ORDINANCE NO. 130-94 (Amended)
AN ORDINANCE IMPLEMENTING SECTIONS 3735.65 THROUGH
3735.70 OF THE OIDO REVISED CODE, ESTABLISHING AND
DESCRIBING THE BOUNDARIES OF THE BRI'ITON PARKWAY
COMMUNITY REINVESTMENT AREA IN THE CITY OF DUBLIN,
DESIGNATING A HOUSING OFFICER TO ADMINISTER THE
- PROGRAM, AND CREATING A COMMUNITY REINVESTMENT
HOUSING COUNCIL AND A TAX INCENTIVE REVIEW COUNCIL,
AND DECLARING AN EMERGENCY.

WHEREAS, this Council desires to pursue all reasonable and legitimate incentive
measures to assist and encourage commercial office development consistent with the City's
Economic Deve~opment Strategy referred to below and in specific areas of the City that have not
enjoyed sufficient reinvestment for remodeling or new construction; and
WHEREAS, as required by Section 3735.66 of the Ohio Reised Code, a survey
of housing has been prepared for the area proposed to be included in e Britton Parkway
Community Reinvestment Area designated in this Ordinance and described and depicted in
attached Exhibit A to this Ordinance (the "Area"), which survey was part of the City's
comprehensive land use survey conducted in 1992 which land use survey has been updated and
reconfirmed for the Area by the City's Department of Development (the "Survey"); and
WHEREAS, the Survey shows the facts and conditions relating to existing housing
and commercial facilities and undeveloped areas in that Britton Parkway Community
Reinvestment Area, including, among other things, evidence of deterioration and lack of new
construction or repair or rehabilitation of substantial portions of the Area; and
- WHEREAS, the City commissioned and undertook a comprehensive economic
development strategy in 1994 (the "Economic Development Strategy") and that Strategy identifies
as most desirable for the City commercial office development which may include research and
... development operations, which development can occur at relatively intense levels; and
WHEREAS, the City of Dublin Department of Development continuousl y monitors
the existing inventory of vacant commercial office space in the City, the region and the State of
Ohio, and the City Department of Development has determined, consistent with the findings of
the Economic Development Strategy, that there has been and is a shortage of readily available
commercial office space for prospective users desiring and needing that space on an immediate
basis; and
WHEREAS, there has been recommended to this Council the approval of the
designation of Britton Parkway Community Reinvestment Area as a Community Reinvestment
Area and this Council has been apprised of the Survey and the facts and conditions relating to
Britton Parkway Community Reinvestment Area, and this Council has determined that the
construction of major new commercial office structures in the Area is consistent with the City's
Economic Development Strategy and would serve to encourage economic stability, maintain real
property values, and generate new employment opportunities in the City; and
WHEREAS, the construction of new commercial office structures in the Britton
Parkway Community Reinvestment Area constitutes a public purpose for which real property

NOW, THEREFORE, BE IT ORDAINED by the City of Dublin, Franklin, Union
and Delaware Counties, Ohio, that:
Section 1. Based upon the aforesaid recommendations and the Survey, and on this
Council's own knowledge of the facts and conditions existing in Britton Parkway Community
Reinvestment Area, this Council hereby fmds and determines that the area to be designated as
the Britton Parkway Community Reinvestment Area constitutes an area in which housing facilities

or structures of historical significance are located, and in which new construction or repair of
existing facilities has been discouraged.
Section 2. Pursuant to Section 3735.66 of the Ohio Revised Code, the Britton
Parkway Community Reinvestment Area is hereby established as that Area described and
depicted in attached Exhibit A to the Ordinance.

regulations within the Area and the City's Economic Development Strategy will be eligible to
....... apply for exemptions under this Ordinance, and commercial retail uses are not eligible to apply
for exemptions under this Ordinance.
This designation of the Area as a Community Reinvestment Area is a
public/private partnership intended to prompt and expand conforming uses of the Area.
Consistent with its Economic Development Strategy, the City has recently undertaken public
improvements supporting economic development in the Area.
Section 3. Within the Britton Parkway Community Reinvestment Area, new
construction of commercial office structures consistent with the City's Economic Development
Strategy is hereby declared to be a public purpose and exempt from real property taxation and,
in accordance with the procedures and requirements of Section 3735.67 of the Ohio Revised
Code, the exemption period shall be up to ten years for these new commercial office facilities,
with that period and the percentage of the tax exemption on the increase in the assessed valuation
resulting from improvements to commercial real property and the term of those exemptions to
be negotiated and determined on a case-by-case basis in advance of commencement of
construction, all in accordance with Section 3765.67 of the Ohio Revised Code. The results of
the negotiation of any exemption authorized by this Ordinance shall be set forth in writing in a
Community Reinvestment Area agreement pursuant to and in accordance with Section 3735.671
of the Ohio Revised Code, each of which agreements shall be approved by this Council.

If new construction qualifies for an exemption, during the period of the exemption
)001 the structure shall not be considered to be an improvement on the land on which it is located for
the purpose of real property taxation.
There shall be no exemptions within the Area (i) residential or industrial new
construction, (ii) repair, rehabilitation or remodeling of residential, industrial or commercial
properties, (iii) repair, rehabilitation or remodeling of commercial properties, or (iv) commercial
retail uses.
Section 4. All commercial office projects in the Area are required to comply with
the State of Ohio application fee requirements of Section 3735. 672 (C) of the Ohio Revised Code.
Section 5. To administer and implement the provision of this Ordinance, the
City's Director of Development is designated as the Housing Officer as described in Sections
3735.65 through 3735.70 of the Ohio Revised Code.
Section 6. A "Community Reinvestment Area Housing Council" shall be created,
consisting of two members appointed by the Mayor of the City, two members appointed by this
Council, and one member appointed by the City Planning Commission. A Majority of those
members shall then appoint two additional members who shall be residents of the City. Terms

from a vacancy in the Housing Council shall be filled in the same manner as the initial

A Tax Incentive Review Council shall be established pursuant to Section 5709.85
of the Ohio Revised Code, and shall consist of three members appointed by Board of County
Commissioners of the applicable County in accordance with Section 5709.85(A)(2) of the Ohio
Revised Code; two members appointed by the Dublin City Manager with the concurrence of this

Council; the Auditor of the applicable County or their designee, in accordance with Section
5709.85(A)(2) of the Ohio Revised Code; an individual appointed by the Board of Education of
the Dublin City School District; and an individual appointed by the Board of Education of the
Central Ohio Joint Vocational School District. At least two members of the Tax Incentive
Review Council shall be residents of the City. The Tax Incentive Review Council shall review
annually the compliance of all agreements involving the granting of exemptions for commercial
or industrial real property improvements under Section 3735.671 of the Ohio Revised Code and
make written recommendations to this Council for continuation, modification or cancellation of
,..... those agreements based upon the performance of each agreement. The Tax Incentive Review
Council shall annually review the compliance of each recipient of a tax exemption under Section
.... 3735.67 of the Ohio Revised Code with the nondiscriminatory hiring policies developed by the
City under Section 5709.832 of the Ohio Revised Code and make written recommendations for
enhancing compliance with such nondiscriminatory hiring policies.
Section 7. This Council reserves the right to reevaluate the designation of the
Britton Parkway Community Reinvestment Area after December 31, 1995, at which time the
Council may direct the Housing Officer not to accept any new applications for exemptions as
described in Section 3735.67 of the Ohio Revised Code, with respect to any additional new
construction thereafter commenced in Britton Parkway Community Reinvestment Area.
Section 8. The Community Reinvestment Area Housing Council shall make an
annual inspection of the properties within the Area for which an exemption has been granted
under Section 3735.67 of the Ohio Revised Code. The Housing Council shall also hear appeals
under Section 3735.70 of the Ohio Revised Code.
Section 9. A copy of this Ordinance shall be forwarded to the Franklin County
Auditor; and a copy of this Ordinance shall be published in a newspaper of general circulation
in the City once a week for two consecutive weeks immediately following its passage.
- Section 10. This Council hereby finds and determines that all formal actions
relative to the passage of this Ordinance were taken in an open meeting of this Council, that all
... deliberations of this Council and of its committees, if any, which resulted in formal action were
taken in meetings open to the public, in full compliance with the applicable legal requirements,
including Section 121.22 of the Ohio Revised Code.
Section 11. The City Manager of the City of Dublin is hereby directed and
authorized to petition the Director of Development of the State of Ohio to confirm the findings
contained within this Resolution.
Section 12. This Ordinance is declared to be an emergency measure necessary for
the immediate preservation of the public peace, health, safety or welfare of this City and for the
further reason that this Ordinance is required to be immediately effective in order to provide
incentives for improvements to be constructed in the district to be made as soon as is possible,
providing necessary jobs and employment opportunities and improving the economic welfare of
the people of the City; wherefore, this Ordinance shall be in full force and effect immediately
upon its passage.
