Vice Mayor Gerber called the Monday, May 5, 2014 Regular Meeting of Dublin City
Council to order at 6:30 p.m. at the Dublin Municipal Building.
ADJOURNMENT TO EXECUTIVE SESSION
Vice Mayor Gerber moved to adjourn to executive session to discuss land acquisition
matters and legal matters.
Ms. Chinn ici-Zuercher seconded the motion.

The meeting was reconvened at 7:00 p.m.
ROLL CALL
Members present were Vice Mayor Gerber, Ms. Chinnici - Zuercher, Mr. Lecklider, Mr.
Peterson, Ms. Salay and Mr. Reiner. Mr. Keenan was absent (excused).
Staff members present were Ms. Grigsby, Mr. Smith, Ms. Readler, Mr. McDaniel, Ms.
Mumma, Ms. O'Callaghan, Chief von Eckartsberg, Mr. Wagner, Ms. Gilger, Mr. Gracia,
Mr. Hahn, Mr. Langworthy, Mr. Edwards and Mr. Kridler.

SPECIAL PRESENTATIONS
• Dublin Counseling Center and Dublin City Schools
Julie Rinaldi, 7971 Riverside Drive, Executive Director, Dublin Counseling Center
addressed Council, together with Dublin Schools Superintendent Todd Hoadley.
Ms. Rinaldi stated that they are present tonight to thank Council for their support.
Shortly after she assumed her duties in 2009, some requests to respond to community
crisis incidents were received by the Counseling Center. They were not able to assist,
as the Center did not have any staff trained in crisis response at that time.
Thereafter, they approached Council regarding some special funding so that their staff
could be trained in crisis response. There are now 13 staff members who are well
trained in community crisis response and they have been utilizing these services on a
regular basis for the past couple of years. They enjoy a strong partnership with
Dublin City Schools, and work in tandem with them during a crisis situation at the
school system.
Superintendent Todd Hoadley, Dublin City Schools thanked Council for the funding
provided for this training. The Schools often contact Dublin Counseling Center in crisis
situations, and several have occurred this year, including the deaths of students from
automobile accidents. This is very impactful on a large number of young adults and is
a difficult and challenging situation. They are very appreciative of this specialized
counseling partnership with the Dublin Counseling Center. The substance abuse and
mental health specialized counseling is also very important, as the Schools do not have
the specialized personnel in the quantity necessary to meet the need. Having these
resources within the community is very valuable to the school system. On behalf of
the Schools, he thanked City Council for their support.
Vice Mayor Gerber thanked Ms. Rinaldi for all that the Counseling Center provides to
the community. This is yet another example of their effective partnerships within the
community.

• Introduction of Police Chaplain
Chief von Eckartsberg introduced Dave Schutter, who is the Senior Pastor at
Northwest Presbyterian Church and who has volunteered to join the Chaplaincy
Program at the Police Division. This program has been in place since 1990 at the City,
and they are looking forward to having him join the group. Pastor Schutter is an
experienced Police Chaplain who previously served with the Naperville, Illinois Police
Department. He also served 12 years in the Army Reserves as a Chaplain and saw
active duty in Afghanistan.
Pastor Schutter thanked him for the introduction. As a minister in Dublin, he is
invested in the welfare of the City in many different ways. As a Chaplain for the Police
division, it will be a great opportunity to "serve those who serve." It is a privilege to
do so.
Mayor Gerber thanked him and welcomed him as a Police Chaplain.
CITIZEN COMMENTS
There were no citizen comments on items not on the agenda.
CONSENT AGENDA
(Items proposed for the Consent Agenda are acted upon by a single motion and vote
of Council. However, upon request of a Council Member, any proposed Consent
Agenda item may be removed from the Consent Agenda for further
discussion /consideration under the regular order of business.)
Mr. Lecklider requested a correction to the minutes of the April 28, 2014 meeting. On
page 5 of 15, in discussion of Ordinance 22 -14 with respect to adult care facilities, his
intent in his motion was to remove this item from the meeting agenda for that evening
to allow Council more time for thoughtful consideration of the matter — not to
discontinue any consideration of a dispersal ordinance. He requested that this intent
be reflected in corrections to the minutes.
Brief discussion followed.
Mr. Lecklider added that this correction to the record would eliminate the necessity of
this matter going back to the Planning and Zoning Commission. It was not his intent
to start anew, with referral of a new ordinance to the Commission for their
consideration.
Ms. Grigsby clarified that her understanding of this correction is that Ordinance 22 -14
is postponed to the June 9 meeting — it was not withdrawn from any future
consideration, but only from the April 28 agenda.
Mr. Lecklider agreed. It was not his intent to take action on the ordinance, other than
to remove it from that evening's agenda in order that Council could more thoroughly
consider it.
Council agreed to this correction of the record.
Vice Mayor Gerber moved approval of the actions for the six items listed on the
consent agenda, including the corrections to the minutes of the Council meeting of
April 28.

POSTPONED ORDINANCE
Ordinance 21 -14
Rezoning Approximately 4.6 Acres, Located on the East Side of Coffman
Road, North of Forest Run Drive at the Current Stub of Nature Drive from R,
Rural District to R -2, Limited Suburban Residential District and Approving a
Preliminary Plat to Create Four Residential Lots Requiring a Preliminary Plat
Variance to the Required Right -of -Way and Pavement Widths. (Case 13-
115Z/PP) (Bremlee Estates)
Ms. Husak stated that Council had requested follow -up on some items at the
introduction of the ordinance.
1. Maintenance of the bioswale
2. Homeowner Association membership as it pertains to the Woods of Indian Run.
Staff has included information regarding the maintenance of the bioswale, as well as
some description of that provided by the applicant. The estimate is that the cost to
maintain the bioswale is $800 -1,000 annually that would be split among the four
proposed lots.
In addition, she provided a locator map for the proposed rezoning, which lies just
north of Nature Drive. The Bremlee Estates residents would have access to their lots
via the main entrance for the Woods of Indian Run at Coffman Road and Forest Run
Drive. The Woods of Indian Run also has an entry feature at Coffman Road.
The applicant's representative is present to respond to any further questions.

Staff recommends approval of the plat with the rezoning; a condition is proposed to
ensure the HOA membership and maintenance of the bioswale issues are addressed.
Jack Reynolds, Smith & Hale, 37 W. Broad Street,, representing the applicant stated
that they are hopeful that all questions concerning the development of these four lots
have been resolved. At the last hearing, he made the representation that they would
ensure that the deed restrictions affecting these four lots would work in conjunction
with those of the Woods of Indian Run. He has spoken to the attorney working on the
deed restrictions, and they will be ready for the final plat review. He offered to
respond to any questions, noting that Jeff Strung of EMH &T is present to respond to
questions about the bioswale.
There were no further questions or comments.

SECOND READING /PUBLIC HEARING - ORDINANCES
Ordinance 24 -14
Amending Section 2 (Wage and Salary Structure /Administration),
Paragraph A, of Ordinance No. 73 -06 ( "Compensation Plan for Non -Union
Personnel ") for the Purpose of Incorporating Certain lob Classifications and
Corresponding Pay Grades as Addressed in the 2014 Operating Budget.
Mr. Wagner stated that he could respond to any questions regarding the amendments.
Vote on the Ordinance: Vice Mayor Gerber, yes; Mr. Reiner, yes; Ms. Salay, yes; Mr.
Peterson, yes; Ms. Chinnici - Zuercher, yes; Mr. Lecklider, yes.
Ms. Grigsby asked for confirmation that the approval of the ordinance also includes
waiving the competitive selection process for this position.
Council concurred.
Ordinance 26 -14
Authorizing the Appropriation of a 0.155 Acre, More or Less, Present Road
Occupied Fee Simple Interest; a 0.045 Acre, More or Less, Permanent Slope,
Grading And Drainage Easement; and a 0.037 Acre, More or Less, Temporary
Easement from lack K. Beatley, for the Property Located at 6713 Glick Road
for the Construction of a Multi -Use Path as Part of the Glick Road Phase 3
Project.
Ms. Grigsby stated that the easements and right -of -way from this property are needed
for the construction of a portion of the Glick Road Multi -Use Path. Discussions with
the property owner have continued, but terms have not been agreed upon at this
point. Staff therefore recommends approval of the legislation in order to continue the
eminent domain process. Staff will continue to work with the property owner in the
hope of coming to agreement at a future date.
Vice Mayor Gerber invited public testimony.
Kevin Humphreys, 332 West Sixth Avenue, Columbus, OH 43201 noted that he is
present on behalf of Mr. Beatley. He stated that they learned of this issue about a
year ago when the stakes were place on the property. They had some discussions
with Ms. Grigsby and Ms. Ott at that time and met with them on site to show them
various characteristic issues that were unique about Mr. Beatley's home that he has
owned for 18 -19 years. The home is within 15 feet of the proposed path. In a more
recent discussion with Mr. Hartmann, the City's legal counsel, they have talked of the
City purchasing the entire property. When he spoke with Mr. Hartmann today, he
indicated that alternatively, it was Mr. Beatley's intention to develop the property at
some point. He is potentially considering this alternative. Another way to resolve with

matter, which would be consistent with the highest and best use of the property,
would be to submit a PUD or rezoning application to make accommodation for the
multi -use path as well as make meaningful use of the property. The present function
of the property would not fit with the proposed multi -use path as laid out by the City.
He requested that Council consider giving them more time by tabling this matter. He
deferred to Mr. Beatley to comment on the factual issues and constraints. He offered
to respond to any questions.
Mr. Reiner stated that in looking at the site, he is not certain what kind of PUD could
be accommodated. It is possible to build another home on the site, but it is
surrounded by residential zoning. The owner's expectations for the site may be too
high. The City has been working to have the path completed due to the dangerous
roadway and lack of pedestrian paths to accommodate those traveling to the Schools
and the Columbus Zoo. The City is working to accelerate the conclusion of this project
due to the safety issues. He asked what Mr. Beatley's expectations are for
development of his property.
Mr. Humphreys responded that there is an existing bikepath located immediately
behind Mr. Beatley's property to the south, as well as a path across the street. A
concern he would have is that Mr. Beatley's property is surrounded by Muirfield
residents to the north and to the south, and those are the people who are using the
existing path system. It appears that the City path is duplicative in view of the
existing paths that serve the people.
Mr. Reiner noted that the paths he refers to are private paths for use only by the
Muirfield residents. They are not designed for public use and under the Muirfield
Association liability insurance policy, the general public is not allowed to use these
private paths. The path planned for Glick Road will be a public path to move people
east to west across the entire distance of north Dublin. The path is now constructed
on either side of Mr. Beatley's property. The issues are the safety considerations for
people and their need to travel east and west in this portion of the City. That was the
conclusion of a two -year study by a group of citizens (the Bicycle Advisory Task
Force). It is important to complete this path for safety reasons.
Mr. Humphreys stated that in this case, the present home on the property does not fit
well with the planned route for the path.
Vice Mayor Gerber stated that it is unlikely this matter can be resolved tonight.
Mr. Lecklider stated that the City is in the process of installing a multi -use path along
Brand Road. From the perspective of the homeowners, Council and City staff, the
path along Brand Road is having as much impact on property owners as the Glick
Road path would have on Mr. Beatley's property. In no instance did the City acquire
anyone's entire property for the Brand Road path. The Glick Road multi -use path has
a public purpose, and not just to serve those who live on adjacent streets. Personally,
he lives in another area of Dublin, but as a cyclist, welcomes the opportunity to travel
safely along Glick Road on this completed path. With respect to a rezoning, it is Mr.
Beatley's right to file such a petition. However, to change from one property with one
home to four separate properties with four homes needing ingress and egress onto
Glick Road would be a high bar to clear, in his view.
Ms. Chinnici - Zuercher asked what Mr. Humphreys' relationship is to Mr. Beatley.
Mr. Humphreys responded that he is legal counsel to Mr. Beatley.
Vice Mayor Gerber noted that Mr. Beatley has also signed in to speak, but he assumes
he will not speak — as Mr. Humphreys has addressed Council on Mr. Beatley's behalf.

Mr. Humphreys commented that he was speaking to the meeting held with Mr.
Hartmann today and procedural matters. Mr. Beatley can speak to the facts as it
relates to the path and his property.
Jack K. Beatley, 6713 Glick Road, Dublin stated that he has been at this address for
16 -17 years. During that period of time, as far as he is aware, no one has been killed
on Glick Road. He has not witnessed a child riding to the zoo on the roadway. He
finds those comments ridiculous. There is a very competent bikepath located directly
behind his property and the City should use eminent domain to take that path, if the
City believes one is needed, or should build one on the north side of Glick Road. To
build a path 15 feet from his bedroom window and to cut down trees on Glick Road is
ridiculous. This is an example of an engineer taking a ruler on a map and drawing a
straight line instead of accommodating and making a correct engineering choice. No
one wants to ride a bike along Glick Road, but people do like to ride along the woods
by the creek. In addition, on Emerald Parkway, there are marked bike lanes on the
street, but it is dangerous to ride in that area. Building a bikepath at this location near
an existing house is wrong. He does not want the path near his house, and Council
would not want the path near their houses. He noted that there are several agenda
items relating to taking people's property to build these multi -use paths. Apparently,
the input of the public does not mean anything.
Vice Mayor Gerber responded that he has been invited to provide public testimony,
and Council is listening.
Mr. Beatley stated that in all the years he has lived in Dublin, he has never been
invited to one meeting about the bikepath going through his front yard. There was no
notice provided and one day, people put stakes in his yard. There was no
communication from the City.
Ms. Chinn ici-Zuercher responded that his attorney has indicated Mr. Beatley had
meetings with Ms. Ott.
Mr. Beatley responded that a meeting was held a year ago. The first he was aware of
a path being planned was when he noticed the stakes in his yard. Prior to that, there
was no contact or notice to him.
Ms. Chinnici - Zuercher responded that he has lived in Dublin a long time and must
have observed there are bikepaths throughout. It is Council's intention to have the
ability for anyone to ride their bike or walk throughout the community. Generally,
meetings are not scheduled with the residents until the property is staked and staff
knows what easements are needed.
Mr. Beatley stated that if the City pursues this current course, there will be three
bikepaths on Glick Road, and one is more than adequate.
Ms. Grigsby stated that staff is recommending that Council approve this ordinance
tonight. Staff will continue to have discussions with the property owner regarding the
project.
Vice Mayor Gerber responded that this is the consistent message he has heard tonight
about easements and property needed for the multi -use path — that even after
legislation is approved for eminent domain, the City will continue to work toward a
resolution with the property owner.
Ms. Grigsby stated that is correct.

Authorizing the Appropriation of a 0.015 Acre, More or Less, Permanent
Easement; and a 0.048 Acre, More or Less, Temporary Easement from
Darrell L. Cramblit and Victoria L. Cramblit, for the Property Located at 355
South High Street for the Construction of a Multi -Use Path as Part of the
Dublin Road South Phase 3 Project, and Declaring an Emergency.
Ms. Grigsby stated that at this point, ongoing discussions are being held with the
property owner. Staff believes that agreement has been reached for the appraised
amount. There are a few minor modifications regarding the driveway and how the
path is connected to the driveway. Staff is hopeful that the documents can be
executed within the next week and that there will not be need to move forward with
this process. This ordinance allows the execution of the documents and to have the
closing on the property.

today, and is hopeful of coming to terms.

to Expand the Scope of Permissible Political Activity for City Employees.
Mr. Lecklider introduced the ordinance.
Mr. Wagner stated that the purpose of this ordinance is to update the current Code
regarding political activity for City employees. It will permit employees to exercise
more freely their First Amendment rights. As part of the collective bargaining
negotiations, the need for these amendments became apparent, as the Code
provisions were inconsistent with what had been negotiated in the Steelworkers and
FOP bargaining agreements. The Code will now align with those agreements. Staff

Ordinance 37 -14
Amending Section 33.67, Political Activity, of the Dublin Code of Ordinances
Ms. Chinnici - Zuercher asked for clarification. Is this for all employees or for bargaining
units only?
Mr. Wagner responded that the amendments relate to all non - bargaining unit
employees. The political activity rights of the bargaining unit employees are already
negotiated in their contracts.
There will be a second reading /public hearing at the May 19 Council meeting.
Ordinance 38 -14
Authorizing the Provision of Certain Incentives to Everhart Financial Group
Inc., dba Everhart Advisors to Induce it to Retain a Main Office and
Associated Operations and Workforce within the City, and Authorizing the
Execution of a Development and Real Estate Purchase Agreement.
Mr. Lecklider introduced the ordinance.
Mr. Garcia stated this is an amended agreement for Everhart Advisors. Staff briefed
Council in February about Everhart's plans to build a new corporate headquarters in
Dublin. Everhart subsequently decided upon an alternative site, and this new proposal
details the real estate purchase agreement for the parcel identified for their new
corporate headquarters and the economic development incentives related to that
project. He offered to respond to questions.
Ms. Chinnici - Zuercher noted she is pleased that they will have their corporate
headquarters in Dublin. This is actually a better site than the one they had previously
identified.
Vice Mayor Gerber agreed.
Mr. Gracia noted that the company representatives would be present at the next
hearing.
There will be a second reading /public hearing at the May 19 Council meeting.
Ordinance 39 -14
Petitioning the Board of County Commissioners of Union County, Ohio for a
Change of Township Lines of Jerome Township for that Portion which Now
Lies within the Corporate Boundaries of the City of Dublin, and Declaring an
Emergency.
Ms. Salay introduced the ordinance.
Ms. Readler stated that this is a follow -up to the annexation agreement that
was approved earlier on tonight's agenda. This ordinance authorizes the Law
Department to file a boundary adjustment petition with the Union County
Commissioners for the property in Tartan Ridge that is currently within Jerome
Township. The petition will move the territory from Jerome Township to
Washington Township and allow Washington Township to provide fire and EMS

service. Staff is recommending approval at the May 19 Council meeting. She
offered to respond to questions.
Vice Mayor Gerber noted that emergency action would be requested at the next
reading. He asked for clarification.
Ms. Readler responded that staff is requesting passage by emergency in order
to have it effective upon passage versus 30 days after passage. Following
passage by emergency, the petition can be filed immediately with the
Commissioners. Jerome Township has already approved the annexation
agreement, and Washington Township is scheduled to approve it shortly.
There will be a second reading /public hearing at the May 19 Council meeting.
Ms. Salay asked what would occur with any future annexation of the remaining portion
of Jerome Township that lies in Dublin's service area.
Ms. Readler responded that the agreement adopted tonight between the City,
Washington Township and Jerome Township addresses the Tartan Ridge area that is
currently within the City of Dublin /Jerome Township. Prospectively, there are a couple
of options. Future annexations could be handled through the Regular annexation
petition process that allows township boundary changes, or an annexation agreement
could be done regarding future annexations in this area. In addition, there are still
issues related to the provider of water and sewer service for these potential future
annexations.
STAFF COMMENTS
Ms. Grigsby reported that on Monday, May 12, a Council workshop is scheduled to
review the proposed Crawford Hoying development along both the east and west sides
of the Scioto River in the Bridge Street District. At staff level, there has been
discussion of the desire to have the session videotaped so that it would be available
for public viewing and the potential to have the meeting live streamed — if Council
desires. If the workshop were live streamed, the set -up would be in the format of a
regular Council meeting, using the dais, because of the location of the cameras. She
asked for Council feedback.
Ms. Chinn ici-Zuercher responded that she is supportive of the live streaming, in view
of the nature of this major project for Dublin. It would be helpful if residents can view
it live versus watching a tape recording of the meeting.
Ms. Salay added that from the perspective of the Planning and Zoning Commission,
they are interested in having the opportunity to watch a videotaped meeting — in case
they are not able to attend a workshop. In fact, they had asked her to bring this up
tonight.
COUNCIL COMMITTEE REPORTS
Ms. Salay, Council representative to the Planning & Zoning Commission reported:
1. The Commission indicated that they would make every effort to attend the
future Bridge Street District workshops, but would welcome the opportunity to
watch a videotape if they cannot attend. They all expressed great interest in
the traffic presentation and asked that the presentation be given to the
Commission as well. Ms. Newell was the only Commission member who was
able to attend the workshop where it was presented, due to the short notice.
Having the presentation at the Commission in the near future will be very
helpful and information to them going forward.
2. The Commission reviewed the signage package for Ohio University campus,
and the Commission asked that it be tabled to allow Ohio University to continue
to work with staff on the package. The University was agreeable to this.

3. They provided informal feedback to Mr. McDaniel and staff on the proposed
Emerald 8 office building. It was a spirited discussion and involved many of the
neighbors.
Mr. Reiner, Chair, Community Development Committee reported that the Council
packet included the recommendations provided to the Community Services Advisory
Commission for agenda items. The CSAC members are to select the items they are
interested in moving forward. The May meeting is their second meeting with the
enlarged group.
Vice Mayor Gerber, Chair, Administrative Committee stated that two items are pending
for the Committee: 1) a review of the Charter update memo; and (2) interviews for
the Personnel Board of Review. He will contact the other members of the Committee
to determine available dates for these two meetings in the May /June timeframe.
COUNCIL ROUNDTABLE
Mr. Reiner thanked all who supported the Dublin Arts Council Garden Party. It was
very successful and enjoyed a large turnout.
Vice Mayor Gerber
1. Encouraged everyone to attend the annual Police Memorial service, honoring all
who have died or been injured in the line of duty. The service is scheduled for
Thursday, May 8 at 1 p.m. at the Dublin Justice Center.
2. Reminded Council members of the board and commission recognition event at
The Country Club at Muirfield on Wednesday, May 14 beginning at 6 p.m.
3. Noted that as previous Mayors have done, he attended the Seventh Annual
African American Academic Recognition and Scholarship Program at Dublin
Coffman High School on Thursday evening. It was well attended and honored
some very remarkable students who work hard and are performing well. Our
future is in good hands!
