WHEREAS, Council finds that it is in the best interest of the
-- City of Dublin, Ohio to facilitate and promote public
transportation;
WHEREAS, the Central Ohio Transit Authority ("COTA") desires
to provide to the residents of the City of Dublin, Ohio
transportation services to and from the residents' homes
("Portal-to-portal Program");
WHEREAS, COTA desires to provide the opportunity for the
residents of the city of DUblin, Ohio to embark and disembark
COTA buses at locations other than regularly established bus
stops after dusk ("Night stop Program");
WHEREAS, Section 351.10 of the Codified Ordinances of the City
of Dublin, Ohio must be amended in order for COTA to implement
the Portal-to-Portal and Night stop Programs in the City of
Dublin, Ohio;
WHEREAS, Council finds that it is in the best interest of the
residents of the city of Dublin, Ohio to facilitate the
Portal-to-Portal and Night stop Programs of COTA;

stop Programs promote the health, safety and welfare of the
residents of the City of DUblin, Ohio.

ROW, THEREPORB, be it ordain~ by the Council of the City of
Dublin, State of Ohio, members concurring:
Section 1. Section 351.10 of the Codified Ordinances of the
city of Dublin, Ohio shall be amended to read as follows:
(a) No person shall stop, stand or park a
vehicle other than a bus at a bus stop,
or other than a taxicab at a taxicab
stand, when any such stop or stand has
been Officially designated and
appropriately posted, except that the
driver of a passenger vehicle other than
a bus or taxicab may temporarily stop at
a bus stop or taxicab stand for the
purpose of and while actually engaged in
loading or unloading passengers provided
such stopping does not interfere with any
bus or taxicab waiting to enter or about
to enter such zone; such stopping does
not exceed a period of three minutes; and
_.~ such stopping is not prohibited by posted
signs.

(b) Except in the case of an emergency, the
operator of a bus shall not stop, stand
or park such vehicle upon any street at
any place for the purpose of loading or
unloading passengers and their
baggage other than at a bus stop so
designated and posted as such. Provided,

however, the operator of a bus owned and

may temporarily stop the bus, in accordance
with all other ordinances governing stopping
- or parking, at locations other than designated
bus stops for the purpose of and while engaged
in the expeditious loading or unloading of
passengers and their baggage.
(c) When an operator of a bus stops the bus
on a street, the right front wheel of the
bus shall not be more than eighteen
inches from the curb and the bus shall be
approximately parallel to the curb so as
not to unduly impede traffic.
(d) The operator of a taxicab shall not stand
or park such vehicle upon any street at
any place other than at a taxicab stand
so designated and posted as such except
that the operator of a taxicab may
temporarily stop the taxicab, in
accordance with all other ordinances
governing stopping or parking, at
locations other than designated taxicab
stands for the purpose of and while

Section 3. This Ordinance shall take effect on the earliest
date permitted by law.

Backqround
The Central Ohio Transit Authority ("COTA") is planning
to implement two programs to improve its service.
COTA is planning to establish a program known as the
"Night stop Program" in which COTA buses would stop at places other
than assigned bus stops after dusk and at off-peak hours.
COTA is also planning to establish a program known as the
"Portal-to-Portal Program" in which COTA would provide service
directly to and from passengers' homes. COTA has told us that they
would use smaller (25-foot) buses to serve as feeders to its
regular routes. Unlike the Night stop Program, the
Portal-to-Portal Program would not be limited to any particular
times of the day.
COTA intends to implement these programs if the COTA levy
passes in November of this year.

e In order for COTA to implement these programs in the City
.... of Dublin, Section 351.10 of the Codified Ordinances of the City of
Dublin, Ohio must be amended. Attached is an ordinance entitled
"An Ordinance to Amend Section 351.10 of the Codified Ordinances of
the City of Dublin, Ohio." Language which we propose to add
appears in bold, and language which we propose to delete appears in
strikeout.
We recommend amending Section 351.10(b) to permit buses
operated by the City or a transit authority (such as COTA) to
temporarily stop at locations other than officially designated bus
stops. Currently, Section 351.10 permits buses to stop only at
assigned stops.

We also recommend amending section 351.10(c) to require
buses to park within eighteen inches of curbs at all locations.
Currently, this requirement applies only to buses parked at bus
stops.
In addition, we propose minor grammatical changes in
Section 351.10 to improve clarity and consistency.
