AN ORDINANCE TO ACCEPT AN ANNEXATION OF 111.5
+/- ACRES IN WASHINGTON TOWNSHIP TO THE CITY
OF DUBLIN, OHIO
.- WHEREAS, said annexation has been approved by the Franklin County
Commissioners, and Council is of the opinion that said territory should
be annexed.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
state of Ohio, ~ of the elected members concurring:
Section 1. That the petition for the annexation of 11.5 +/- acres (See
attached legal description) to the City of Dublin, Ohio is hereby
accepted.
Section 2. That this Ordinance shall take effect and be in force from
and after the earliest period allowed by law.

IN WASHINGTON TOWNSHIP TO THE CITY OF DUBLIN
Situated in the State of Ohio, County of Franklin, and in the Township of
Washington. Being a part of Virginia Military Land No. 6748.
Beginning at the southeast corner of the Nanolab Inc. 8.664 acre tract of land
and being the northeast corner of the Allen S. Shepherd III, 32.67 acre tract
of land. Being the west right-of-way line of State Route 33 and the east
right-of-way line of Eiterman Road and the south line of the existing City of
Dublin Corp. line as established by Ordinance No. 85-87, official record
11892-HI0.
Thence southerly along the right-of-way lines of State Route 33 and Eiterman
Road and the Allen S. Shepherd III 32.67 acre tract of land a distance of
114'f to the southeast corner of the Shepherd's 32.67 acre tract of land and
the northeast corner of Frances H. Judson 19.67 acre tract of land.
Thence westerly along the south line of Shepherd's 32.67 acre tract of land
and the north line of the Judson's 19.67 acre tract of land a distance of

are presented the petition for annexation of certain adjacent territory
to the City of Dublin, Ohio, filed by Allen S. Shepherd, III, signed by

in the County Commissioners' Hearing Room, 3rd Floor of the
Franklin County Administration Building at 10:00 A.M. on July
3, 1991; and
Section 2. That the Zoning Director to the Board of County
Commissioners be and hereby is directed to notify the agent of
the petitioners of the time and place of said hearing.

REFERRED TO THE COUNTY ENGINEERS FOR CHECKING
HEARING: JULY 3, 1991

WHEREAS, the time and date have been set by the Franklin County
Commissioners for the annexation petition by Allen S. Shepherd, III; and
WHEREAS, the Ohio Revised Code in Section 709.031 stipulates that
the County Commissioners can ask the County Engineer for a report on the
accuracy of the map or plat; now, therefore, on motion of Commissioner
Teater, seconded by Commissioner DeMoss ,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN COUNTY,
OHIO:

RESOLUTION APPROVING THE PETITION
OF ALLEN S. SHEPHERD, III FOR
ANNEXATION OF 111.5I ACRES IN
WASHINGTON TOWNSHIP TO THE CITY
OF DUBLIN, OHIO - CASE #16-91
WHEREAS, the Commissioners of Franklin County, State of Ohio, proceeded
on the 3rd day of July, 1991 to hear the petition of Allen S. Shepherd,
III, filed May 3, 1991 , and having in open hearing heard all of the persons
desiring to be heard for or against the granting of the petition, and having
considered all the facts with reference thereto, being fully advised, and
WHEREAS, the Commissioners make the following findings, based upon
the exhibits and testimony presented at the hearing of this matter:
1. The Petition contains all of the matters required by Ohio
Revised Code Section 709.02 including, without limitation:
A. A full description and accurate map or plat of the
territory to be annexed; B. A statement of the total number
of owners of real estate in the territory to be annexed;
C. The name of the person to act as agent for the petitioner.
2. The territory sought to be annexed is adjacent and contiguous
to the City of Dublin, Ohio.
3. Notice of the petition and the hearing has been published
as required by law, and all notices of filing the petition
and the hearings thereon have been given and delivered
as required by law.
4. The persons whose names are subscribed on the petition
are owners of real estate in the territory sought to be
annexed, and as of the time the petition was filed, the
number of valid signatures on the petition constituted
a majority of the owners of real estate in the territory
proposed to be annexed.
5. The map or plat and the description of the territory
contained in the petition are accurate.
6. The City of Dub lin has complied with Division (B) of Ohio
Revised Code Section 709.031.
7. The territory sought to be annexed is not unreasonably
large.
8. The general good of the territory sought to be annexed
will be served if the annexation petition is granted and
the annexation is allowed.
Therefore, upon the motion of Commissioner Teater , seconded
by Commissioner DeMoss :
BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF FRANKLIN COUNTY, OHIO:
Section 1. That the prayer of the Petition be GRANTED, and
the territory sought to be annexed by the petition filed herein

I TO THE CITY OF DUBLIN. OHIO AS REQUIRED
il BY SECTION 709.031 OF THE OHIO REVISED
CODE AND DECLARING AN EMERGENCY.

IWHEREAS. a petition for the annexation of 111.5 acres from Washington Township
was duly filed by Robin Green, agent for the petitioner, Allen S. Shepherd
III; and
. WHEREAS. a public hearing will be required before the Franklin County
i Commissioners on July 3, 1991; and, ,
jlWHEREAs. Section 709.031 of the Ohio Revised Code requires that, prior to said
hearing, the Municipal Authority shall adopt a statement indicating what
services, if any, the Municipal Corporation will provide to the territory
proposed for annexation.

I NOW. THEREFORE. BE IT RESOLVED by the Council of the City of Dublin, State of
I Ohio, _____ of the elected members concurring that:
I Section 1. The City of Dublin will provide the following municipal services
I for the 111.5 acres in Washington To~ship, Franklin County upon the
I annexation of said area to the City of Dublin, Ohio:

i Police. The City provides Police and Communications service on a full
twenty-four hour basis and also has mutual aid agreements with other
municipali ties. The annexation area lies approximately one mile south of
Dublin's Police Division Headquarters. Dublin operates with a minimum of
three cruisers on duty. A response time of approximately five minutes, for an
emergency situation, should be expected in this area.
Fire. Fire protection is currently provided by well-staffed departments in
Washington an<;l Perry Townships in Franklin County, and Concord Township in
Delaware County. They too have mutual aid agreements with other
I municipalities. This annexation. would not change fire department
I jurisdictional boundaries and therefore response times for fire and emergency
medical services. will not be affected. The Washington Township Fire Station
I is approximately one mile from the annexation area and normal response times
should be approximately three minutes.

Sanitation. Residential refuse collection services are contracted by the City
and are currently provided at no additional charge.
Street Maintenance. The City has a Street Maintenance Department which
provides excellent service in the area of street and road maintenance. This
,.... department also provides curbside leaf pick-up at no additional charge.

Section 2. The City has SEWER and WATER service area contracts with the City
..,. of Columbus, and the subject property is within said service areas, and
Iconditioned on the ability of the City of Columbus to provide WATER, and to
provide sufficient SEWERAGE disposal capacity, the City will have the ability
to service the area.
II Sec tion 3. Due to the fact that a public hearing will be required and heard
before the Franklin County Commissioners on July 3, 1991; this Ordinance is
I hereby declared to be an emergency measure necessary for the preservation of
I the public peace, health and safety and therefore this Ordinance shall taker
I effect and be in force immediately upon its passage.

(4) Preparation of an affidavit stating the name of the agent, the
number of owners of real estate at the time of the filing of
petition and the number of owners signing the petition.
(5) Ensuring that the legislative body of the municipality to which
the annexation is proposed, by ordinance or resolution, adopts
a statement indicating what services, if any, the municipal
corporation will provide to the territory proposed for annexation,
upon annexation. (The resolution or ordinance should include
response times for fire, EMT and police units as well as information
concerning water and sewer hook-ups and other pertinent data).
(6) The Agent or Representative of the petitioners needs to be present
at the hearing to present the petition to the Board of County
Commissioners.
Proof of compliance with the above is required to be submitted to this
office no later than June 19, 1991.

Enclosed is a copy of the resolution adopted on May 14, 1991 , by the Board
of County Commissioners, setting the time and place of public hearing for
the annexation petition which you, as agent, filed with this office on
May 3, 1991.
Under the provisions of Section 709.03 and 709.031 of the Ohio Revised
Code, you, as agent, are responsible for the following:
(1) Notification of the date of filing of your petition with the Board
of County Commissioners to be delivered to the Clerk of the
municipality to which annexation is proposed and the clerk of
each township which is included in the annexation. (A map,
description and a copy of the petition should be presented to
each clerk).
(2) Publication of the substance of the petition once a week for four
consecutive weeks in a newspaper of general circulation in the
County. (The enclosed resolution will satisfy the statutory
requirements and should be used for the published notice).
(3) Service upon the municipal and township clerks of a copy of the
notice within seven (7) days after the Franklin County Commissioners
set the date for the pub lic hearing on the annexation petition,
