HomeMy WebLinkAbout98-91 Ordinance AMENDED ~ RECORD OF ORDINANCES Form No. 30043 ___fu ~ Ordinance NO....___~~:_:_.~~mJ~ended) Passed.m._ nnn" mmn'm_ un ow_ n19 AN ORDINANCE AMENDING ORDINANCE 23-91, YARD WASTE DIVERSION PROGRAM ~ WHEREAS, the City of Dublin recognizes the mandate of the , I state of Ohio to divert yard waste from landfills by December -. 1, 1993; and WHEREAS, the city of Dublin recognizes that available landfill space in the Franklin County Region is dwindling at an accelerated rate compared to original estimates; and WHEREAS, the City of Dublin recognizes the need to implement an educational process as soon as possible in order to achieve the future mandate of yard waste diversion; and WHEREAS, the Solid Waste Advisory Committee, appointed by City Council, has thoroughly researched the concept of yard waste di version and strongly recommends its timely implementation in order to comply effectively with said mandates; and WHEREAS, City Council adopted a yard waste diversion program per Ordinance 23-91, as recommended by Dublin's Solid Waste Advisory Committee; and WHEREAS, the Solid Waste Advisory Committee has subsequently determined that certain provisions of this legislation need to be changed: ~I NOW, THEREFORE, BE IT ORpAINED by the Council of the City of ~ Dublin, State of Ohio, ~of the elected members concurring that: Section 1. The following shall constitute the City's official approach to divert yard waste from its municipal waste stream, A. Implement the "Don't Bag It Campaign" in cooperation with the Franklin County Regional Solid Waste Management Authority. B. Implement educational efforts in regard to home composting of yard waste. C. Implement a Curbside Composting program to provide a means for yard waste to be collected at the curb side and disposed of in a manner that is environmentally sound and in a way other than landfilling. D. Implement Compost Authorization Aqreements. which will allow residents and commercial businesses to take yard waste to Franklin County Reqional Solid Waste Manaqement Authority's yard waste facilities. where yard waste will be properlY recycled and/or composted. rl E. Implement mandatory diversion of yard waste from the L,,! municipal waste stream effective March 1. 1992. The City of '. Dublin or its Contractor shall not be required to pick UP yard waste. if said yard waste placed at the curb is not part of the curbside compostinq proqram. curbside chipper service. and curbside leaf collection service. Provide a Curbside Chipper Service from mid-April throuqh , ; mid-November to assist Dublin residents with the removal of -- tree and shrub trimminqs. These yard resources are recycled into wood chips that are used bY the city in street landscapinq and city parks. When plentiful. these wood chips will be offered. free of charqe. to residents. Surplus chips may be composted at authorized compostinq facilities. G. Provide a Curbside Leaf Collection Service from mid-October throuqh mid-November to assist residents with leaf removal. Leaves collected are taken to a compostinq facility. Section 2. Definitions. The fOllowinq words and phrases when used in this Ordinance or any other ordinance of this City shall have the meaninqs respectivelY ascribed to them in this Section: A. "Compostinq" shall mean the bioloqical treatment process by which natural orqanisms and chemical chanqes decompose the orqanic fraction of yard wastes over time. B. "Compost" shall mean the materials produced by composting yard wastes. C. "Yard Wastes" shall mean qrass clippinqs. bush and shrub [..... cuttinqs. leaves. tree limbs. qarden qrowth residues. rocks of i one inch or less in size. and other natural materials collected resulted from the care of lawns. qardens. vines. bushes. shrubs and trees. D. "Compost Authorization Aqreement" shall mean an aqreement executed between the city of Dublin and residents and/or commercial businesses. authorizinq them to take yard waste to the Franklin County Reqional Solid Waste Manaqement Authority's yard waste facilities. E. "Municipal Solid Waste" shall mean unwanted residual solid or semi-solid material resultinq from residential. commercial or institutional operations. Section 3.
