AN ORDINANCE TO ACCEPT AN ANNEXATION OF
139.183+/- ACRES IN WASHINGTON TOWNSHIP
,.... TO THE CITY OF DUBLIN
"- WHEREAS, said annexation has been approved by the Franklin
County Commissioners, and Council is of the opinion that said
territory should be annexed.
NOW, THEREFORE BE IT O~NED by the Council of the City of
Dublin, state of Ohio, of the elected members concurring:
Section 1. That the petition for the annexation of 139.183+/-
acres (see attached legal description) to the City of Dublin,
Ohio is hereby accepted.
Section 2. That this Ordinance shall take effect and be in
force from and after the earliest period allowed by law.
Passed this ;(O~ day of h-' 1992.

should not cause any problem in your annexation procedures. If
this were a deed transfer it would cause a problem for the auditor

I represent the property owner of a 100 acre parcel located at
the corner of Hayden Run Road and Avery Road in Washington
Township. This parcel is South of the Young Life Foundation Land
which is subject to a recent annexation request.
My client is also interested in joining in the annexation
petition subject to Dublin being able to provide waste and sewer in
the near future.
Under Columbus 1986 WIN WIN agreement my client is convinced
that with any future annexation to ColUmbus he would suffer
significant financial. losses. The highest and. best use of my
clients land is Single Family Residential not Industrial or
Commercial zoning. Therefor, schools are one of the major keys to
a, successful development. Since WIN WIN in 1986 Single Family land
in the Columbus School District have in the majority of cases seen
a severe decrease in land value.
Please consider the aforementioned matter and the surrounding
property owners in considering the Young Life Foundation request
for annexation to Dublin. Until Columbus resolves, solves or
eliminates WIN WIN there is not motivation to annex to Columbus for
Single Family Development.

Dear Mr. Clarke:
Thank you for your letter of February 10, 1992 to Commissioner Teater. Commissioner Foulk
asked me to acknowledge your correspondence.
As you know, the Ohio Revised Code generally favors the landowner in determining which
community he may annex to. In that regard, your client has essentially the freedom to chosc to anncx to
Dublin if the land lics contiguous to the City. This, is the "general good of the territory sought to be
annexed" in ORC 709.033. Howcver, the Commissioners must also be convinced that the level of services
anticipated can actually be provided for the general good of the territory to be annexed. In cases
complicated by intcr-municipal service agreements, as this onc is, the Commissioners may feel the nced
to request and revicw additional information prior to making a decision. By deferring this casc to their
April 1st hearing, the Commissioners have allowed themselves ample time to evaluate comments such as
yours.

'- Now comes Laurence L. Eberhart, being first duly sworn, and
deposes and states that to the best of his knowledge and belief:
1. I am a duly elected and acting Township Trustee for
Washington Township, Franklin and Delaware Counties, Ohio.
2. I am the current Chairman of the Board of Township
Trustees of Washington Township.
3. The Township Trustees of Washington Township, Franklin
and Delaware Counties, Ohio support the above-referenced
annexation as being for the general good of the territory sought
to be annexed within the meaning of R.C. 709.033.
4. The primary reason the Township Trustees support the
annexation is that fire department jurisdictional boundaries
would not change and Washington Township would continue to
provide fire and emergency medical services to the territory.
5. Washington Township Fire Station No. 91 is located 1.8
miles from the Young Life Foundation property and response times
are in the range of 3 - 5 minutes.
6. If the annexation is approved, Washington Township would
also continue to provide fire prevention services to the
....... territory.
7. If the annexation is approved, there would also be
continuity in terms of education and zoning. The territory would
remain in the Hilliard City School District and Washington
Township zoning regulations are comparable to those of the City
of Dublin.

Dear Franklin County Commissioners:
The City of Columbus wishes to thank the Commissioners for
granting a 30-day continuance before further hearing on this
request for annexation to the Ci ty of Dublin by the Younglife
Foundation. During this thirty days, Dublin and Columbus
continued to seek solutions to the various issues that the two
communities need to bring to resolution.
The City of Columbus wishes to be on record that these issues have
not been completely resolved and that approval of this annexation
jeopardizes the corridor option previously discussed by Dublin and
Columbus.
Therefore, the City opposes this annexation until such time that
these issues have been resolved, and requests that further
hearings be postponed until that time.

Dear Mr. Hornbeck:
Enclosed is a copy of the resolution adopted on October 29, 1991, by the
Board of County Commissioners, setting the time and place of public hearing
for the annexation petition which you, as agent, filed with this office
on October 11, 1991.
Under the provisions of Section 709.03 and 709.031 of the Ohio Revised
Code, you, as agent, are responsible for the following:
(1) Notification of the date of filing of your petition with the Board
"'" of County Commissioners to be delivered to the Clerk of the
municipality to which annexation is proposed and the clerk of
each township which is included in the annexation. (A map,
description and a copy of the petition should be presented to
each clerk).
(2) Publication of the substance of the petition once a week for four
consecutive weeks in a newspaper of general circulation in the
County. (The enclosed resolution will satisfy the statutory
requirements and should be used for the published notice).
(3) Service upon the municipal and township clerks of a copy of the
notice within seven (7) days after the Franklin County Commissioners
set the date for the pub lic hearing on the annexation petition,
is on or before November 5, 1991. (The enclosed resolution will
satisfy the statutory requirements and should be used to serve
the clerks).

(4) Preparation of an affidavit stating the name of the agent, the
number of owners of real estate at the time of the filing of
petition and the number of owners signing the petition.
(5) Ensuring that the legislative body of the municipality to which
the annexation is proposed, by ordinance or resolution, adopts
a statement indicating what services, if any, the municipal
corporation will provide to the territory proposed for annexation,
upon annexation. (The resolution or ordinance should include
.",- response times for fire, EMT and police units as well as information
concerning water and sewer hook-ups and other pertinent data).

(6) The Agent or Representative of the petitioners needs to be present
at the hearing to present the petition to the Board of County
Commissioners.
Proof of compliance with the above is required to be submitted to this
office no later than December 24, 1991.

A RESOLUTION TO SET FORTH A STATEMENT OF
SERVICES TO BE PROVIDED TO THE AREA IN A
PROPOSED ANNEXATION OF 139.183 ACRES IN
WASHINGTON TOWNSHIP, FRANKLIN COUNTY TO
THE CITY OF DUBLIN, OHIO AS REQUIRED BY
SECTION 709.031 OF THE OHIO REVISED CODE
AND DECLARING AN EMERGENCY.
WHEREAS, a petition for the annexation of 139.183 acres from
Washington Township was duly filed by David B. Hornbeck, agent
for the petitioner, Young Life Foundation of Colorado Springs,
Colorado; and
WHEREAS, a public hearing will be required before the Franklin
County Commissioners on January 8, 1992; and,
WHEREAS, section 709.031 of the Ohio Revised Code requires
that, prior to said hearing, the Municipal Authority shall
adopt a statement indicating what services, if any, the
Municipal Corporation will provide to the territory proposed
for annexation.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Dublin, State of Ohio, 7 of the elected members concurring
that:
section 1. The City of Dublin will provide the following
municipal services for the 139.183 acres in Washington
Township, Franklin county upon the annexation of said area to
the city of Dublin, Ohio:
Police. The City provides Police and Communications service
on a full twenty-four hour basis and also has mutual aid
agreements with other municipalities. The annexation area
lies approximately two miles south of Dublin I s Police Division
Headquarters. Dublin operates with a minimum of three
cruisers on duty. A response time of approximately three
minutes, for an emergency situation, should be expected in
this area.
Fire. Fire protection is currently provided by well-staffed
departments in Washington and Perry Townships. They too have
mutual aid agreements with other municipalities and townships.
This annexation would not change fire department
jurisdictional boundaries and therefore response times for
fire and emergency medical services will not be affected. The
Washington Township Fire station is approximately one mile
from the annexation area and normal response times should be
approximately two minutes.
Sanitation. Residential refuse collection services are
contracted by the City and are currently provided at no
additional charge.
Street Maintenance. The City has a street Maintenance
Division which provides excellent service in the area of
street and road maintenance. This divisiion also provides
curbside leaf pick-up at no additional charge.

section 2. The city has SEWER and WATER service contracts
with the City of Columbus, and the subject property is within
said service areas, and conditioned on the ability of the City
of Columbus to provide WATER, and to provide sufficient
SEWERAGE disposal capacity, the City will have the ability to
service the area.

declared to be an emergency measure for the preservation of
the public peace, health, or welfare of the residents of this
city, and therefore this Ordinance shall take effect and be in
force immediately upon its passage.

OF 139.183+ ACRES IN WASHINGTON TOWNSHIP
TO THE CITY OF DUBLIN, OHIO
CASE #ANX-37-91
I WHEREAS, the Commissioners of Franklin County, State of Ohio, proceeded on the 1st day of
April, 1992 to hear the petition of The Young Life Foundation, filed October 11, 1991, and having in open
hearing heard all of persons desiring to be heard for or against the granting of the petition, and having
considered all the facts with reference thereto, being fully advised, and
WHEREAS, the Commissioners make the following findings, based upon the exhibits and
testimony presented at the hearing of this matter:
1. The Petition contains all of the matters required by Ohio Revised Code Section 709.02
including, without limitation: A. A full description and accurate map or plat of the
I territory to be annexed; B. A statement of the total number of owners of real estate in the
territory to be annexed; C. The name of the person to act as agent for the petitioner.
I 2. The territory sought to be annexed is adjacent and contiguous to the City of Dublin, Ohio.
I 3. Notice of the petition and the hearing has been published as required by law, and all

notices of filing the petiton and the hearings thereon have been given and delivered as
required by law.
4. The persons whose names are subscribed on the petition are owners of real estate in the
territory sought to be annexed, and as of the time the petition was filed, the number of
valid signatures on the petition constituted a majority of the owners of real estate in the
territory proposed to be annexed.
5. The map or plat and the description of the territory contained in the petition are accurate.
6. The City of Dublin has complied with Division (B) of Ohio Revised Code Section
709.031.
7. The territory sought to be annexed is not unreasonably large.
8. The general good of the territory sought to be annexed will be served if the annexation
petition is granted and the annexation is allowed.
Therefore, upon the motion of Commissioner Fonlk , seconded by Commissioner
DeMoss :
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN COUNTY,
OHIO:
Section 1. That the prayer of the Petition be GRANTED, and the territory sought to be
annexed by the petition filed herein be annexed to the City of Dublin, Ohio, in accordance
with law; that the orders and proceedings of this board relating to the Petition, and map
and description attached thereto, and all papers on file relating to this matter be delivered
forthwith to the Clerk of Council, City of Dublin, Ohio.
