arrangement for the
installation for the installation of these improvements; and,

WHEREAS, it is necessary to appropriate $100,000.00 from the Capital Improvement
Tax Fund to pay for the City's portion of the street light and traffic signal improvement;
and,
WHEREAS, the adoption of this ordinance is an emergency because delay in the
construction of the high school could create significant additional public costs to provide
additional temporary classroom facilities at the existing high school facility if
construction of the proposed new high school is delayed, and further that the construction
of the Hard Road extension has been identified as a major east/west connector needed
to provide relief to existing east/west roadways in this area;
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State
of Ohio, 0 of the elected members concurring:
Section I. That the City Manager is authorized to enter into a Cost-Sharing Agreement
with the Developer and the School Board for the installation of street lights and a traffic
signal along the proposed Hard Road extension.
f" Section 2. That there be appropriated, from the unappropriated balance in the Capital
" Improvement Tax Fund, the amount of $100,000. to Account #40-03-14-2551 for the
..... City's portion of the cost-sharing agreement.
Section 3. That this ordinance be, and hereby is, declared to be an emergency measure
necessary for the preservation of the public health, safety and welfare and, therefore, this
ordinance shall take effect and be in force immediately upon its passage.

SUBJECT: Cost-Sharing Agreement for Hard Road Street Lights and Traffic Signal
Tim, as you are aware, we have been working for some time with representatives of the school
district and the developers associated with the Schottenstein rezoning to address the issue of
street light and traffic signal installation on Hard Road. The original Schottenstein rezoning
document did not stipulate a requirement for street lights along Hard Road or a traffic signal to
be installed at the entrance to the new high school. Similarly, the City's current street standards
do not specify a requirement for the installation of street lights. After review of the proposed
construction drawings by the City Engineer, however, it was determined that it would be
extremely desirable to have street lights installed along Hard Road given the significant traffic
volumes projected for this roadway and the cost effectiveness of installing these improvements
as part of the initial roadway construction. In relation to the high school construction, MS
Consultants has performed an analysis of the main entrance to the high school on Hard Road and
has determined that, in fact, a traffic signal will be needed at this location. This signalized
intersection will also serve a small amount of single-family development which will be located
to the south side of Hard Road.
Because these requirements were established somewhat late in the development review process,
and because some level of general public benefit will be provided by these particular
improvements, the Administration has felt it appropriate that some type of reasonable cost-
sharing arrangement be worked out to encourage the installation of the street lights and traffic
signals at this time. Based upon these efforts, we are requesting that City Council authorize you
to enter into a Cost-Sharing Agreement which provides for a fair and reasonable cost-sharing
of these improvements. Basically, the agreement would provide as follows:

As you can see, the street lights and traffic signal will be installed with less than 50 percent of
the costs coming from the City of Dublin. We have the added benefit, of course, that as a
private installation which is not obligated to pay prevailing wage rates, there is a significant cost
savings associated with these projects. We believe this is an excellent opportunity for the City
to have these very important public improvements installed at a significant savings to the City
so that they will be available when the road is open to serve the public.
