... AN ORDINANCE AUTHORIZING THE CITY
f MANAGER TO ENTER INTO A CONTRACT
L .. FOR THE REPAIR OF GUARDRAIL,
~ WITHOUT FORMAL ADVERTISING &
COMPETITIVE BIDDING, AND DECLARING
AN EMERGENCY.
WHEREAS, council desires to remedy hazardous conditions involving
guardrail within the City of Dublin; and,
WHEREAS, in the interest of preserving the public health, safety, and
welfare, Council desires to remedy these hazardous conditions in an
expeditious manner; and,
WHEREAS, Section 8.02(B) of the Dublin Charter enables Council, by
ordinance or resolution adopted by a vote of at least two-thirds of its
members, to authorize, without advertising and competitive bidding,
contracts or expenditures for any purpose where the statutory or common
law of Ohio does not require competitive bidding; and,
WHEREAS, Section 735.051 of the Ohio Revised Code enables the
legislative authority of a city to authorize, by a two-thirds vote of
its members elected thereto, the City Manager, or other duly authorized
contracting authority, to enter into a purchasing contract without
formal bidding and advertising, when a real and present emergency
arises in connection with the operation of any department, division,
commission, bureau, or board of the municipality; and,
WHEREAS, Council believes that a real and present emergency exists

, NOW, THEREFORE, ~ IT ORDAINED by the Council of the City of Dublin,
'.. State of Ohio, ~ of the elected members concurring:
SECTION 1. That, pursuant to Section 8.02 of the Dublin Charter and
Section 735.051 of the Ohio Revised Code, the City Manager is hereby
authorized to enter into a Contract with the Paul Peterson Company for
the repair of guardrail, in the amount of $18,592.50, without formal
advertising and competitive bidding.
SECTION 2. That this Ordinance be, and hereby is, declared to be an
emergency measure necessary for the preservation of the public health,
safety, and welfare and, therefore, this Ordinance shall take effect
and be in force immediately upon its passage.

....... Attached for your consideration please find Ordinance No. 33-92
authorizing the city Manager to enter into a contract for the
repair of guardrails without formal advertising and competitive
bidding and declaring an emergency. Also attached for your
reference is a memorandum from Danny Johnson, Maintenance
superintendent, detailing the critical issues and concerns
regarding this matter.
It is the objective of staff to remedy hazardous conditions in an
expeditious manner; however, in order to meet this objective, it is
critical that a contract for the above mentioned repairs be
executed immediately. In this regard, Staff recommends that
pursuant to Section 8.02 of the Dublin Charter and section 735.051
of the Ohio Revised Code, formal advertising and competitive
bidding be waived and the City Manager be authorized to enter into
a contract with the Paul Peterson Company, in the amount of
$18,592.50, for the above mentioned repairs on an emergency basis.

Subject: Muirfield Guardrail

For the last few years there has been a continuing concern over the deteriorating condition of
the wood guardrail in the Muirfield sub-division. Two years ago Council authorized repairing
<!1i,*"'" these guardrail as part of a CIP program. However, several issues delayed this project. During
this delay the guardrail has continued to deteriorated to the point that I now feel it is imperative
the guardrail be replaced as soon as possible.
In a couple months (June 1) the Memorial Tournament will bring millions of visitors into the
City and these visitors will be driving in the areas where the guardrail need replaced.
Additionally, these guardrail are located on some of the most highly traveled streets in the City.
I feel the condition of these guardrail represent a real and present danger to the motoring public.
The issues which delayed this project have been answered and as this is a continuing concern
$40,000 was budgeted for the repair of the wood guardrail as part of the 1992 budget. Due to
the severity of the deterioration and the lack of time before the tournament there is not sufficient
time to bid this project. Therefore, I have acquired quotes for the project. Only 2 companies
were willing to submit quotes (see attached).
Please note these quotes are for the repair of the guardrail only, and Maintenance employees
would paint the guardrail in-house. I am recommending the City accept the quote from the Paul
Peterson Company in the amount of $18,592.50. To have a contractor paint the guardrail would
cost an additional $5,000.00 - $6,000.00, however, for City employees to paint it will cost
approximately $1,000 for paint and $1,000 for salaries. At this point I plan to cover the cost
of the paint and salaries out of my operating budget. However, this was not a project which was
included in our 1992 operating budget, therefore, other projects may have to be cut back or
money transferred into the accounts later in the year.

I am requesting that Council accept the quote from the Paul Peterson Company on an emergency
basis at its next regularly scheduled meeting on April 6, 1992. If the quote is accepted at this
meeting Paul Peterson has assured me the repair work will be completed prior to June 1, 1992.
City employees would then paint the guardrail after the tournament.
