Readler, Assistant Law Director DATE: May 1, 2014 RE: Ordinance No. 39 -14 - Boundary Adjustment Petition INTRODUCTION As you know, the City of Dublin and Washington and Jerome Townships have been working for several years to resolve issues surrounding the provision of fire and EMS services to Dublin residents whose properties are also located within Jerome Township in the Tartan Ridge subdivision. At the April 28 City Council meeting, an annexation agreement between these entities was introduced at first reading, with second reading at the May 5 meeting. The Jerome Township Trustees approved the annexation agreement on April 25, 2014 and the Washington Township Trustees are scheduled to take action on the annexation agreement at their May 13, 2014 meeting. This boundary adjustment petition is a follow up to the annexation agreement. The boundary adjustment petition will be filed with the Union County Commissioners and, if granted, will move the boundaries for the properties attached to the petition from Jerome Township to Washington Township. The annexation agreement will be filed with the boundary adjustment petition. BOUNDARY ADJUSTMENT PETITION Ohio Revised Code Section 503.07 provides the authority for the City to file a boundary adjustment petition and the County Commissioners to approve the petition. A boundary adjustment petition must be submitted to the Board of County Commissioners where the territory is located (in this case, Union County). In the present situation, since an Expedited Two annexation was used, boundaries can only be adjusted through the agreement of the Townships and the City. In order to file such a boundary adjustment petition, a vote of the majority of the members of Council to petition the Board of County Commissioners for a change of township boundary lines is necessary. The Board of County commissioners, upon presentation of such petition, with the Memo re. Ordinance 39 -14 — Boundary Adjustment Petition May 1, 2014 Page Two proceedings of the City Council authenticated, at a regular or adjourned session, shall change the boundaries of the township. RECOMMENDATION The Law Department recommends approval of Ordinance 39 -14 by emergency action at the second reading/public hearing on May 19, 2014. RECORD OF ORDINANCES Dayton Legal Blank. Inc. WHEREAS, on August 22, 2005, the Union County Commissioners approved the petition for annexation of 82.3 + /- acres, more or less, in Jerome Township, filed as an Expedited Type II Annexation petition by Harrison W. Smith, Jr., Agent for the Petitioners, Suburban Improvement of Columbus, Inc., c/o Ben W. Hale, Jr., 37 West Broad Street, Suite 275, Columbus, Ohio 43215 and Cheistoff P. and Sandra Sue I Steuerwald, 9955 Sylvian Drive, Dublin, Ohio 43017; and I WHEREAS, Dublin accepted the above - referenced annexation area, which is located within the boundaries of Jerome Township northwest of the intersection of McKitrick Road and Jerome Road, and which is more particularly described and depicted in Exhibit A attached hereto and incorporated herein by reference ("the Property'l; and WHEREAS, under an Expedited Type H Annexation, real property that is annexed to a municipal corporation from a township is not to be excluded from the township under Ohio Revised Code Section 503.07, absent an agreement to the contrary that is executed by both the municipality and the township; and WHEREAS, the City of Dublin and Jerome and Washington Townships have executed an Annexation Agreement pursuant to Ohio Revised Code 709.192, which is attached hereto as Exhibit B and incorporated herein by reference, consenting to removing the Property from the Jerome Township Boundaries and moving the Property to the Washington Township Boundaries in order to facilitate the provision of fire and EMS services by Washington Township, and ensuring the ability of Washington Township to impose levies to compensate it for providing the services; and WHEREAS, Ohio Revised Code Section 503.07 authorizes the Dublin City Council to petition the Board of County Commissioners of Union County to change the township boundaries within the municipal corporation; and WHEREAS, the procedure set forth above has been upheld by the Ohio Supreme Court in the case of State, ex rel. Clty of Dublin v. Delaware County Board of Commissioners, 62 Ohio St.3d 55, 577 N.E.2d 1088; and WHEREAS, Washington Township has the largest area of township jurisdiction within the City of Dublin; and WHEREAS, Washington Township has fully equipped and staffed fire stations and can respond to fire and medical emergencies in the Jerome Township portion of the City of Dublin. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring that: Section 1. The City of Dublin, Ohio, an Ohio Municipal Corporation, hereby petitions the Board of County Commissioners of Union County, Ohio, for a change of township lines of Jerome Township to remove that area included within the corporate limits of the City of Dublin, as shown on the attached Exhibit A, from Jerome Township and place it in Washington Township pursuant to Ohio Revised Code 503.07 and related sections, as well as the case law noted herein, and pursuant to the Annexation Agreement executed between the City of Dublin, Jerome Township and Washington Township under Ohio Revised Code 709.192 attached hereto as Exhibit B. 39 -14 RECORD OF ORDINANCES Ordinance No. 39 -14 Form No. 30043 Page 2 of 2 Passed . 20 I Section 2. The Clerk of Council is hereby authorized and directed to certify a copy of this Ordinance, together with a certified copy of the minutes of the meeting at which this Ordinance was adopted, showing its adoption by a vote of the majority of the members of the Dublin City Council, being the "legislative authority of such Municipal Corporation" as set forth in Ohio Revised Code Sections 503.07 and 709.192, to the Board of County Commissioners of Union County, Ohio. The City Law Director is hereby authorized and directed to present a certified copy of this Ordinance and a certified copy of the minutes of this meeting to the Board of County Commissioners of Union County, as a petition praying for such changes to the boundary lines of Jerome Township as set forth herein.
