Reconsideration of Rezoning Application Z92-014 - Swanson Property Location: +7.21 acres lOCated on the south side of Rings Road, approximately 1,350 feet to the east of Wilcox Road. Goodale Blvd., Columbus,OH 43212. REQUEST: To rezone 72 acres located on 7.2 acres on the south side of Rings Road, 1,350 feet west of Wilcox Road, for 53 condominium units. BACKGROUND: .lIP This application was informally reviewed by the Planning Commission at the September 10, 1992 meeting. During the meeting, the Commission was concerned that the existing Southwest Area Plan indicates this site as office use, not multi-family, as proposed. The Commission was uncomfortable recommending land use changes before the plan is revised. Several members were also concerned about the number of multi-family units being developed in the area. The applicant is interested in developing two-story condominium units within the PLR, Planned Low Density Residential District, and has filed a formal rezoning application. No changes have been made to the plan. The rezoning ordinance was heard by Council as a frrst reading on September 14 1992, and referred to the Planning Commission. The next step is review by City Council. The rezoning ordinance will be scheduled for a public hearing and later for a vote by City Council. A two-thirds vote will be needed to override the Planning Commission's recommendation. CONSIDERA TIONS: 0 The site has 358 feet of frontage on Rings Road and is about 900 feet deep. It contains a home at the northwest corner. The southern property line fronts on future Relocated Wilcox Road. The site is generally flat with mature tree rows along property lines. 0 To the west of the site are two existing single-family residences located along the south side of Rings Road, zoned R-IB, Restricted Suburban Residential District (Washington Township). The proposed Brighton Park subdivision is also to the west, zoned PLR, Planned Low Density District. To the east is a large undeveloped property zoned SO, Suburban Office and Institutional District; Britton Parkway (also known as the Coffman Road Extension) will be constructed through it to connect with Rings Road. Across Rings Road to the north is undeveloped property zoned R, Rural District. South across future relocated Wilcox Road is the new Britton Woods apartment complex zoned R-12, Urban Residential District. 0 The applicant is proposing 53 condominium units along a 20-foot wide private drive running north/south through the middle of the site. Eight separate buildings are proposed with attached one-car garages and patios. The units are approximately 1,300 square feet and will contain two or three bedrooms. There are 27 additional parking spaces shown in addition to the garages and driveways. The units are two-story with basements. The proposed materials are brick and siding. The applicant has developed similar units at Northbridge along the east side of Frantz Road just south of Tuttle Road. 0 Four storm water detention basins are proposed. The smallest, located at the southwest corner, of the site, will serve Brighton Park. It will resolve the pending storm water issue ---- ---~ _n,'__. Dublin Planning and Zoning Commi~sion Staff Report - October 8, 1992 Page 9 that arose due to a miscalculation in the Britton Woods apartment project's storm water design. 0 The required parkland dedication is 1.8 acres, or 25 percent of the gross acreage. The developer is proposing to substitute developed facilities for part of the acreage. The dedication in this case is 0.8 acres. The staff supports this concept. Two tennis courts are proposed along the northwest corner of the site to be built by the developer. They ," will be made available to the public, and' a public parking and access easement will be needed. The Parks and Recreation Committee reviewed this application and recommended that the park and tennis courts be clearly defined as open to the public with the appropriate park signage. 0 There is a proposed 10-foot bikepath easement, between lots 32 and 33 in Brighton Park to the west, which stubs into this site. The applicant has agreed to extend that bikepath northeast through the site linking it to Rings Road. A sidewalk will be needed across the eastern portion of the Rings Road frontage. 0 The adopted Southwest Area Plan designates this site as office use. Multi-family use and office uses, however, generally have similar land use characteristics and can be used to fulfill the same sorts of land use transitions. This proposal would not be considered a more intense land use than office. However, an amendment of the Southwest Area Plan will be needed in conjunction with the requested change. 0 The construction of future Relocated Wilcox Road is not a developer responsibility. The City will be the responsible party, but it is not a project which has been scheduled for the current 5-year Capital Improvement Program. Relocated Wilcox Road will run from present Wilcox Road to Britton Parkway paralleling the south property line. Until that road is constructed, a temporary turnaround will be needed for this site. 0 The gross density proposed here is 7.35 dwelling units per acre. 0 Utilities are under construction in the area and will be available to service the site. 0 The Fire Department has reviewed this plan and is concerned about the lack of available water pressure to service new multi-family development. Until this issue is resolved, the City cannot make the commitment that building permits will be issued. STAFF RECOM'MENDA TION: Staff believes the site can accommodate this multi-family development because of its low density . Staff is concerned about the detention, layout, and private driveway width. Additionally, Staff has some concerns about the developability of the piece of land to the east, just west of proposed Coffman Extension. Bases: 1) The plan provides a transitional land use between the single-family development to the west (Brighton Park) and the proposed office development to the east. 2) Surrounding property in Columbus was downzoned from office to multi-family use, and this would provide land use consistency. ADDmONAL INFORMATION: The adoption of this change in land use which differs from the approved Southwest Area Plan requires a formal plan change. Rezoning Application Z92-014 - Swanson Property Ms. Fierce showed slides of the site and presented the staff report. During the presentation of this application last month, the Commission was concerned that the existing Southwest Area Plan indicates this site as an office use, not multi-family. There was also concern about a number of apartments being requested for the area. Additionally, the Commission felt uncomfortable recommending new land use changes before that Southwest Area Plan is formally revised. The applicant is still interested in pursuing condominium developments with a PLR, Planned Low Density Residential District zoning change. There have been no real changes in the plan since last month. The subject site is located on the south side of Rings Road. There are two . residences adjacent to it to the west, and then Brighton Park. There are a number of trees along the western portion and a significant treeline along the property, as well. The applicant wants to develop 53 two-story condominium units with an overall density of 7.3 units per acre. The proposal includes eight separate buildings, approximately 1,300 square feet per unit, similar to Northbridge on Frantz Road. The developer is proposing to develop two public tennis courts to meet the park requirement. The applicant will extend the bikepath northeast through the site linking it to Rings Road. A sidewalk will be built along that portion of the Rings Road frontage. Staff is still concerned about the detention, the layout, and the private driveway width, and has some concerns about the developability of the portion of the property located to the east of this site, which has been slated for office use. Staff is recommending approval of this application because it does provide transitional land use between the Brighton Park subdivision to the west and the proposed office portion to the east, and is proposed at a low density. A number of conditions are included with this recommendation and are as follows: 1) That the proposed private road be 24 feet wide and that the individual driveways be 24 feet long between the garage and the curb; 2) That the developer dedicate 30 feet of right-of-way from centerline along Rings Road and Relocated Wilcox Road; 3) That drainage detention comply with MORPC guidelines and be approved by the City Engineer; 4) That left turn stacking lane be constructed along Rings Road if determined to be - necessary by the City Engineer; 5) That a park development access and maintenance plan, as well as bikeway extension into the subdivision be approved by the Parks and Recreation Committee and Director; 6) That the units be subject to the standard residential height of 35 feet, with natural building materials and appropriate architectural treatment; 7) That a street tree program and sidewalks be installed along Rings Road and future Wilcox Road Relocated; 8) That interior lighting be provided which meets the Dublin Lighting Guidelines; 9) That the site plan reflect sensitivity toward the single-family neighbors to the west; and 10) That a temporary turnaround be constructed at the southern end of the private drive until Wilcox Road Relocated is built. Ms. Fierce said this change in zoning would also require a formal change to the Southwest Area Plan and a motion recommending any Plan amendments is also requested. , Dublin Planning and Zoning Commission Meeting Minutes - October 8, 1992 Page 12 Mrs. Stillwell asked for an explanation of the developabiIity of the land to the east. Ms. Fierce said there is a concern of having an appropriate layout of buildings and roadways along the portion to the east, but the developer feels they can work with Staff on this. Mr. Charlie Ruma, applicant, said he is in agreement with the conditions. He said the plan has been revised to show a 24-foot drive through the site. Accommodating a 24-foot setback to the drive is almost impossible, but he said it will be between 20 and 22 feet. These units have enclosed one-car garages. There will also be 27 parking spaces, bringing it close to three parking spaces per unit. 30 feet of right-of-way will be dedicated from the centerline of Rings Road and the Relocated Rings Road. The detention facilities will comply with MORPC ~ guidelines and will be approved by the City Engineer. The left turn stacking lane, if necessary, will be done. Approval has been given by the Parks and Recreation Committee to proceed with the two public tennis courts. He said he will continue the path through Brighton Park to Rings Road. He intends to have a landscaped area between this site and the Brighton Park subdivision. A heavily landscaped area will be installed between the tennis courts and Mr. Steve Martin's home (adjacent to the tennis courts to the west.) Mr. Ruma will maintain the treeline, also. He said the density of 7.3 units per acre is great for the transition of single-family and commercial office uses. Mrs. Stillwell asked what the Frantz Road Northbridge development density is. Mr. Ruma said that development is 10 units per acre. Mr. Manus asked if the park will include a sign informing the public it is open for their use, and will there be parking. Mr. Ruma said yes. Mr. Bill Yoder, Southwest Area Residents Association representative, said he attended the Southwest Area Plan meeting on October 6, and one of the themes was the elimination of multi- family zoning. This development lacks a proper road system, interior setbacks, sidewalks, street trees and sufficient park area. There is a lack of screening, and this development is too close to the adjacent single-family development. The residents also fear the loss of the treeline. They r feel the two-story with basement units will attract younger couples with children to the area. I There have been no substantial changes with this project. He calculates the density at eight units per acre, not seven. Mr. Rauh said the current Southwest Area Master Plan shows this area as designated office use. He still is concerned about a changing direction of that plan. Mr. Campbell said a condominium complex with less than eight units per acre is reasonable, however, the original discussion was that this would still be office, same as the area to the east. He said he is still hesitant about changing this without knowing how it will fit into the larger scheme of things. Mr. Manus said it was made clear before that the proposal did not conform with the Southwest Area Plan. The amendments to the Southwest Area Plan are being written now, and if it is revised so that this parcel should be multi-family, he would go along with that. Mllii Dublin Planning and Zoning Commission ,Meeting Minutes - October 8, 1992 Page 13 Mrs. Stillwell said there are very good points to this application, e.g. resolving the detention basin problem with the adjacent property and the tennis courts, but she feels since the entire Southwest Area Plan is taken into consideration, she hesitates to make any substantive change in this Plan to accommodate this proposal. Mr. Leffler said he can not support multi-family in this area at this time. Mr. Ruma said this is a seven acre site that is between commercial and single-family. If commercial is to be developed on this site, then access is needed off of Rings Road. He feels putting commercial on Rings Road is a mistake., If the commercial site were developed from Britton Parkway, then that would be reasonable. When roads change, then the overall Master Plan should change along with it. The most significant change is the roadway and the use of the property along Britton Parkway. Mr. Fishman asked if the materials for the exterior would be all brick, or brick and frame. Mr. Ruma said brick and frame, most fronts and ends are brick, high pitched roofs with siding in between. Mrs. Stillwell made a motion to disapprove rezoning application Z92-014 on the basis: 1) That the proposed development fails to advance the general welfare of the municipality or the immediate vicinity, and 2) That the benefits to be derived do not justify deviation from the currently adopted plan. Mr. Rauh said many residents at the Southwest Area Plan meeting, October 6 were concerned about how this area will develop. He said this proposed use might be the best use for this parcel in the future, but the residents of the Southwest Area would not benefit today. Mr. Ruma said the Southwest Area Plan is a guideline, and it is up to the Commission to use it as that. Rings Road will be moved north, and the existing Rings Road on which this site is presently is going to be fronting will be turning to the north and stubbing into a new Rings Road. This will be a residential road. Ms. Fierce said this proposed use of multi-family is similar in intensity to office. The new road plan is not yet adopted. Mr. Campbell asked Mr. Yoder if the southwest area residents would rather see this parcel remain office? Mr. Yoder said single-family is preferred. Parkland could help in easing the multi-family/single-family transitions. When this area is fully developed, one tenth of the total population of Dublin will probably live in the southwest area in the 1,572 multi-family units expected. Mr. Campbell cited that there are other pockets of multi-family elsewhere including Asherton and Dublin Village. Mr. Fishman asked Staff how much impact on the area would there be by accepting this application without the completed Southwest Area Plan. Ms. Clarke said Staff has recommended approval of this application. It could be determined otherwise after study. Part of the land that was shown on the Southwest Area Plan in Columbus as office was downzoned for apartments (Britton Woods). We did modify our roadway proposal for the area, but the roadway plan is not completed: Consultants are under contract and are looking at the roadway needs for the . . Dublin Planning and Zoning Commission . Meeting Minutes - October 8, 1992 Page 14 area. There are no unique characteristics which this site has that needed to be captured. When the larger area is studied, there might be a few commercial sites to be reserved for the maximum tax base. Seven acres of the site as compared to the 20 square miles of Dublin is not significant. Mr. Campbell seconded the motion.
