WHEREAS, after conducting formal advertising and -- competitive bidding procedures for a new skid-mount seed/mulch sprayer; and, WHEREAS, Council has determined that the bid submitted by the Finn Corporation, in the amount of $20,994.00, for said equipment is the lowest and best bid; NOW, THEREPORE, BE IT ORDAINED by the Council of City of DUblin, state of Ohio 7 of the elected members concurring: section 1. That the bid submitted by the Finn Corporation, in the amount of $20,994.00, for the above mentioned equipment is hereby accepted. section 2. That the City Manager is hereby authorized to enter into a contract with the Finn Corporation for the procurement of said equipment as specified within said bidder's bid proposal on file in the Division of Personnel and Purchasing. Section 3. That this Ordinance be, and hereby is, declared ~ to be an emergency measure necessary for the preservation of the public health, safety, and welfare in that two major seeding projects will be initiated in the immediate future ~ and this equipment is critical to completion of the projects in a timely and effective manner. IIQ IIQ .. .. MEMORANDUM ml Members of Dublin City Council FROIII Timothy C. Hansley, City Manager / SUBJECT I Skid-Mount Seed/Mulch Sprayer Bid Process DATE I April 4, 1995 BYI David L. Harding, Director of Personnel & Purchasing ~ ,,e,,,,*' Attached for your consideration please find Ordinance No. 27-95 accepting the lowest and best bid for a new skid-mount seed/mulch sprayer. Also attached for your review is a copy of the bid tabulation form. This bid process involves the purchase of a specialized piece of equipment designed for large-scale seeding and/or mulching projects and is intended for use primarily in the development of parkland or other related areas. $25,000.00 was recently approved for the purchase of this equipment in the 1995 Capital Budget. In addition to our standard practice of formally advertising the bid notice in a newspaper of general circulation, staff also mailed bid documents directly to the vendors on our mailing list. Although four vendors expressed interest in the bid process initially, the City only received a bid from the Finn Corporation. In seeking to validate the reasons others chose not to submit a bid, staff contacted the company regarded as Finn's primary competition and learned that they simply did not feel they could be competitive in their pricing given their shipping and delivery costs. Although the City received only one bid for the specified equipment, staff believes that the bid submitted by Finn Corporation is a good bid, since it was submitted as part of an openly publicized competitive process. In addition, given staff's earlier research during the specification development phase of the process, Finn's bid price seems to be in line with the going market price for this type of equipment. Staff also believes Finn's bid to be responsive in that it contains no deviations from the City's equipment specifications. Furthermore, staff believes the Finn Corporation to be an established, reliable vendor in this region. Again, in researching the market earlier in the process, staff identified Finn as one of several reliable manufacturers of this type of equipment and also as one whose manufacturing facility is located in Ohio. In the final analysis, staff believes that accepting the bid from the Finn Corporation, in the amount of $20,994.00, would be in the best interest of the City and, therefore, hereby recommends that said bid be accepted. Please note that Ordinance No. 27-95 has not been drafted as emergency legislation; however, staff would respectfully request that Council consider such as emergency legislation at the April 24, 1995 Council Meeting. Staff believes that emergency passage at that time would be justified for the reason that there are two major spring seeding projects on the horizon and this equipment is deemed to be critical in completing said projects in a timely and efficient manner. Given the timeframe for delivery of thirty (30) days after receive of order, there is a legitimate need to get the equipment ordered as soon as possible. Mr. Fred Hahn, Parks Administrator, will be in attendance at the Council Meeting On April 10, 1995 in the event you have any questions concerning the technical details of this equipment.
