WHEREAS, said annexation has been approved by the Franklin
County commissioners, and Council is of the opinion that
said territory should be annexed.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City
of Dublin, state of Ohio, 1] of the elected members
concurring:
section 1. That the petition for the annexation of
1.162+/- acres (See attached legal description) to the City
of Dublin, Ohio is hereby accepted.
Section 2. That this Ordinance shall take effect and be in
force from and after the earliest period allowed by law.

WHEREAS, the Board of County Commissioners of Franklin County, Ohio,
are presented the petition for annexation of certain adjacent territory
to the City of Dublin, Ohio, filed by Robert A. Fisher, signed by Robert
A. Fisher and appointing Robert A. Fisher as agent for the said territory
being described as follows:
Situate in the State of Ohio, County of Franklin, Washington Township,
and being all of Lot Number Eighteen (18) of DUBLIN ESTATES SUBDIVISION,
as said lot is numbered and delineated upon the recorded plat thereof,
of record in Plat Book 27, Page 49A, Recorder's Office, Franklin County,
Ohio, and known as 7660 Bellaire Avenue, Dublin, Ohio 43017, and being
more particularly described as follows:
Beginning at a point in the northeasterly corner of the said Lot Number
18 said point also being in the existing City of Dublin Corporation Line

Teater , seconded by Commissioner Der10ss ;
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN COUNTY,
OHIO:
Section 1. That a hearing upon said petition shall be held
in the County Commissioners' Hearing Room, 26th Floor of the
Franklin County Courthouse, 373 S. High Street at 10:00 A.M.
on August 7, 1991; and
Section 2. That the Zoning Director to the Board of County
Commissioners be and hereby is directed to notify the agent of
the petitioners of the time and place of said hearing.

Commissioners for the annexation petition by Robert A. Fisher; and
WHEREAS, the Ohio Revised Code in Section 709.031 stipulates that
the County Commissioners can ask the County Engineer for a report on the
accuracy of the map or plat; now, therefore, on motion of Commissioner

Dear Mr. Fisher:
Enclosed is a copy of the resolution adopted on May 21, 1991 , by the Board
of County Commissioners, setting the time and place of pub lic hearing for
the annexation petition which you, as agent, filed with this office on
May 10, 1991.
Under the provisions of Section 709.03 and 709.031 of the Ohio Revised
co~ you, as agent, are responsible for the following:
(1) Notification of the date of filing of your petition with the Board
of County Connnissioners to be delivered to the Clerk of the
municipality to which annexation is proposed and the clerk of
each township which is included in the annexation. (A map,
description and a copy of the petition should be presented to
each clerk).
\~2) Publication of the substance of the petition once a week for four
consecutive weeks in a newspaper of general circulation in the
County. (The enclosed resolution will satisfy the statutory
~ requirements and should be used for the published notice).
(3) Service upon the municipal and township clerks of a copy of the
notice within seven (7) days after the Franklin County Commissioners
set the date for the public hearing on the annexation petition,
is on or before May 28, 1991. (The enclosed resolution will satisfy
the statutory requirements and should be used to serve the clerks).

(4) Preparation of an affidavit stating the name of the agent, the
number of owners of real estate at the time of the filing of
petition and the number of owners signing the petition.
(5) Ensuring that the legislative body of the municipality to which
the annexation is proposed, by ordinance or resolution, adopts
a statement indicating what services, if any, the municipal
corporation will provide to the territory proposed for annexation,

THE AREA IN A PROPOSED ANNEXATION OF
1.162 ACRES FROM WASHINGTON TOWNSHIP,
FRANKLIN COUNTY TO THE CITY OF DUBLIN,
OHIO AS REQUIRED BY SECTION 709.031 OF
THE OHIO REVISED CODE
WHEREAS, a petition for the annexation of 1.162 acres from Washington Township
was duly filed by James V. Maniace on behalf of Robert A. Fisher, 7660 Bellaire
A venue, Dublin, Ohio; and
WHEREAS, a public hearing will be required before the Franklin County
Commissioners; and
WHEREAS, Section 709.031 of the Ohio Revised Code requires that, prior to said
hearing, the Municipal Authority shall adopt a statement indicating what services, if any,
the Municipal Corporation will provide to the territory proposed for annexation:
NOW, THEFFORE, BE IT RESOLVED by the Council of the City of Dublin, State
of Ohio, of the elected members concurring that:
Section 1. The City of Dublin will provide the following municipal services for the
1.162 acres in Washington Township, Franklin County upon the annexation of said area
to the City of Dublin, Ohio:
Police. The City provides Police and Communications service on a full twenty-four hour
basis and also has mutual aid agreements with other municipalities. The annexation area
lies approximately two miles east of Dublin's Police Division Headquarters. Dublin
operates with a minimum of three cruisers on duty. A response time of approximately
five minutes for an emergency situtation, should be expected for this area.
Fire. Fire protection is currently provided by well-staffed departments in Washington
and Perry Townships iri Franklin County, and Concord Township in Delaware County.
They too have mutual aid agreements with other municipalities. This annexation would
not change fire department jurisdictional boundaries and therefore response times for fire
and emergency medical services will not be affected. The Washington Township Fire
Station is approximately one and one half miles from the annexation area and normal
response times should be approximately three minutes.
Sanitation. Residential refuse collection services are contracted by the City and are
currently provided at no additional charge.

I Street Maintenance. The City has a Street Maintenance Department which provides
excellent service in the area of street and road maintenance. This department also
provides curbside leaf pick-up at no additional charge.
Section 2. The City has SEWER and WATER service area contracts with the City of
Columbus, and the subject property is within said service areas, and conditioned on the
ability of the City of Columbus to provide WATER, and to provide sufficient
SEWERAGE disposal capacity, the City will have the ability to service the area.

RESOLUTION APPROVING THE PETITION
OF ROBERT A. FISHER FOR ANNEXATION
OF 1.162:1:: ACRES IN WASHINGTON
TOWNSHIP TO THE CITY OF DUBLIN, OHIO
CASE fF17 - 91
WHEREAS, the Commissioners of Franklin County, State of Ohio, proceeded
on the 7th day of August, 1991 to hear the petition of Robert A. Fisher,
fi led May 10, 1991 , and having in open hearing heard all of the persons
desiring to be heard for or against the granting of the petition, and having
considered all the facts with reference thereto, being fully advised, and
WHEREAS, the Commissioners make the following findings, based upon
the exhibits and testimony presented at the hearing of this matter:
1. The Petition contains all of the matters required by Ohio
Revised Code Section 709.02 including, without limitation:
A. A full description and accurate map or plat of the
territory to be annexed; B. A statement of the total number
of owners of real estate in the territory to be annexed;
C. The name of the person to act as agent for the petitioner.
2. The territory sought to be annexed is adjacent and contiguous
to the City of Dublin, Ohio.
3. Notice of the petition and the hearing has been published
as required by law, and all notices of filing the petition
and the hearings thereon have been given and delivered
as required by law.
4. The persons whose names are subscribed on the petition
are owners of real estate in the territory sought to be
annexed, and as of the time the petition was filed, the
number of valid signatures on the petition constituted
a majority of the owners of real estate in the territory
proposed to be annexed.
5. The map or plat and the description of the territory
contained in the petition are accurate.
6. The City of Dublin has complied with Division (B) of Ohio
Revised Code Section 709.03l.
7. The territory sought to be annexed is not unreasonably
large.
8. The general good of the territory sought to be annexed
will be served if the annexation petition is granted and
the annexation is allowed.
Therefore, upon the motion of Commissioner Teater , seconded
by Commissioner DeMoss :
BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF FRANKLIN COUNTY, OHIO:
Section 1. That the prayer of the Petition be GRANTED, and
the territory sought to be annexed by the petition filed herein
be annexed to the City of Dublin, Ohio, in accordance with the
law; that the orders and proceedings of this board relating to
the Petition, and map and description attached thereto, and all
I papers on file relating to this matter be delivered forthwith
to the Clerk of Council, City of Dublin, Ohio.
