I, II NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, II il State of Ohio, 7 of the elected members concurring: I Section 1. That the following described real estate (see attached legal I I description marked Exhibit "A"), situated in the City of Dublin, State of Ohio, I r II is hereby rezoned to PLR, Planned Low Density Residential District, and shall L II be subject to regulations and procedures contained in Ordinance No. 21-70 II (Chapter Eleven of the Codified Ordinances), the City of Dublin Zoning Code I and amendments thereto. REQUEST: Approval of an application to rezone 43.667 acres located on the ~1st and west sides of Muirfield Drive immediately to the north of the Indian Run Meadow subdivision and extending northward to the Bear Run, from R-1, Restricted ~ Suburban Residential District to PLR, Planned Low Density Residential District, for 105 lots and 6.9 acres of park. ,...,.. BACKGROUND: The site is on the east of Avery Road and extends eastward about one-half mile to the Dublinshire subdivision. The City of Dublin took by eminent domain a swath out its center and for the construction of Muirfield Drive. The Muirfield Drive connector opened about a year ago. The rezoning of this property has not been discussed r("..cently. It was last heard as part of the Dunmere mixed use plan several years ago. This is a request to rezone property from the R-l zone to the PLR, Planned Low Density Residential District. The plan sets f011h the general layout, lot size, access, park area, utility service, and development standards. The Planning and Zoning Commission shall make its recommendation on the rezoning requested and then return the application to City Council. A public hearing will be conducted there. Following that, City Council will vote on the ordinance. A two-thirds vote of Council is required in order to override the recommendation of the Commission. If approved, the proposal will be reviewed under the preliminary and final platting procedures as well. CONSIDERATIONS: 0 The site includes several acres from the rear portion of the Butterfield property (southwest corner of site), as well as the Ohio Holding Company's original parcel. 0 The site is bounded on south by lots in Indian Run Meadow Section 6 to the west of }'1uirfield Drive and by the park and detention pond located to the north of Scottish "'If Corner Elementary School on the east side of Muirfield Drive. All of this area to the south is zoned PUD, Planned Unit Development District. To the west, across A very Road, are the St. Brigid Catholic Church (R-l, Restricted Suburban Residential District), and the southern section of the \Vexford Estates subdivision (PLR, PlannrAi Low Residential District). The site wraps behind two estate-type lots located on the east side of Avery Road, just to the north of the Bear Run. To the north are the proposed Dublinshire 4 subdivision (PLR) located to the west of Muirfield Drive and vaccU1t property to the east of the road (R-1 and PUD). To the east is the Dublinshire Section 2 subdivision and abutting this site is the wooded park area. 0 The minimum lot size proposed is 70 feet in width and 9,300 square feet in area. Most of the lots are 70 feet wide, but the depth varies greatly. The gross density is 2.40 dwelling units per acre. The density for Dublinshire 4 is 2.59 units per acre; Indian Run Meadows is 2.64; and Dublinshire (original) is 2.33 units per acre. The density is expected to be kept within the 2-4 unit per acre range by the Community Plan, and the area west of Avery Road is to be limited to 2.0 units per acre. . '-~.~,_.~--_._. The sanitary sewer was installed last year along the south side of the Bear Run. 0 A bikepath was included in the construction of Muirfield Drive along its east side. .'- Sidewalks wiJI be constructed throughout the balance of the subdivision along both \- existing and proposed roads. 0 Detention areas for stormwater are shown along the south side of the Bear Run. \Vhile these are contained in the proposed park, the area being used for this purpose is not considered to be "park." 0 The park requirement is 6.648 acres, and the net amount shown is 6.899 acres. The park will be linear and encompasses the length of the Bear Run. The north side of the Bear Run was set aside as park in a previous zoning, Dublinshire 4. Providing the Bear Run as a linear park was previously discussed in connection with that rezoning, and it was encouraged. 0 The Bear Run was deepened and straightened last year, as well. This improved the drainage for the area arld decreased the amount of land subject to flooding. (Approved 5-0-1: 5-Yes, I-Abstain). 7. Rezoning Application Z92-004 - Dublinshire 5 Ms. Clarke showed slides of the site and presented the staff report. Ine subject site is on both sides of Muirfield Drive, and \\'faps around a pair of residences located on A very Road. It includes the back portion of the Butterfield acreage, whjch is a very deep single-family lot along Avery Road. It includes approximately four acres to the rear of that and continues. The site encompasses the open area which is to the south of the Bear Run, as well as wooded acreage along the south side. No provision was made for street access from the Indian Run Meadows subdivision and then to the nonh there is a substarltial barrier in the Bear Run. The land is , ' currently wned R-l. The propos.a1 is to rezone it to the PLR, Planned Low Density Residential District. The plan includes the general layout, the lot size, the access, the park area, utility .' service, and development standc.Jds. Separate from this, there will also be the review of a preliminary plat and the final plat, as well. The applica.T'Jt had submitted applications for both consideration of the rezoning application as Case #7 on this agenda and Case #8 was the consideration of the Preliminary Plat. Staff felt there \l,'ere enough unresolved issues 1.1-)at the Preliminary Plat should be held up. Approval of the preliminary plat is adequate for a developer to start construction. The Butterfield home will still have 1.3 acres as their lot. Tills overaJl site will be 43.6 acres. The park that is being set aside is the Bear Run, and the Dublinshire 4 subdivision to the north set aside parkland to the center line of the creek. This site will set aside parkland on the south side of the creek so there will be an adequate band that extends from east to west along both sides of the creek. The minimum lot size proposed is 70 feet aIld the minimum lot area is 9,300 squ2.Je feet. The gross density on this site is 2.4 dwelling units per acre. Dublinshire 4 is 2.59 dwelling units per acre, and Indian Run Meadows is 2.64 units per acre. The original Dublinshire (the Orr property) is 2.33 units per acre. The density in the Community Plan is two to four units per acre. To the west of A very Road, a maximum cap will be kept on the density at two units per acre. The subdivision will have one access point on A very Road and one access point on either side of Muirfield DIive. There is currently only one curb drop on Muirfield Drive, and that is where the Dublinshire Drive extension comes through. Since the two streets are aligned at Muirfield Drive, a median break may be appropriate. The utilities are available to the site. The sanitary sewer was inst2l1ed last year along the south side of Bear Run. A bikepath was included along 1-1uirfield Drive as part of this construction, and sidewalks are required L'JIoughout the balance of this subdivision, including along e>Jsting streets. Detention areas for stormwater are shown on the south side of the Bear Run that is within the park area, but the acreage of the detention areas is not included in the park dedication requirement, which is 6.648 acres. The net amount shown after the detention area is deducted is 6.899 acres. Tne park is linear along the Bear Run, which was deepened and .,...., straightened last year to improve the area drainage. Staff recommends approval of this rezoning application, be.cause single-family is the appropriate use of the land. The density is consistent with the Community Plan, which supports a park propos.a.1 that has been established. The "- conditions requested by Staff are as follows: 1) Revision of the plan with respect to lot lines along the floodway and no build zones along floodways and abutting parks; 2) Submission of u1e A very Road and Muirfield Drive landscaping, entry feature, and street tree plans; 3) Examination of all lots in the platting phases to assure adequate depth and buildable areas given limitations caused by floodway, setback, entry features, no build zones, landscaping, and mounding; 4) Identification of existing trees and provision of preservation plan; 5) Submission of appropriate single-family development standards and updated legal description; 6) Providing adequate access to the park; and 7) Description of detention ponds, especially along Muirfi.eld Drive, to demonstrate that appropriate appe-arc.nce and maintenance can be assured. These items have been addressed by the developer through a text. The minor remaining issues can be worked out. M.r. Geese asked if the contiguous property owners were sent notices. Ms. Clarke said yes. - He asked if these were sent out by certified mail. Ms. Clarke said no. Public hearing notices for City Council will be sent out by certified mail. Mr. Kelley said he is in agreement with the seven conditions. Sheryl Christ, 7277 Hopewell Court, s.cid she lives near the Butterfield property, and is concerned about her treeline. She doesn't want to lose it. She viewed the plans and doesn't see a problem. Ms. Clarke said a clitical issue is where the utiJities \l.'ill be placed. The preliminary drawings indicate that there won't be utilities going along the back property line. That is good news for the neighbors. The residents in Indian Run Meadow have a no-build zone established along the rear of their lots. It may be appropriate to match that development standard on the opposite side to protect the trees. The trees should be identified on the plat, and a tree protection plan should be devised. This would include bright orange, plastic snow fencing which will serve as a visual cue to a bulldoz.er operator. Staff will meet with the developer and any concerned residents to decide what trees should be taken out. Ms. Christ said this would be satisfactory. She said there will probably be more traffic than anticipated down Muirfield Drive to get to St. Brigid of Kildare. " Dublin Planning and Zoning Commission Meeting Minutes - September 10, 1992 Page 11 Mr. Bob Harrison, 7240 and 7210 Avery Road, which include a substantial portion of Bear Run, said he has worked out with the appbcant, an arrangement which is satisfactory. He said there will be a four-foot farm fence along his north property line. As part of the agreement, this fence will continue to wrap around 7240 Avery Road on the east side, as well as 7210 Avery Road on the south side, which will encompass a fence around Bear Run. This was necessary for the property line delineation. There were a large number of lots against a wide open piece of property. There is tile drainage at 7240 Avery Road, which accesses Bear Run Creek, and they have agreed there will be an easement across the parkland or a lot involved with it. The property was tiled when he bought the property. There is a tile outlet into Bear Run Creek. ,- 7240 A very Road does not touch Bear Run Creek. During the parkland development, he doesn't want the drainage easement disrupted. He is also concerned about assessments for sidewalks .... on A very Road. He feels that any sidewalk construction along A very Road should not be at the existing property owners' expense. They should not be required to maintain 500-600 feet of sidewalk. 11r. Geese asked 11r. Harrison if he approved of a sidewalk in front of his propeI1y if it would not cost him anything. 11r. Harrison said he doesn't desire a sidewalk across his property if it is not mandatory. Ms. Clarke said when a sidewalk ends at a property Ene, there will probably be a desire to extend it someday. The way municipalities often extend sidewalk is by assessment against the property owner. The long-term maintenance burden is always on the property owner. Mr. Harrison said this is a lot of sidewalk to maintain. He feels that since the City maintains the greenspaces and plows the streets, there should be a provision for the maintenance to extend to the sidewalk. This would cease if the 8.3 acres were developed. Ms. Clarke said only City Council can grant this request, and decides who pays for it and who mainLajns it. Mr. Leffler asked about breaking the median at the intersection of Muirfield Drive. He understands that this will be Dublin's obligation. Ms. Clarke said currently no median bre<.Jc has been requested, and would not normally be funded by the City. Mrs. Stillwell asked how many acres of trees are on the property now and how many will be - preserved by the plan. 11r. Kelley said the aerial accurately shows the property lines and the location of the trees. He feels that backing the lots up to the trees gives an opportunity to front ~' load the utilities, and provides for no-build zones along the rear of the lots. Be S?jd he will plot the location of the trees and will use a tree preservation program. Mr. Kelley said he wilJ show tf)e fence on the preliminary plat, so Mr. Harrison doesn't have to apply for a pennit. For the drain tile, he will put an easement in place tl1rough the park into the creek. 11r. Geese said he is bothered by the eljrnination of the trees. He said the drainage ditch for parkland is unattractive. He said it is poor planning and no imagination in the treed area. He wants to see the tree area (east parcel) dedicated to the park to extend the paIkland. Mr. Kelley said it is inaccurate to say aJl the trees are gone. He sajd the front-loading of the utilities, the no-build zones backing up to the trees will save many trees. He said the east side of MuirfieJd is a very difficult site. The boundary and a substantial setback of Muirfield Drive is difficult to deal with. There is a prior commitment to dedicate the park along the north property line to get the passive park connection aJong Bear Run. Given these constraints, this plan is a good plan. Mr. Fishman asked why we are giving away beautiful, treed land and taking a drainage ditch. Ms. Jordan said it is a stream. Waterway corridors have been identified as desirable for parkland. They make connections to larger areas of parkland. There is aJso concern about the Dublin Planning and Zoning Commission .' ~-"" Meeting Minutes - September 1 0, 1992 Page 12 number of trees that will be lost, and a plan similar to Wexford \Voods would be desirable for tree preservation. She said the northern part of the parkJand (Dublin shire Section 2) extends up to the creek and includes 12 acres of woods. Ms. Jordan said she spoke with Mr. KelJey about having a major access to that park and bikeway (near lots 16-19) off of Brigids Close Drive. Ms. Clarke said the \Vexford Woods' and Treetops of Brandon's tree preservation plan were fairly successful. Those programs include an on-site arborist on site who helps determine at the beginning what needs to be trimmed and taken out, what areas make the most sense for fencing and grading plans. Mr. Kelley said he is willing to do a plan similar to the Woods of .- Dublinshire program. -- Mr. Geese said there is usually more information with a PUDlrezoning application, i.e. an indication of where the woods sections are. Ms. Clarke said a lot of what is the text in a single- family subdivision, even though it is a PUD, fills up a lot of space, but is not very informative. In a PLR, the situation is more streamlined. The rezoning application was not distributed in the Commissioners' packet. Mr. Geese said this site is too dense in the east area. Mr. Kelley said a considerable amount of effort was made to come up with a reasonable plan, given the constraints of Muirfield, and having Bear Run as the passive parkland area. 1\.fs. Clarke said that in other wooded areas, the City has asked for a lot width of 100 feet, and lesser lot width in areas that are not wooded. She said the parkland the City wants to acquire in this area is the Bear Run. She said the 12 acres of woods on the Orr property, opposite the swimming pool, is large enough to satisfy the passive park needs for woods. Mr. Rauh said in order to save the trees on the sides of the lots, the lots will have to be widened. Construction equipment will need ] 0 feet to maneuver. It might entail a reduction of density. The lots could be done at 85-90 feet to accomplish this. Mr. Fishman asked if a condition could be added that the wooded lots have to be 100 feet wide like the other comparably wooded subdivisions. Ms. Clarke said if the wooded lots will be widened, the overall layout will change drastically. 11r. Kelley said he would like to take the lots #26-17, and come back with a preliminary plat that shows more sensitivity to the woods. Mr. Geese asked that he also consider lots #54-49. ,"'~ 1\.fr. Kelley asked that a condition to rezoning be made at the preliminary plat to specifically ......... . address where the trees are and appropriate lot widths in those locations, so that the tree preservation program agreed to can be effective. Mr. Banchefsky said the density can be adjusted at the preliminary plat to preserve the trees. This density is not locked in so long as there is this understanding. Mr. KeUey said he only has the cul-de-sac to adjust the lot frontages. Possibly a lot or two will be lost by doing this. It was withdrawn from the agenda prior to the meeting by the staff. There was no discussion and no vote. 9. Final Plat - Dublinshire 4, Phase 1 Ms. Clarke presented the staff report and showed slides of the site. This is the final plat for the first section of Dublinshire 4. It lies west of MuirfieJd Drive and includes 74 lots and 5.7 acres of parkland. The overall PLR is zoned for 123 lots and 5.7 acres of parkland. This is for the southern section which is along the Bear Run, opposite \Vyndham Village. One issue is to provide access to the Jefferson Savings BaJlk site which was, at the time of zoning, considered to be the next likely high school. This first section is not adjacent to it, so a determination will ...... be made later whether it should be a road or a bikepath connection. The Bear Run runs south of the site and that area to the creek centerline has been set aside as parkland with this ...... ' application. The development standards for this site are a front and rear yard minimum of 25 feet, a minimum sideyard of 6 feet and combined sideyards of 14 feet. That is fairly consistent for this size lot. The park access was widened to 50 feet on Round Tower Lane, and then providing park access easements through the subdivision cul-de-sacs. City Council added a specific condition at the preliminary plat approval requiring the perimeter landscaping (the area along Avery Road and Muirfield Drive) to be landscaped in a similar manner to the Indian Run Meadow. This includes mounding and landscaping along the boulevard, as well as along Avery Road. Muirfield Drive should have a continuation of that landscape program. Additionally, a possible left-turn lane on A very Road is needed, and would be built by the developer. 1ms is subject to the determination of the City Engineer.
