NOW, THEREFORE, BE IT ORDAINGD by the Council of the city of
Dublin, state of Ohio, /J of the elected members
concurring:
Section 1. That the following described real estate (see
attached map marked Exhibit "A" ) situated in the City of
Dublin, State of Ohio, is hereby rezoned to PCD, Planned
Commerce District District and shall be subject to regulations
and procedures contained in Ordinance No. 21-70 (Chapter
Eleven of the Codified Ordinances) the City of Dublin Zoning
Code and amendments thereto.
Section 2. That application, Exhibit "B", including the list
of contiguous and affected property owners, and the
recommendations of the Planning and Zoning Commission, Exhibit
"C", are all incorporated into and made an official part of
this Ordinance and made an official part of this Ordinance and
-" said real estate shall be developed and used in accordance

..... The Planning and Zoning Commission took the following action at its regularly scheduled
meeting:
s. Revised Concept Plan - ~:last Property
Location: 14.4 acres located on the northwest corner of Post Road and Avery Road.
Existing Zoning: R-1, Restricted Suburban Residential District and POO, Planned Unit
Development District.
Request: Review and approval of a revised Concept Plan to permit office and
institutional uses.
Proposed Use: Expansion of the existing Lowell Trace POOl for SO, Suburban Office
and Institutional, uses, including a church campus.
Applicant: Ruth E. Mast, 6759 Avery Road, Dublin, OH, and Robert J. Apel, 5640
Frantz Road, I?ublin, OH 43017.
MOTION: To approve this revised Concept Plan because it is consistent with the previously
approved plan for Lowell Trace and is compatible with existing and proposed
uses in the area, with the following five conditions:
",.... 1) That flood way and floodplain boundaries be accurately shown on all plat, planning,
building permit, and engineering documents and that all City Codes be met regarding
floodways and floodplains;
~ 2) That the applicant submit a tree survey showing trees with a caliper of six inches and
above, and that a tree preservation plan, prepared by a Certified Arborist be submitted
subject to Staff approval;
3) That the building and parking setbacks along Post Road be consistent with the
Convalarium at Indian Run and the Dublin Retirement Center;
4) That setbacks remain consistent with the approved development standards including side
and rear setbacks of 50 feet for structures and 30 feet for parking, loading, and service
areas; and
5) That engineering issues such as stonnwater management and access be resolved at the
Preliminary Development Plan stage.

REQUEST: Review and approval of a revised Concept Plan under the provisions of Section
1181.07 for 14.4 acres located on the northwest corner of Post Road and Avery- ~
Muirfield Road to permit office and institutional uses, including a church campus.

BACKGROUND: ...
The subject site includes two parcels zoned R-l (1.383 acres and 0.436 acre), Restricted
Suburban Residential District and a portion of the approved Lowell Trace PUD, Planned Unit
Development. This request is for an expansion of the SO, Suburban Office and Institutional,
portion of the existing Lowell Trace PUD. This portion of Lowell Trace was previously
approved for SO uses in April 1987 by the Planning and Zoning Commission (Refer to attached
minutes).
The Concept Plan is a non-binding review to be conducted first by the Planning Commission and
later by City Council. The procedure and requirements are outlined in Section 1181.07. The
Concept Plan is the first stage of the PUD review process. It is intended to indicate proposed
land use(s), open space, and road systems in very general terms. This review is prior to
conducting more detailed engineering and other site analyses.
The objective of the Concept Plan is to inform the applicant as to whether the proposal is
generally on the right track. An approval here authorizes the applicant to proceed with filing
a formal rezoning application (preparation of the Preliminary Development Plan), site
engineering, etc. Following a recommendation by the Planning and Zoning Commission, the
Concept Plan will be reviewed by City Council.

CONSIDERATIONS: *
0 The 14.4 acre site is located on the northwest corner of Post and Avery-Muirfield ...J
(formerly Avery) Road. The site contains two existing single-family residences, one
fronting on Avery-Muirfield Drive and the other on Post Road. A portion of the site
contains farmland which is still cultivated.
0 Most of the site is zoned for office/institutional use as part of the Lowell Trace PUD.
Two portions of the site are currently zoned R-l, Restricted Suburban Residential
District: an existing single-family residence on 1.383 acres located on Post Road near
the western property line; and a small 0.436 acre site located on the northeast corner of
the site which abuts Avery-Muirfield Drive.
0 North of the site is the Red Trabue Nature Preserve which is part of the Dublin park
system. The South Fork of the Indian Run is located within the preserve, directly north
of the site. Farther to the north are single-family homes located in the Lowell Trace
subdivision. To the west of the site is the Convalarium at Indian Run, a nursing care
facility, which is zoned PUD. To the east of the site across Avery-Muirfield Drive are
single-family residences zoned R-l. South of the site is the Riverside Hospital property
which is currently undeveloped and is zoned PCD, Planned Commerce District.
0 The site is generally flat with existing deciduous and evergreen trees located throughout

Subarea F
Location: 18.470 acres located between Perimeter Drive and Perimeter Loop Road.
Existing Zoning: PCD, Planned Commerce District (perimeter Center).
Request: Review and approval of modified Development Text as provided under the
provisions of Section 1181.09.
Proposed Use: Expansion of retail center (Building A) from 166,000 to 176,500
square feet and expansion of the grocery store from 72,000 to 85,000 square feet.
Applicant: Continental Real Estate, c/o Mark A. Pottschmidt, 150 East Broad Street,

MOTION: To approve this revised Development Text because the modifications down-
zone the retail center from 250,000 square feet to 176,500 square feet, are not
substantial in nature, enhance the center's viability in serving the community,
and fulfill the condition of approval placed on the Development Plan with the
understanding that future phases will fully meet off-street parking requirements
within Subarea F with the following three conditions:

I) That the City's parking code be fully met in all future phases of the retail center.
2) That the applicant submit a revised Development Text for Staff review and approval

3) That a detailed landscape plan for the mound and screening along the retail center's

"..,,:;,-< The following Subarea Descriptions and Development Standards by subarea shall be made part
of the Concept Plan and are further discussed and illustrated in the Subarea Plan.
Subarea Descriptions
Subarea A Interchanl:e Related: (25.4 acres)
Because of its location adjacent to a major freeway interchange, Subarea A may contain freeway
oriented uses similar to the other two quadrants on the east side of the Route 161 at 1-270
interchange and include hotels/motels, general office uses, corporate headquarters office or major
institutional uses.
Subarea B Post Road Related: (42.0 acres)
This area is characterized by its relationship with residential uses on the north side of Post Road
and the need for a reasonable landscaped setback buffer between the residential uses and the
proposed development
~ Subarea B-1 Revised Post Road Related area: (7.4 acres)
_~"i This area is also characterized by its relationship with residential uses on the north side of Post
Road. The permissible uses will include compact disc manufacture in addition to office-type
uses. All development standards and buffers from Subarea B will continue to be applicable.
Subarea C Internal Orientation: (91.6 acres)
Uses within this subarea shall include a mix of commercial, office research and light industrial
uses or uses that exhibit a degree of clean, quiet unobjectionable processing activities within an
enclosed structure. These uses are more appropriate to Subarea C because of its internal
relationship within the site.
Subarea D State Route 161 Related Uses: (113.1 acres)

Because of extensive State Route 161 frontage, uses within Subarea D are primarily freeway
oriented, general office, corporate headquarters office and institutional uses, hotels and motels.
Subarea E Services Zone: (14.2 acres)
Typically found between a major interchange and the first arterial intersections, this subarea
contains freestanding uses on individual lots that require a highly visible orientation and
immediate access. Architecture, signage and site planing/traffic elements are coordinated
~.. through various controls to assure a unified development appearance.
-'41: Subareas F, Fl, F2, and F3 Retail Center: (33.0 acres)
This area contains a mix of retail/commercial uses in an integrated shopping environment typical
in size to a community center. This self-contained area also has access on all sides creating an
even distribution of traffic.
Subarea G Multi-Family: (16.2 acres)
As a buffer or a transition zone to the single-family area to the north (Post Road frontage), the
multi-family area will have a unified, residential scale appearance with a limited density.
Subarea H Institutional/Elderly: (8.0 acres)
Catering to the needs of an aging population, this area is adjacent to major retail facilities and is
specifically reserved for housing elderly citizens in various living arrangements (e.g.. congregate
care, elderly care) and/or professional office uses.
Subarea I Transitional Area: (5.0 acres)

This zone will function as a transition zone between the retail uses of Subarea E (the service zone
- along Avery Road), and F, FI, F2, and F3 (the retail mall) and the freeway oriented office area-
Subarea D to the east.

Subarea Development Standards
General:
1. If these standards conflict in any way with the City of Dublin Codified
Ordinances, then the Planned Commerce District shall prevail. Standards in the
Dublin Zoning Code applicable to matters not covered in this document shall
apply to each of the subareas in the Planned Commerce District.

2. The standards included herein shall not require modification of any structures,
~,.;;,;: landscaping, or other improvements actually in place as a result of development occurring
prior to this rezoning. Such structures, landscaping and improvements shall be
considered permitted and legal and conforming uses at the location and to the size and
degree they exist at the time of said rezoning.
3. Perimeter Drive will be constructed through to Wilcox Road as a part of the initial
development phase of Subarea F, FI, F2, and F3. The loop road through Area E,
F, D shall also be constructed as part of the initial phase. At such time as the part
of said Perimeter Drive is constructed through the Thomas property, the
remainder of said Perimeter Drive from the east line of the McKitrick property to
the west line of the Thomas property shall forthwith start and be completed within
a reasonable time. The entire length of Perimeter Drive shall have a sidewalk
along the southern right-of-way from Avery Road to Coffman Road. Nothing
herein shall prohibit owner(s) from completing Perimeter Drive prior to the
required completion period. If additional right-of-way is required for ramp
widening, it shall be provided.
The landscape buffer along the south side of Post Road shall be installed in its entirety
- from Avery Road to Wilcox Road with the beginning of construction on Subarea G, H, F
or the construction of perimeter drive from A very to Wilcox.

With regard to the mound and landscaping required on the property along Post Road and
owned by applicant Olde Poste Properties, the following schedule should apply:
a) At such time as any parcel of said property along Post Road is developed,
applicant shall complete the mounding and landscaping along the Post
Road frontage of said parcel as a part of the initial phase of construction
and maintain the same thereafter.
b) In addition, if said applicant, prior to the completion of the mound and
landscaping as required under a) hereof should develop lands lying north
of Perimeter Drive (not at the date ofthis rezoning developed) with
construction amounting to 100,000 square feet of building area or more,

applicant will complete the entire mound and the landscaping between the
mound and the Post Road right-of-way from Discovery Boulevard to the
east if the City of Dublin undertakes to water the landscaping elements
until any or all parts of the Post Road frontage mound and landscaping are
constructed in accordance with a) hereof. For these purposes, neither the
planned day care center which is a permitted use at the northeast comer of
Discovery Boulevard and the proposed loop street nor construction on the
15 acre parcel owned by White Consolidated Industries shall be included
."""~ within the said 100,000 square feet.
iliiio& The applicant shall be obligated to pay one-third of the cost of the improvement of Avery
Road from the south right-of-way line of Post Road to the north right-of-way line ofS.R.
161 according to plans approved by the City of Dublin if, and only if, the City of Dublin
agrees to pay one-third of said cost, and one-third of said cost is assumed by those
owning property on the west side of A very Road, between Post Road and S.R. 161. Said
improvement shall be undertaken and performed by applicant prior to the opening of any
commercial use on applicant's property the subject of this rezoning if, and only if, the
City of Dublin furnishes the applicant in money or required materials with its share of
said costs at a time which reasonably meets applicant's construction and opening
schedules. In addition, applicant agrees to include within the improvement project that
part of A very Road (Muirfield Boulevard) from the south right- of-way line of Post Road
to the present southerly terminus of the four land section of Muirfield Drive north of
Indian Run if, and only if, the City of Dublin furnishes the applicant in money or required
materials with the cost of said additional construction. Both applicant and the City of
Dublin understand that appropriate con tracts will be executed covering the construction
contemplated herein.
4. The street plan shown on the plan is the general plan which will be platted and
~"'" constructed. It is not, however, intended to be precise, and while the functional
system will be produced, its precise location may vary from that shown so long as
;lWih'. the functional objectives continue to be attained. A safe bike connection from
Post Road to Perimeter Mall through areas G & H will be provided if the bikeway
connection over S.R. 161 is made, a bike tie/link will be completed to Post Road
from the proposed bike path in Area G, H to State Route 161 connection.
5. Signage and Graphics:
DESIGN CRITERIA
A. These criteria are written in conjunction with the Dublin Sign Code Chapter
1189. In areas of conflict, these criteria shall supersede the Dublin Sign Code.

1. All signs with a base shall have the base constructed of the predominant
material of the user building.
2. All signs mounted on pylons shall have landscaping around the base of the
sign and around the pylons such that the pylons are not visible. All
plantings shall be of an evergreen material (see Example E attached). The
length of the pylons shall be limited to two (2) feet between the grade
elevation and the bottom of the sign face.
c. Dimensions of Sign:
1. Maximum area of sign face: 50 square feet per face, with a limit of no
more than two faces per sign.
2. Area of sign base (if any) shall not exceed area of sign face. The base shall
not be included in the overall area permitted for the sign face.
3. Maximum overall height: 8'-0" above top of adjacent street curb. Signs
located on earthen mounds shall maintain conformance to 8'-0"

4. It is intended that the signs shall be generally rectangular in design with an

level signage employed solely to identify users with structures and landscaping effectively
shielding the street from the impact of activity on the site. The following additional standards
are deemed appropriate to produce such a function.

Subarea F
Subarea Development Standards:
Subareas F, Fl, F2, and F3 shall comply with the general subarea development standards
contained in the original Perimeter Center zoning (general, signage and graphics, lighting and
Perimeter Center primary identification signage design criteria) unless otherwise indicated in this
text or in the submitted site plans. Percentage of lot coverage shall be no greater than 80% in
- Subarea F. When Subareas Fl, F2 and F3 are combined, their total percentage oflot coverage
shall be no greater than 75%.

Subarea F:
The retail center will have a maximum total gross square footage of 176,500 with a
maximum 85,000 square foot grocery store. The grocery store square footage is contained within
the total gross square footage of 176,500. This retail center may be developed in phases.
Servicing for the proposed center, upon completion of all phases, will be totally screened from
view by passer-by traffic, and, until completion, temporary screening of the rear areas will be
accomplished by mounding and by placing pine trees staggered fifteen feet on center along those
spaces. This total screening height shall be fourteen feet at the time of planting from the
elevation of adjacent drives or parking. Special attention will be provided to design of all
elevations of the center to maintain an established architectural theme with good aesthetic quality
throughout the development of the retail and services zone. The same or compatible building
materials and a common lighting, signage and landscaping ethic will also be incorporated to
blend with the surrounding proposed uses for total site compatibility. The first building to be
constructed will be the Big Bear store and related shell shops. Future phasing will be controlled
by market demand.

Architecture:
The architectural design of the buildings shall be consistent with the architectural
elevation plans submitted with this application. The development shall be constructed with the
same architectural style and roof treatment with the exception of service corridors. The facade
shall consist of brick and manufactured stone and the sloped roof shall be constructed of cedar
wood shake shingles. The brick shall be selected from the approved Perimeter Center pallet.
The manufactured stone shall be "Ohio limestone (buff)" by manufacturer Carriage Hill Stone or
~lH! approved equal and used throughout the project as a water table and as a facade treatment in
select areas. The store front system shall be designed in a historic style using windows with
"',d mullions and raised panel details. The roof slops shall be 8/12, 10/12 or 12/12 pitch depending
upon location of the roof element. The rear areas of the development shall be given special
treatment so as to present an architecturally appropriate facade to the traveling public. The rear
walls of the Big Bear Store and related shops and the flex-office structure shall be constructed of
stucco or synthetic stucco in order to complement the architectural style found on the front
facade and scoring and/or lights or other relief elements shall be used to break up the back of the
center. The three (3) free-standing buildings (being designated as 8.4K, 12.6K, and 2SK
respectively) shall maintain the same architectural style and roofing as the main center on all four
(4) facades. Screening to a height of six (6) feet shall be placed along the west property line of
Subarea F 1 to provide additional screening for the north elevations of these buildings. Further,
there shall also be a hedge of bushes along the front of the shopping center walkway similar to
those along the rights-of-way within the subject area that shall provide continuity with the entire

The Transitional Nature of Subarea I: The area proposed for Subarea I was contemplated to
be general office, corporate headquarters, hotels, etc. It was further contemplated that this site
would form an important part of the entrance impression of not only Perimeter Mall but Dublin
itself. Because of specific high quality retail use fulfilling this purpose, the original concept for
Perimeter Center was altered to allow creation of Subarea I permitting automobile dealerships
under strict development standards, in addition to the standards set out for Subarea D.
Subarea I will additionally serve as an architectural transition, incorporating elements of
,--" the Perimeter Mall, while at the same time easing into the higher scale uses of Subarea D, where
common architectural themes are not contemplated.

Interrelationships of Rezoning and Development Plan: To create the new Subarea I, a
rezoning was necessary. This rezoning is agreed by the initial end user of Subarea I (the
Mercedes automobile dealership), the City, and the developer of Perimeter Mall to be
specifically conditioned on the development plan presented for the parcel and the rezoning and
development plan are presented concurrently. It is further agreed that a simple rezoning to a
retail use for this parcel would be inappropriate. In effect, the rezoning amounts to a variance;
the development plan, the architecture, building materials, and development standards of the
specific rezoning and development plan proposal presented are integral parts of the rezoning.
Taking all of these matters together, the particular retail use presented at the time of the rezoning
of Subarea I is appropriate for this site. However, it does not follow that any other use, deviating
in any respect from the development plan presented would be appropriate for the site. It is a
condition of the rezoning of Subarea I that any future use of Subarea I must meet the
requirements set out in this text.
Subarea I - Transitional Area
Permitted Uses:

Development Standards for Automobile Dealerships:
The development shall be limited to the highest caliber auto dealership which shall
exhibit an extraordinary visual quality. Construction shall be limited to one building which does
not exceed 44,000 square feet in area. Auto display, sales and service, shall be permitted and
- may not include a body shop, or storage of damaged vehicles or other activities which may
detract from the higher visual quality intended here. This site will be treated as an important
'->41 gateway into Dublin and the design will reflect both high quality and a coordination with
surrounding development.
No automobile bodywork permitted on site. No damaged automobiles stored outdoors on
site. Automobiles stored outside of buildings and awaiting sale are limited to number of
approved parking spaces, and may be displayed in single rows only; Le., automobiles may be
displayed nose to tailor side to side, but not both. Display, pad areas outside of parking areas are
not included in foregoing requirement, providing same is finished with concrete, brick pavers or
other permanent material and is located behind building setback line. No outside loudspeakers
permitted. No balloons, banners, flags, blimps or helium air devices or similar devices, may be
used on site for any purpose. All building materials must be of equal quality all four sides.
Display information on vehicle not a part of the vehicle itself is limited to stickers
required by federal or state law and in addition, one additional sticker not larger than 3 by 6
inches, not an iridescent color, and listing the year and type of car. There will be no slogans,
prices or other information painted or added to the windows, either on the interior or exterior
side, of automobiles held for display on site.

pavers or concrete finished in a brick pattern at point of entry into site.

Treatment of hazardous materials on site:
1. Waste oil and waste anti-freeze must be stored above ground in concrete vault

Lighting:
General standards for lighting are contained in the general text. Lighting for automobile
dealerships must comply with the general standards. Further, lighting for automobile dealership
display if of a higher intensity than surrounding parking lot lighting must make a smooth
transition to lower intensity lighting on surrounding uses. Applicants for this type of land use
- must show specific fixtures to be used and specifications, and further must provide lighting
engineering plan showing actual intensities of light falling on illuminated areas and
*",-,.. cutoff areas. Higher intensity display lighting may be used only in association with sales
activity, limited to the hours of the showroom operation. A Secondary lower intensity lighting
level consistent with the adjacent parking lot(s) will be used at other times.
If fixtures selected for surrounding uses in Perimeter Center are not suitable for lighting
for automobile dealerships, then similar and visually compatible designs must be used. Fixture
finish and color will be the same as Perimeter Center standard.

PERlMETER CENTER TEXT AMENDMENT
This text covers Subarea F as delineated in the original Perimeter Center zoning. The .
- purpose of this amendment is to modify the site plans and uses which were included in the original
Perimeter Center zoning for this subarea. This text amendment also breaks the original Subarea F
... into Subarea F, Subarea Fl, Subarea F2. and Subarea F3.
SIJBAREA DEVELOPMENT STA.l\'DARDS:
Subareas F, FI, F2, and F3 shall comply with the general subarea development standards
contained in the original Perimeter Center zoning (general. signage and graphics, lighting and
Perimeier Center primary identification signage design criteria) unless otherwise indicated in this
text or in the submitted site plans. Percentage of lot coverage shall be no greater than 80% in
Subarea F. 'When Subareas Fl, F2 and F3 are combined, their total percentage oflot coverage shall
be no greater than 75%.
SUBAREA F:
The retail center will have a maximum total gross square footage of 166.000 'with a
maximum of 72,000 square foot grocery store. The groceI)' store ~are footage is contained within
the total gross square footage of 166,000. This retail center may be developed in phases. Senicing
for the proposed center, upon completion of all phases, will be totally screened from view by passer-
by traffic, and, until completion, temporary screening of the rear areas will be accomplished by
mounding and by placing pine trees staggered fifteen feet on center along those spaces. This total
screening height shall be fourteen feet at the time of plantini from tbe elevation of adjacent drives
- or parking. Special attention will be provided to design of all elevations of the center to maintain
r an established architectural theme with good aesthetic quality throughout the development of the
\.. retail and services zone. The same or compah'ble building materials and a common lighting, signage
and landscaping ethic will also be incorporated to blend with the SUlTOUnding proposed uses for total
site compatibility. The first building to be constructed will be the Big Bear store and related shell
shops. Future pbasini will be controlled by market demand.
The following uses shall be permitted v.ithin Subarea F: permitted uses include USes
permitted in the ee, Community Commercial District. and the SO, Suburban Office Institutional
District. Conditional uses to include outdoor seating associated with an eating aod ddnking place,
theaters, outdoor garden sales including garden centers, drlve.in facilities associated with a pennitted
use and open display associate~ with a permitted use.

SUBJECT: Ordinance 127-94 - Perimeter Center - Subarea F - Approved Colors
....
L Council requested a memo identifying the approved color palette for the Perimeter Center retail
shopping center which is Subarea F within the overall Perimeter Center Plan.
1) The Big Bear wall sign with red plastic internally illuminated letters was approved by the
Planning Commission and Council in the rezoning document. The shade of red does not
match the "palette" and was the only component approved in a true red color. The
applicant argued that the shade would be complimentary. All other shopping center
signage is to be gold lettering which will be lit by gooseneck light fixtures.
2) A general color palette for exterior building trim, as previously approved, includes
Algerian (dark red), Shaded Spruce (dark green), and navy blue (all Pratt and Lambert
colors). The amended development text, as submitted to Council at -the time of rezoning
the shopping center site in 1994, cites (see page 4) the approved colors as the original
three as listed above, plus "compatible" color(s) "as approved by Staff."
3) At the later presentation of the Development Plan to the Planning Commission, Staff
'. endorsed the use of black and plum (dark purple). Both of these additions have more
historical basis than the original three colors, and they are muted and compatible with
the original three, in the opinion of Staff. Staff and the Planning Commission rejected
other additional colors requested at the same public meeting.

4) The approved canvas awning colors for the center are generally to match the paint trim
colors: Algerian, Shaded Spruce, navy blue, black and plum. In the alternative, the
.. awnings may match the other facade building materials: neutral white, neutral gray, or
a gray stripe.
More than the original three trim colors were depicted on the applicant's presentation boards at
the time of the rezoning. The colored xerox drawings that were distributed last year in the
packet, are in retrospect, difficult to make definitive color identification. They do, however,
communicate the general architecture and trim. It should be noted, however, the actual decision
on additional colors was made at the later Planning Commission as part of the final public
approval of the shopping center architecture, etc. Staff continues to hold that the added colors
will enhance the architectural character of the center to create a more village-like ambience.
The color for gooseneck light fixtures is to be selected from the storefront palette. Canvas
awnings are not to be backlit. All final color selections are subject to Staff review and approval
at the time of building permit approval.

Since we gained approval of our Preliminary Development Plan for Perimeter
Center, we have been able to finalize plans with our three largest tenants: Big
Bear, Revco and Blockbuster. As a result of the final design process our
square footage numbers, as approved with our Preliminary Development Plan,
have changed slightly.
The most significant change occurs with the Big Bear store. The approved
Preliminary Development Plan text calls for a retail center with a maximum
total gross square footage of 166,000 with a maximum of 72,000 square foot
grocery store. Big Bear has made several modifications to accommodate
recommendations contained within an in depth market study, which include
an enlarged produce section, a cappuccino bar and a juice bar.

MOTION: To approve this development plan, with the following 22 conditions, because it
will comply with the Composite Plan and Development Text, the Community
Plan identifies the site as a major retail location, the architectural solution
proposed provides a great deal of interest within a village-like setting, establishing
Perimeter Center as a unique entry to Dublin, and the pedestrian environment is
unique for a contemporary suburban retail development:

~",4f with the Development Text or that the Development Text be amended per Code to permit
a larger store;
2) That no parking signage be posted along Mercedes Drive and that Perimeter Loop Road
be striped and signed for a continuous bi-directionalleft turn lane;
3) That the applicant consolidate the architectural palette by deleting the "french vanilla"
trim color, adding black as a trim color, and deleting "sapphire blue" awning color, that
the "burgundy" color of awning match the "algerian" color of trim, that gray be added
as an awning stripe, and that canvas awnings not be back-lit;
4) That storefronts, awnings and sign boards be a single color per individual storefronts,
as approved by Staff, that grocery store signage be accurately shown relative to color,
and that rear service doors and mechanical units, such as gas and electric meters, be
painted to match the respective background wall;
5) That a lighting plan for Subarea F complying with the Dublin Lighting Guidelines be
submitted for Staff review and approval, including all proposed lighting fixtures (style,
color height, etc.), an isofootcandle plot, and the dormer window indirect lighting
treatment;

perimeter screening, that landscape islands within the parking area be increased in width

inside the right-of-way, and that evergreen plantings proposed on top of the seven-foot
mound to the rear of the retail center be installed in a scattered pat!em along the sides

9) That appropriately sized skyline locusts be installed along retail center storefronts that
will not conflict with awnings, that the proposed burning bushes be replaced with a salt-
tolerant evergreen with a 36-inch mature height, and that the applicant install sufficient
water bibs for'planting beds;
10) That the Development Plan be revised to indicate the off-season (fall and winter)
treatment of the entry fountain, subject to Staff approval;
11) That an eight-foot-wide bikepath be constructed along the south side of Perimeter Drive
from Avery-Muirfield Drive to Wilcox Road, prior to occupancy;
12) That all rooftop mechanica1s be fully screened to their height; ...
13) That the applicant commit to constructing the evergreen hedge and stone pilaster border
along Perimeter Drive, Perimeter Loop Road, and adjacent service drives adjacent to the -
retail center, that the applicant commit to constructing the hedge treatment as adjacent
parcels (under the applicant's andlor property owner's control) are developed, and that
within one year' of Development Plan approval for the retail center, the applicant will
construct the hedge treatment on the property owned by Continental Real Estate, and
landscape buffer along Avery-Muirfield Drive as required;
14) That a conditional use permit must be approved by the Planning Commission for all
outdoor retail sales, including garden centers and open display associated with a
permitted use;
15) That A very- Muirfield Drive outparcel (Subarea E) development continue to be controlled
by the architectural palette on file with the City;
16) That the SR 1611andscape buffer required in the Perimeter Center Development Text be
installed;

20) That the developer submit a traffic management plan for construction-related traffic,
subject to review and approval by the City Engineer;

22) That the pond have five jets instead of three.

CASE 9: Development Plan - Perimeter Center - Phase 1 - Subarea F
APPLICANT: Continental Real Estate Companies, c/o Mark A. Pottschmidt,

REQUEST: Review and approval of the Development Plan for Perimeter Center, Subarea F,
for a retail center' of 135,839 square feet of building area, comprised of two
structures (124,439 square feet and 11,400 square feet), 5,645 square feet of
outdoor retail area and parking for 771 automobiles on 18.47 acres located ..
between Perimeter Drive and Perimeter Loop Road.
BACKGROUND: ...-
The PCD zoning for this site was amended by Council on July 18, 1994, to permit a 166,000
square foot retail center with a maximum of 72,000 square foot grocery store. A Revised
Composite Plan and Development Text was approved at that time. The grocery store square
footage is contained within the total square footage of 166,000 square feet. The proposed
Development Plan includes 135,839 square feet of building area, which includes a 79,000 square
foot grocery store, and 5,645 square feet of outdoor retail area. The outdoor retail area will
require a conditional use permit from the Planning Commission. The balance of the retail center
(two structures), two outparcels and the flex-office structure will be in later phases.

Development Plan approval is required under the provisions of Section 1181.09(d). This plan
provides public review of issues related to architecture, landscape and screening, access,
utilities, parking, etc. Approval of the Development Plan is required before the applicant may
fIle for a building permit. If disapproved by Planning Commission, the applicant may appeal
to City Council. A subdivision plat is also required under the provisions of Chapter 1181.
Because the grocery store exceeds the text maximum of 72,000 square feet, a revised Composite
Plan and Development Text will need to be submitted for review and approval before the
Planning Commission and Council.
CONSIDERATIONS: ..
0 Existing uses within Perimeter Center are: to the north the Perimeter Lakes apartment
,
complex (zoned R-12) and a vacant recently rezoned multi-family parcel, a veterinary :-'
clinic, credit union and restaurant to the east, two auto dealerships to the south, and two
banks to the west along Avery-Muirfield Drive.
0 The site is located in Subarea F of the Perimeter Center development which was rezoned
in July for a 166,000 square foot retail center (including a 72,000 square foot grocery
store and three separate retail structures totaling 46,000 square feet), two outparcels
totaling about 4 acres for restaurant or other commercial uses, and a flex-office structure
totaling 100,000 square feet.
0 Subarea F is further subdivided into four subareas: Subarea F is the retail center, Subarea
F1 is the two restaurant outparcels, Subarea F2 is the flex-office structure, and Subarea
F3 contains existing uses adjacent to Wilcox Road (vet office, credit union and
restaurant).
0 The Development Plan consists of a 122,982 square foot retail center (including a 79,000
square foot grocery store) with an additional 5,646 square feet of outdoor retail area (for
a total of 128,627.6 square feet), a 11,400 square foot retail structure, 771-space off-
