A RESOLUTION ACCEPTING THE LOWEST AND BEST BID
FOR THE 2014 SIDEWALK MAINTENANCE PROGRAM
WHEREAS, formal advertising and competitive bidding procedures have been
conducted, pursuant to Section 8.04 of the Revised Charter and Chapter 37 of
the Dublin Code, for the 2014 Sidewalk Maintenance Program; and
WHEREAS, Council has determined that the bid submitted by B &C Blacktop
Sealing, Inc. constitutes the lowest and best bid; and
WHEREAS, Council has determined that there may be a legitimate need to
declare the relocation of the utilities in connection with the above - referenced
project as a "single source" procurement, for reason that the company owning
the utilities in question has the exclusive rights to relocate such utilities.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin,
of its elected members concurring, that:
Section 1. The bid submitted by B &C Blacktop Sealing, Inc. in the total
amount of $266,440.00 is hereby accepted.
Section 2 . The City Manager is hereby authorized to enter into contracts
with B &C Blacktop Sealing, Inc. for performance and completion of the 2014
Sidewalk Maintenance Program pursuant to the Advertisement, Proposal and
Contract Documents for said project on file in the office of the City Engineer.
Section 3. This Resolution shall take effect upon passage in accordance
with Section 4.04(a) of the Revised Charter.

Acceptance
Summary
On June 19, 2014, (5) bids were received, publicly opened and read for the 2014 Sidewalk
Maintenance Program, which involves the removal and replacement of deficient sidewalk sections.
The 2014 Program will include work on existing sidewalks in the following subdivisions: Indian
Run Meadows, Dublinshire, Earlington Village (Sections 2, 3 and 4), Hemingway Village, Shannon
Park, Ballantrae (Sections 2 -5 and 1 -1), Waterford Village (Section7) and Brighton Park. The 2014
work was originally intended to be performed by Adleta, Inc. (based in Cincinnati, Ohio) as a
second phase of the 2013 Sidewalk Maintenance Program by means of an addendum to the 2013
Program. However, as a result of actual costs exceeding their bid prices, Adleta, Inc. declined the
requested addendum for the 2014 Program. This resulted in the 2014 Sidewalk Maintenance
Program being advertised for bid as a separate project.
The Engineer's estimate is $250,000.00. The budgeted amount in the 2014 Capital Improvement
Program (AT1406) for the 2014 Sidewalk Maintenance Program is $250,000.00. B &C Blacktop
Sealing, Inc. submitted the lowest and best bid of $266,440.00. Staff has reviewed all bids and a
summary of the bids is listed below.

For Council's reference and review, a reduced set of project construction drawings has been placed
in the Council Planning Room.
The bids received were higher than anticipated for the removal and replacement of the concrete
sidewalk areas. The Sidewalk Maintenance Program is not a project where a contractor can expect
high productivity, and this is reflected in the increased costs for the replacement of the concrete
sidewalks.

As in the past, the majority of the sidewalk repair locations are caused by roots from mature trees
heaving the sidewalks. As part of the repair process, these roots will be pruned and removed. A
few trees that have larger roots removed in the sidewalk repair process will also have their
canopies thinned and trimmed by forestry staff from the Parks Division. Engineering works closely
with the forestry staff on the sidewalk repair process to ensure impact to trees will be minimized
where feasible.
Staff anticipates initial construction activities to begin on August 4, 2014 (after the Irish Festival)
with a completion date of October 24, 2014. An Engineering Project Inspector will closely monitor
this work, including the coordination with adjacent residents.
Staff has thoroughly reviewed the B &C Blacktop Sealing, Inc. bid. While this contractor has not
previously worked for the City of Dublin, they did provide references for projects they have
recently constructed within central Ohio. Staff has contacted representatives of these projects and
received acceptable feedback on the work performed by B &C Blacktop Sealing, Inc. and their
performance capabilities.
Recommendation
Staff recommends Council approval of Resolution 59 -14, accepting as lowest and best the bid of
B &C Blacktop Sealing, Inc. in the amount of $266,440.00 and authorizing the City Manager to
enter into a contract with B &C Blacktop Sealing, Inc. for this project.
