DRIVE /NORTH FORK INDIAN RUN PEDESTRIAN
BRIDGES PROJECT, AND DECLARING AN EMERGENCY.
WHEREAS, the City of Dublin (the "City ") is constructing bike lanes, a shared -
use path, and pedestrian bridges along Muirfield Drive as part of the Muirfield
Drive Bike Lanes Project (the °Project'j; and
WHEREAS, said Project requires that the City obtain a two permanent
easements and a temporary easement from The Country Club at Muirfield Village
(the "Grantor ") at the corner of Muirfield Drive and Moors Place North, identified
as Franklin County Parcel No. 273 - 001847, as well as obtaining a permanent
easement and temporary easement from the Grantor from the property located
south of Carnoustie Drive, identified as Delaware County Parcel No. 600- 343 -05-
073 -000, said property interest more fully described in Exhibit "A" and depicted in
Exhibit "B," all attached hereto; and
WHEREAS, the City and the Grantor participated in good faith discussions and
have come to mutually agreeable terms for the acquisition of the necessary
property interest for the value of Twenty Thousand Dollars ($20,000.00); and
WHEREAS, the City desires to execute necessary conveyance documentation to
complete the transaction between the City and the Grantor.
NOW, THEREF&E, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, of the elected members concurring that:
Section 1. The City Manager is hereby authorized to execute all necessary
conveyance documentation to acquire a 0.115 acre, more or less, permanent
easement; a 0.023 acre, more or less, permanent easement; and a 0.101 acre,
more or less, temporary easement from the Country Club at Muirfield Village from
the property located at the comer of Muirfield Drive and Moors Place North; and a
0.144 acre, more or less, permanent easement and a 0.328 acre, more or less,
temporary easement from the Country Club at Muirfield Village from the property
located in Delaware County along Muirfield Drive, south of Carnoustie Drive, for
the value of Twenty Thousand Dollars ($20,000.00), said property interest
located within Franklin County Parcel No. 273 - 001847 and Delaware County
Parcel No. 600 - 343 -05- 073 -000, and as more fully described in the attached
Exhibit "A" and depicted in attached Exhibit '"B."
Section 2. This Ordinance is declared to be an emergency necessary for the
immediate preservation of the public peace, health, safety or welfare, and for the

further reason that obtaining the property interest is necessary for the
advancement of this Project. The ordinance shall therefore take effect
immediately upon passage.

EMERGENCY.
Background
The City of Dublin (the "City') is constructing bike lanes, a shared -use path, and pedestrian
bridges along Muirfield Drive as part of the Muirfield Drive Bike Lanes Project (the "Project'.
The Country Club at Muirfield Village (the "Grantor ") owns property from which the City desires
three permanent easements and two temporary easements for the construction of the shared -use
path. The property interests that the City desires is from two different locations: the property
located at the corner of Muirfield Drive and Moors Place North, identified as Franklin County Parcel
No. 273 - 001847; and the property located in Delaware County along Muirfield Drive, south of
Carnoustie Drive, identified as Delaware County Parcel No. 600 - 343 -05- 073 -000.
After engaging in amicable discussions, the City has come to an agreement with the Grantor to
acquire the property, pursuant to the terms outlined in this memorandum. This Ordinance
authorizes the settlement of the matter for the value of Twenty Thousand Dollars ($20,000.00),
which is slightly above the appraised value.
The City is requesting emergency action to preserve the public peace, health, safety, or welfare,
and for the further reason that obtaining the property interest is necessary for the advancement of
this Project.

Acquisition
The City will be acquiring from the Grantors only the property interest necessary for purposes of
the Project, as depicted in the legal description and depiction attached to this memorandum. The
property interest is detailed below.
The Country Club at Muirfield Villaae
In the interest of keeping the Project moving forward, the City believes it is prudent to accept the
Grantor's counter -offer and continue moving forward with the Project.
Recommendation
Ordinance No. 70 -14 would authorize the City Manager to execute all necessary conveyance
documentation to formally acquire the necessary property interests described above.
The Law Department recommends that Council dispense with the public hearing and approve
Ordinance 70 -14 by emergency at the July 1 Council meeting in order to finalize settlement with
the Country Club at Muirfield Village and continue moving forward with the Project.

2545 and 5162 being a part of a 53.99 acre tract conveyed to The Country Oub at Muirfield Village by
Deed Book 445, Page 528, Delaware County and Deed Book 1248, Page A07, Franklin County, as
records herein are from the Recorder's Office, Delaware County, Ohio unless otherwise noted and being
more particularly described as follows:
Beginning for Reference at 3/4" diameter Iron pipe at the Intersection of the west Right of Way of Muirfield
Drive (variable Right of Way width - Plat Book 12, Pages 6-8, Delaware County & Plat Book 49, Pages
81-83, Franklin County) and the northerly line of said 53.99 acre tract
Thence, North 85'26'15" West, a distance of 17.91 feet, a" the northerly line of said 53.99 acre tact,
said pant being the Point of Beginning;
Thence, South 37 °41'06" West, a distance of 226.67 feet, crossing said 53.99 acre tact, 15.00 feet west
and parallel to the west Right of Way of said Muirfield Drive to a point;
Thence, with a curve to the left a radius of 676.62 feet, an arc length of 18825 feet a delta of 15'56'2T',
a chord bearing of South 29 °42'53" West and a chord distance of 187.64 feet, continuing 15.00 west and

53.99 acre tad to a pant;

the Point of Beginning, containing 0.328 acres, more or less, subject to legal highways, easements,
leases and restriction of record and of records in the respective utility offices.
The bearings described herein are based on the Ohio State Plane Coordinate System, South Zone,
NAD83 (CORS96). Note that parcel Is located In North Zone, however, the overall project is in South
Zone and used for the Construction Documents. Said bearings originated from a field traverse which was
referenced to said coordinate system by GPS observations and observations of selected stations in the
Ohio Department of Transportation Virtual Reference Station Network.
The described 0.328 acre tad is a part of Auditors Tax Parcel Number 80034305073000 and is based
on Plat Book 12, Pages 8-8, Plat Book 12, Page 35, Plat Book 15, Page 153, Delaware County and Plat
Book 49, Pages 81-83 Franklin County.
