,~ WHEREAS, The city Engineer of the city of Dublin, has determined that a
storm sewer easement in the Moors at Muirfield can be vacated, the details
of which are more fully set forth in the attached document; and

WHEREAS, Council further finds that there is good cause for such vacation
of the storm sewer easement and that such vacation will not be detrimental
to the City's storm sewer system or general interest of the city of
Dublin.
HOW, TllEREFO~, be it ordained by the Council of the City of Dublin, state
of Ohio, v of the elected members concurring, that:
section 1. That the Moors at Muirfield storm sewer easement located
between Lots Nos. 1292 and 1298 of the resubdivision of the Moors at
Muirfield is hereby vacated, subject to the City reserving any and all
other easements thereon. This storm sewer easement is more fully
described in the legal description and survey attached hereto as Exhibit
"A".
Section 2. That the City Manager be and is hereby authorized to execute
on behalf of the City of Dublin the easement vacation instrument attached
hereto as Exhibit "A", and incorporated herein by reference, all as more
fully described in the said vacation plat.
Section 3. That the city Engineer is hereby instructed to cause said plat
to be recorded at the Office of the Franklin county Recorder.
Section 4. That the Clerk of Council is directed to notify the Auditor of
Franklin County of the vacation, by forwarding a copy of this Ordinance
thereto.

DESCRIPTION OF AN EXISTING
10 FOOT EASEMENT TO BE VACATED
LOT NO. 1292 OF THE RESUBDIVISION
OF THE MOORS AT MUIRFIELD
Situate in the State of Ohio, County of Franklin, City of Dublin and being
a strip of land on, over and across Lot Number 1292 as the same is shown and
delineated upon the Record Plat of "RESUBDIVISION OF LOTS NOS. 1266 THRU 1282,
'c........ LOT NOS. 1287 THRU 1292 AND LOT NOS. 1299 AND 1300, ALL INCLUSIVE, OF THE MOORS
AT MUIRFIELD" as shown of record in Plat Book 66 pages 60 and 61, records of the
Recorder's Office, Franklin County, Ohio and being more particularly described
as follows;
Being a strip of land 10.00 feet in width, beginning in the southerly line
of an existing 15 foot easement delineated on said plats of record in P1at.Book
66, Page 60 and Plat Book 63, Page 02, and terminating in the southerly line of
said Lot 1292 and being adjacent to, parallel with and immediately easterly of
the following described line;
Beginning for reference at a point on a curve in the southerly right-of-way
line of Moors Place West (SO feet in width) at the northwesterly corner of said
Lot Number 1292;
Thence S 100 21' 39" W, a distance of 15.08 feet, along the westerly line
of said Lot 1292 and tqe easterly line of Lot 1298 of the Moors at Muirfie1d
shown of record in Plat Book 63 Page 02, to a point in said southerly line of the
existing 15 foot easement; said point being the point of true beginning of the
herein-described strip;
Thence S 100 21' 39" W, a distance of 149.75 feet along the westerly line
of said Lot 1292 and the easterly line of said Lot 1298 to a point at the
southwesterly corner of said Lot 1292 and being the terminus point of the herein-
described strip;

SUBJECT: Vacation of storm sewer easement
Please find attached a copy of a storm sewer easement we recommend to be vacated.
The easement is located along the west side of lot 1292 in The Moors at Muirfield
residential subdivision. It is 10 feet wide, and no utilities, drainage swales, or
pede&trian ways are located or planned within the easement.
The Moors at Muirfield was originally platted in 1985. In 1987 this subdivision was re-
platted with many lots being joined to make larger lots. Lots 1299 and 1300 of the
original platting were combined into lot 1292 at this time. With the re-platting, a 10-foot
wide storm sewer easement, which was centered on the common property line between
lots 1299 and 1300, was now located in the center of the newly-created lot 1292, A
new 10-foot easement (the easement recommended to be vacated) was created along
the west side of the new lot 1292 with the understanding that the old 10-foot easement
would be vacated when the existing storm sewer was relocated to the new easement.
Nothing has been done with this lot or with the storm sewer relocation since 1987.

In May of this year a lot split was approved for lot 1292. The lot split essentially
restores the originally-platted lots 1299 and 1300 to their original configurations. The
storm sewer easement created with the re-platting of The Moors in 1987 is now located
along the west side of the newly-restored lots. The easement is not necessary; no
work was done to relocate the storm sewer, no other utilities were placed within the
easement, no grading was performed, and no pedestrian ways were planned to be
located within the easement. In addition, the presence of this easement adversely
affects the developability of this lot. Because of its narrow width, this lot cannot be
reasonably developed unless this easement is vacated.
Upon Council's approval of this easement vacation, we will proceed with the recording.
